1.  Declaration of Interests

2.  Records of Meetings

The Panel noted and approved the records of the meetings held on 19th and 25th November 2024.  

 

3.  Proposed Budget 2025-2028 Review

The Panel noted that the Ministerial Response to its Scrutiny Report S.R.8/2024 was due to be presented by the Minister for Treasury and Resources by 9th January 2025. It was agreed that an area of questioning on the Ministerial Response would be included for the upcoming quarterly hearing with the Minister for Treasury and Resources, which was scheduled for 27th January 2025.

4.  OECD Pillar Two Review

The Panel noted and discussed the Ministerial Response presented by the Minister for Treasury and Resources on 29th November 2024 to the Scrutiny Report S.R.7/2024. The Panel agreed that an area of questioning on the Ministerial Response would be included for the upcoming quarterly hearing with the Minister for Treasury and Resources, which was scheduled for 27th January 2025.

The  Panel  discussed  ways  in  which  to  stay  abreast  of  the  implementation  of  the Organisation for Economic Co-operation and Development (OECD) Pillar Two taxation and agreed to consider this further following the public quarterly hearing with the Minister for Treasury and Resources.

The Panel discussed the potential for periodic briefings on implementation progress of the workstream and considered whether to hold a focused public hearing later in the year.

The Panel also discussed keeping communications ongoing with stakeholders with a view to gathering their views on the implementation of the OECD Pillar Two taxation.

The Panel thanked Deputy Renouf for chairing the OECD Pillar Two sub-panel.

 

5.  Control of Housing and Work Law Review

The Panel was updated that minor amendments to the draft proposals were still being considered by the Law Drafting Office. It was noted that the draft proposals had not yet been shared with the Panel in confidence as was anticipated by 31st December 2024.

The Panel noted that it was due to receive a briefing on the draft proposals which was scheduled for 14th January 2025.

The Panel noted and discussed an Officer briefing paper drafted to provide background and context in relation to the workstream to date. The Panel discussed the Common Population Policy Annual Report 2024 which was presented on 19th December 2024. The Panel agreed to request a briefing from the Chief Minister on the report.

The Panel discussed any potential overlap of the housing qualifications with the remit of the Environment, Housing and Infrastructure Panel but noted that the workstream was under the remit of the Panel.

The Panel discussed the High Value Residency 2(1)(e) workstream and agreed to request a private briefing to update on the matter.

6.  Occupational Health

The Panel noted and discussed the letter received in confidence from the Chief Minister to  provide  an  update  on  the  progress  of  the  tender  process  to  secure  a  future Occupational Health provider for the Government of Jersey.

The Panel noted that it was due to receive a private briefing to provide an update on the position regarding Occupational Health which was scheduled for 28th January 2025.

The Panel agreed to include an area of questioning on Occupational Heath for the next quarterly hearing with the Chief Minister on 7th March 2025.

7.  P.88/2024 States of Jersey Development Company: Pre-Sales Provisions for Residential  Developments  and  Pre-Lets  Provisions  for  Commercial Developments

The Panel noted and discussed P.88/2024 lodged by the Council of Ministers on 19th December 2024 for earliest debate in the States Assembly on 4th February 2025. The Panel agreed to request the deferral of the debate in order to further consider the proposals. The Panel agreed to write to the Chief Minister regarding the deferral request and to include a request for a briefing on the Proposition and further detail on certain aspects of the proposals.

8.  Quarterly Hearing – Minister for Treasury and Resources

The Panel noted its upcoming public quarterly hearing with the Minister for Treasury and Resources scheduled for 27th January 2025. The Panel discussed and agreed the question areas to include. It was noted that the draft question plan would be shared with

the Panel ahead of its next meeting on 14th January 2025 for its consideration and approval.

 

9.  Work Programme 2025

The Panel discussed and updated its work programme for 2025.

The Panel discussed the report by the Jersey Law Commission – Keeping the Complaints Panel or Creating the Ombudsperson and agreed to request a meeting with its author.

10. Upcoming Briefings, Meetings and Hearings

The Panel noted the various briefings, meetings and hearings which were scheduled for quarter one 2025.

