REPORT

Background

The  Sea Fisheries (Jersey) Law 1994 is the overarching Law that makes provision for the regulation of sea fishing and conservation of fish. The Sea Fisheries (Minimum Size Limits) (Jersey) Regulations 2001 (the 2001 Regulations) is made under Article 2 and 6 of the 1994 Law and prescribes the minimum size of fish that can be retained. An amendment is required to define new a minimum size for lobster.

Recommendation

It is proposed the minimum size for lobster will increase to 90 mm carapace length in 1 mm increments. This amendment to increase the minimum size from 88 mm to 89 mm is the second phase (of three) of this recommendation.

The Minister for the Environment has accepted the recommendations of the Lobster Working Group who have worked to improve lobster stock management over the last 5 years.

There are no additional financial or staffing implications, as these will be met within current department operations.

EXPLANATORY NOTE

These Regulations, if made, will amend the Schedule to the Sea Fisheries (Minimum Size Limits) (Jersey) Regulations 2001 to increase the minimum size limit from 88 mm to 89 mm of lobster that can be landed, sold, exposed or offered for sale or retained in possession.

These Regulations come into force on 16 September 2025.

1  Sea Fisheries (Minimum Size Limits) (Jersey) Regulations 2001 amended

These  Regulations  amend  the  Sea  Fisheries  (Minimum  Size  Limits)  (Jersey) Regulations 2001.

2  Schedule amended

In the Schedule, Part 3, in the entry "Lobster (Homarus gammarus)", in column 2, for "88" there is substituted "89".

3  Citation and commencement

These Regulations may be cited as the Sea Fisheries (Minimum Size Limits) (Jersey) Amendment Regulations 202- and come into force on 16 September 2025.
