REPORT
Background
The Food (Jersey) Law 2023 was passed by the States Assembly in December 2022 (P.105/2022).
The Law outlined several areas where secondary (or subordinate) legislation was required to bring certain of its provisions into effect. For example, Article 20 of the primary Law stated that Regulations may make provision relating to allergens and Article 6 referred to Regulations providing for the licensing of food businesses.
The Regulations containing these and other provisions have now been drafted and are lodged for debate. If adopted, these Regulations would come into effect on 1 October 2026.
The adoption of these Regulations means that it is now appropriate for the Food (Jersey) Law 2023 to come into force 7 days after this Act is passed.
Financial and staffing implications
There are not additional financial or staffing implications for Government as a result of this proposition.
Children's Rights Impact Assessment
I consider that the Draft Act, in itself, has no direct or indirect impact on children and that the duty to have due regard to the UN Convention on the Rights of the Child does not arise. Accordingly, a Children's Rights Impact Assessment is not required for the Draft Act under the Children (Convention Rights) (Jersey) Law 2022. However, a Children's Rights Impact Assessment (CRIA) was published as Appendix 1 of the Food (Jersey) Law 202- (P.105/2022) when it was lodged in 2022 and is available to read on the States Assembly website.
Draft Food (Jersey) Commencement Act 202- Explanatory Note
EXPLANATORY NOTE
This Act, if passed, will bring the Food (Jersey) Law 2023 into force 7 days after the Act is passed.
The Food (Jersey) Law 2023 repeals the Food Safety (Jersey) Law 1966 and the Food Safety (Miscellaneous Provisions) (Jersey) Law 2000 and replaces them with a new Law that reflects the standards and practices used in the United Kingdom and the European Union. This includes obligations on food business operators to ensure that food is fit for human consumption and powers to serve notices and enforce the Law.