The Panel noted its upcoming public hearing on Gender Pay Gap on 12th February 2025. The  Panel  discussed  potentially  co-opting  a  non-Panel  States  Member  for  that workstream. The Chair agreed to raise this accordingly with the potential Members and revert to the Panel in due course.

11. Training

The Panel noted that the Scrutiny Liaison Committee was arranging questioning training with the Solicitor General and had extended the invite for training to all Scrutiny Panels.

The Panel discussed the potential training and agreed that it would accept the invite.

The Panel noted that its next scheduled meeting was at 9:30am on Tuesday 14th January 2025 in the Blampied Room of the States Building.

The Panel discussed the briefing received and agreed, in the first instance, to follow up with questions during its upcoming quarterly hearing with the Chief Minister on 7th March 2025. The Panel also agreed to consider a potential public hearing on population policy for later in the year.

 

4.  Proposed Budget 2025-2028 Review

 

 

The Panel noted and discussed the Ministerial Response presented jointly by the Chief Minister and Minister for Treasury and Resources to the States Assembly on 9th January 2025 in respect of the Panel's Scrutiny Report S.R.8/2024. The Panel agreed to include an area of questioning on the Ministerial Response for its upcoming quarterly hearing with the Minister for Treasury and Resources on 27th January 2025. It was further agreed that an area of questioning would also be included for the quarterly hearing with the Chief Minister on 7th March 2025.

5.  Control of Housing and Work Law Review

The Panel recalled the request received from Deputy Carina Alves , Assistant Chief Minister, to postpone the Control of Housing and Work Law briefing as the draft legislation was still being finalised. The Panel noted that an alternative date to receive the briefing had been requested and would be confirmed in due course.

6.  Quarterly Hearing – Minister for Treasury and Resources

The Panel noted its upcoming public quarterly hearing with the Minister for Treasury and Resources which was scheduled for 27th January 2025. The Panel discussed a draft question plan and raised some suggested changes. The Panel agreed to further consider the draft question plan ahead of finalising it at a meeting scheduled for Monday 20th January 2025. It was noted that the question areas would also be shared with the department on that day.

7.  P.88/2024 States of Jersey Development Company: Pre-Sales Provisions for Residential  Developments  and  Pre-Lets  Provisions  for  Commercial Developments

The Panel noted its letter sent to the Chief Minister requesting further detail on the proposals within P.88/2025 and its request to defer the States Assembly debate on the Proposition from 4th February to 25th February 2025. The Panel noted and discussed the response received from the Minister for Treasury and Resources. The Panel noted that its deferral request was accepted and that a briefing on the proposals had also been confirmed for 20th January 2025. The Panel raised that the response had not fully provided all the information that was requested, however, the Panel agreed to explore those aspects further during the briefing.

 

8.  Upcoming Briefings, Meetings and Hearings

The Panel noted the various briefings, meetings and hearings which were scheduled for quarter one 2025.

The Panel noted an invitation extended to it to discuss the Jersey Law Commission's work on the Human Rights (Jersey) Law and agreed for this meeting to be arranged accordingly.

The Chair agreed to raise the potential for co-opting a non-Panel States Member to its Gender Pay Gap workstream with potential Members and to revert accordingly.

1.  Briefing: States of Jersey Development Company: Pre-Sales Provisions for Residential  Developments  and  Pre-Lets  Provisions  for  Commercial Developments (P.88/2024)

The Panel received Government Officers for a briefing on the proposals for the States of Jersey Development Company (SoJDC) pre-sales and pre-lets provisions - P.88/2024 which was lodged by the Council of Ministers on 19th December 2024. The briefing was held in private in accordance with the Freedom of Information (Jersey) Law 2011 (as amended) under Qualified Exemption Article 35.

The Panel discussed the briefing received and agreed to present Comments ahead of the States Assembly debate on the Proposition which was deferred from 4th February to 25th February 2025 at the Panel's request. The Panel also agreed to request a further private meeting with the Chair and Chief Executive Officer of the SoJDC and to include an area of questioning on P.88/2024 for its upcoming quarterly hearing with the Minister for Treasury and Resources on 27th January 2025.
