What is the problem or issue the decision is trying to address?

Do children experience this problem differently from adults?

  1. The end-of-life care proposition asks the Minister to be required by law to provide for end-of-life services in Jersey, and to request the Minister to lodge the legislation necessary to give effect to that decision, for consideration by the Assembly before the draft Assisted Dying (Jersey) Law 202- comes into full force.
  1. The report and proposition sets out that the law would apply to the provision of end-of-life care for both adults and children,

2)  Which groups of children and young people are likely to be affected?

Groups of children could include early years, primary or secondary education; young adults; children with additional learning needs; disabled children; children living in poverty; children from particular ethnic backgrounds; migrants; refugees; care experienced children and LGBTQ+ children

All islanders would be affected equally, that is to say, not directly affected by a decision to develop an end-of-life law.

Should the law be introduced (i.e. a future decision following debate on the draft law by States Assembly) this would impact both adults and children with a diagnosis of a terminal medical condition, and adults and children with family members who have a terminal diagnosis.

3)  What is the likely impact of the proposed decision on children and on their rights?

Identify any potential positive OR negative impacts and include indirect impacts on children and their rights as described in the UNCRC

Will different groups of children be affected differently by this decision?

This decision will have no direct impact on children and on their rights.

Should the decision result in the requirement for the Minister for Health and Social Services to develop legislation to provide for end-of-life services in Jersey, at that stage there will be an impact on children.

A full CRIA is not required because the decision to develop a draft law will not have a direct impact on children.

If the decision made by the Assembly is that legislation should be developed, then there will be an impact on children at the next stage in the process, and a full CRIA will be required at the time of lodging the draft law.
