REPORT
These draft Regulations, if adopted, would re-designate Springfield Sports Ground in the Policing of Parks (Jersey) Regulations 2005 from its current status as a Part 5 park to a Part 1 park. This would lift the current blanket ban on dogs being taken into the confines of Springfield.
Under its current designation as a Part 5 park, dogs cannot be taken into the boundaries of Springfield Sports Ground even if they are kept on a lead. This is likely due to the fact that, prior to 2015, Springfield hosted a grass football pitch, and the Part 5 designation will have been to ensure that dogs were kept off the original pitch. The grass pitch was replaced in 2015 with a 3G (artificial) playing surface, and the pitch is now protected by fencing.
Strictly speaking, any person who violates the 2005 Regulations is guilty of an offence and liable to a fine of level 2 on the standard scale (£1,000).
In respect of Springfield, it is recognised that the Regulations are now more honoured in the breach than the observance. Given the changes since 2015, it seems logical for the legislation to catch up with practice, rather than to seek to enforce the existing statutory provision, which would seem to be disproportionate and somewhat illogical. Accordingly, and should the States agree to this re-designation of Springfield as a Part 1 park, it will be possible to walk a dog on a lead on established paths within the boundaries of Springfield Sports Ground.
The designation of Springfield as a Part 1 park is a workable arrangement, particularly given that the 3G pitch is more secure (with the surrounding fencing) than the original grass pitch, which was effectively unprotected.
It is noteworthy that, following the recent installation of new signage at Springfield which reflected its existing designation as a Part 5 park, representations have been made by members of the public and parish representatives seeking the change proposed in these draft Regulations.

Draft Policing of Parks (Jersey) Amendment Regulations 202- Explanatory Note
EXPLANATORY NOTE
These Regulations, if passed, will amend the Policing of Parks (Jersey) Regulations 2005 (the "2005 Regulations") so that Springfield Sports Ground moves from Part 5 of the Schedule to the Regulations to Part 1 of the Schedule to the Regulations.
Under Regulation 5(4) of the 2005 Regulations a person may take a dog into a "Part 1 park" so long as the dog is kept on a lead and is kept within the confines of established paths while it is in the park. The effect of this amendment is therefore to enable people to walk their dogs at Springfield Sports Ground in accordance with Regulation 5(4), without committing an offence.

THE STATES make these Regulations under the Loi (1851) autorisant l'établissement des règlements sur la police des chemins and Article 92 of the Road Traffic (Jersey) Law 1956 –
1 Policing of Parks (Jersey) Regulations 2005 amended
These Regulations amend the Policing of Parks (Jersey) Regulations 2005.
- In Part 1 of the Schedule, after the Plan relating to South Hill and Mount Bingham Gardens and La Colette Gardens there is inserted –
- In Part 5 of the Schedule, the plan relating to Springfield Sports Ground is deleted.
These Regulations may be cited as the Policing of Parks (Jersey) Amendment Regulations 202- and come into force 7 days after they are made.
