REPORT
Article 29A(3) of the States of Jersey Law 2005 requires the Chief Minister to present a report to the States Assembly for a 14-day notice period before making an Order to amend the name by which a Minister is described and/or to make provision relating to a Minister's functions (including their transfer from one Minister to another).
Accordingly, this report appends a draft Order (see below) that would achieve proposed changes to Ministerial Offices, as set out below, and which makes consequential legislative amendments, and commences a notice period of 14 days.
It is intended that the Order will be finalised and made at the conclusion of the 14-day notice period.
Once finalised, it is intended that an election take place for the newly created role of Minister for Planning and Regulation.
Proposed Changes
Introduction of the role of Minister for Planning and Regulation and subsequent transfer of functions
The dedicated office of Minister for Planning and Regulation will focus on planning matters and work to deliver an improved regulatory environment. It will also enable the Minister for the Environment to focus on the environment and take on responsibilities for the agriculture and marine sectors; functions which are currently assigned to the Minister for Sustainable Economic Development.
The separation and reassignment of functions will support a greater focus for each of the Ministers on specific areas.
The specific changes required are listed in the Order below.

THE CHIEF MINISTER makes this Order under Article 29A of the States of Jersey Law 2005 after complying with paragraph (3) of that Article –
1 Article 1 (current list of Ministerial offices) of States of Jersey (Ministerial
Offices) Order 2022 amended
In Article 1 of the States of Jersey (Ministerial Offices) Order 2022, after "the Minister for Justice and Home Affairs" there is inserted "the Minister for Planning and Regulation".
2 Transfer of functions from Minister for the Environment
Schedule 1 contains amendments to enactments that transfer some of the functions of the Minister for the Environment to the Minister for Planning and Regulation.
3 Transfer of functions from Minister for Sustainable Economic Development
- Schedule 2 contains amendments to enactments that transfer some of the functions of the Minister for Sustainable Economic Development to the Minister for Planning and Regulation.
- Schedule 3 contains amendments to enactments that transfer some of the functions of the Minister for Sustainable Economic Development to the Minister for the Environment.
4 Transfer of functions from Minister for Health and Social Services
In Article 1(1) of the Community Provisions (Food Supplements) (Jersey) Regulations 2014, for "Minister for Health and Social Services" there is substituted "Minister for Planning and Regulation".
5 Title
This Order is the States of Jersey (Ministerial Offices) Amendment Order 202-.
6 Commencement
- Schedule 3, paragraph 2 comes into force when Article 1 of the Agricultural and Fisheries (Loans) (Jersey) Law 202- comes into force.
- The rest of this Order comes into force on the day after it is made.
