REPORT
Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that she has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above. (More detail on the transfer is given below.)
Background
The Freedom of Information (Jersey) Law 2011 falls under the Chief Minister's list of responsibilities, with certain duties placed on the Information Commissioner to encourage good practice and to be the receiving body for appeals.
For the last 3-years, the Department for the Economy has supported freedom of information activities as part of the wider data protection responsibilities of the Jersey Office of the Information Commissioner that rest within the Minister for Sustainable Economic Development's (MSED's) Ministerial duties. In this time governance and reporting metrics have improved and data protection and freedom of information governance have been formally separated.
Expertise and policy officer resource for freedom of information activities sit within the Central Information Governance Team, Cabinet Office and over the past 3 years these officers have provided the necessary expert knowledge to ensure the requirements of the grant agreement and legal duties of the Information Commissioner have been met.
Therefore, to avoid continual duplication of resource, and to ensure efficiency of operation, the Minister for Sustainable Economic Development has asked that responsibility for renewal of the grant agreement will be handed over to the Central Information Governance Team. The 3-year grant agreement expired with the Department for the Economy on 31 December 2025.
To support the transition of governance responsibilities, the Minister is happy that the current annual grant of £70,000 to the Information Commissioner for freedom of information activities be internally transferred from the Department of Economy to the Cabinet Office, effective from 1 January 2026.
