Income Support Medical Appeal Tribunal: re-appointment of Chair (P.76/2025) – Children’s Rights Impact Assessment

1)  Name and brief description of the proposed decision

The subject of your CRIA may be a proposed law, policy or proposition and in accordance with the Law is referred to in this template as the ‘decision'

• What is the problem or issue the decision is trying to address?

The decision is to approve the re-appointment of Chair to the Income Support Medical Appeal Tribunal (ISMAT). The individual concerned has already served an initial 5 year period as Chair and the proposal is that they serve a further second period of up to four years.

2)  Which groups of children and young people are likely to be affected?

Groups of children could include early years, primary or secondary education; young adults; children with additional learning needs; disabled children; children living in poverty; children from particular ethnic backgrounds; migrants; refugees; care experienced children and LGBTQ+ children

The ISMAT hears appeals on the award of the Impairment Component under the Income Support system. These assessments can include children of any age who have a physical, sensory or mental impairment.

3)  What is the likely impact of the proposed decision on children and on their rights?

• Identify any potential positive OR negative impacts and include indirect impacts on children and their rights as described in the UNCRC

• Will different groups of children be affected differently by this decision?

The ISMAT will review all facts placed before it and may confirm, reverse or vary the decision made by Determining Officers of the Employment, Social Security and Housing Department. The position of Chair of the ISMAT is therefore crucial in ensuring that decisions are made in accordance with the relevant legislation.

The ISMAT is a compliant body under Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, agreed by the Council of Europe at Rome on 4th November 1950 as it has effect in Jersey under the Human Rights (Jersey) Law 2000.

The ISMAT therefore ensures that children have the same opportunity as adults to exercise their Article 6 compliant rights under the Income Support (Jersey) Law 2007 to challenge a decision made under that law regarding their care needs.
