RE: Legislative Programme for 2025  

Thank you for your letter dated 20th January 2025 regarding the legislative programme for Infrastructure for 2025.

Please find further details of the legislative programme for the five areas below, as requested.

Amendment to the Regulation of Care (Jersey) Law 2014

Amendments to the Law to introduce regulation for hospital and ambulance services have been developed and refined, following the conclusion of a public consultation on 3 June 2024. The draft Amendment Law requires further amendments to address concerns that the Law currently places liability for providing government services on senior officials personally. It is anticipated that these changes will be made in time to enable Ministers to reconsider the draft Amendment Law in Q2 2025.

Animal Welfare (Jersey) Law 2004  

The Animal Health and Welfare law is now in its 7th draft and close to being finalised. We are also working on secondary legislation that will need to come into place in parallel to the new law.

Food (Jersey) Law 2023

The new Food (Jersey) Law 2023 is awaiting its appointed day act. Before this can proceed, secondary food legislation must be drafted. This includes regulations on labelling and allergens, food safety and hygiene and management and licensing of food businesses. These regulations are interdependent and are currently being drafted. The goal is to present this legislation to the Assembly at the end of 2025 or early 2026.

Trawling Netting Dredging Regulations  

The Trawling Netting and Dredging regulations have required updating since Brexit. While the situation has been manged through licence conditions while the TCA stabilised it is now time to bring the legislation up to date and to house all mobile fishing gear rules in one place. The work has been scoped and is near ready for MD and drafting.

This work is vital to ensure clean management of the fishery and meet the conservation objectives of the Marine Spatial Plan. Updating the regulation will also simplify and reduce the overall volume of regulation applicable to fishers by removing duplication and overlaying that was needed in the days of the Bay of Granville Agreement.

Amendments to the Planning and Building (Jersey) Law  

As part of the wider planning service reform identified in the CSP, work is being undertaken to consider amendment to the Planning and Building (Jersey) Law and associated secondary legislation. The scope of this work will include a review of the General Development Order; the planning appeals process; and the island plan review process, together with a review of the form of the island plan itself.

It is proposed that consultation on proposed change is undertaken in the second quarter of the year, with a view to change being made to the legislative framework for planning by the end of the year.

Bridging Island Plan  

The Island Plan is a policy document and does not form part of the legislative programme for 2025.
