REPORT

On 16th December 2025 the Minister for Treasury and Resources made a Ministerial Decision delegating certain of her functions under Articles 28, 30 and 30A of the States of  Jersey  Law  2005 (see  Decision  reference  MD-TR-2025-956,  available  at www.gov.je).

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

 

Delegate:

The Treasurer of the States

Functions delegated:

incorporate the  Limited Liability Company on behalf of the Minister  for  Treasury  and  Resources. The  Minister  for Infrastructure was also briefed on this arrangement on 2 October 2025; and

enter into leases on behalf of the LLC to facilitate decisions made in MD-TR-356

Further to:

MD-TR-356, as part of which the Minister for Treasury and Resources agreed to  put  into  place optimal and  legally  binding  arrangements  for  the  new Government Headquarters (Union St Office building) to be held as a local infrastructure investment for the Social Security (Reserve) Fund; and

briefing to the  Minister for  Treasury  and  Resources received  on 15  August 2025 in respect of the intention to enter into a 99-year lease of land from the Public of the Island (as Landlord) to a Limited Liability Company (as Tenant), incorporated for the purposes of the legal arrangement referred to above, and a further  lease  from  the Limited  Liability  Company  (as  Landlord) to Jersey Property Holdings (as Tenant);

There  is  a  need  to  formally  delegate authority to and  direct the  Treasurer  of  the States to:

incorporate the aforementioned Limited Liability Company on behalf of the Minister for Treasury and Resources. The Minister for Infrastructure was also briefed on this arrangement on 2 October 2025; and

enter into leases on behalf of the LLC to facilitate decisions made in MD-TR- 356
