AnnouncementThe Bailiff, Sir Timonthy Le Cocq, announced that Her Royal Highness, the Princess Royal, will be visiting Jersey on 4th and 5th November. Princess Anne will unveil a portrait of King Charles and Queen Camilla to commemorate their visit to the Island in July 2024. The Princess will also attend several other public engagements.
Tribute
The Bailiff paid tribute to Mr Brian Richardson, former Connétable of Trinity between 1993 and 1996, who passed away on 11th September aged 76. Mr Richardson had served his Parish for many years before retiring from politics.

P.42 - Draft Bank (Recovery and Resolution) (Jersey) Amendment Law 202-
The Minister for External Relations, Deputy Ian Gorst, proposed that to consolidate and strengthen Jersey’s response to bank failures, the functions fall under the sole remit of the Jersey Resolution Authority. The Proposition would bring legislation for both resolution and compensation schemes under the same Law.
This debate is a continuation, after the Principles were adopted on July 9 and the Proposition was referred to the Economic and International Affairs Scrutiny Panel.

P.52 – Health and Care Jersey Advisory Board and Partnership Board
Prior to any vote on either the Proposition or the Amendment, Deputy Renouf sought to bring the proposition back to scrutiny for further review (“Reference Back”). This request was rejected, with 11 votes for, 35 against, and 1 abstention.
The Minister for Health and Social Services, Deputy Tom Binet, proposed that the non-statutory Health and Community Services Advisory Board should continue to operate and provide improved governance and oversight for the services delivered by Health and Care Jersey; and that a new non-statutory Health and Care Jersey Partnership Board should also be established.

P.52 – Health and Care Jersey Advisory Board and Partnership Board – amendment
The Health and Social Security Scrutiny Panel proposed an amendment to the Minister’s proposition, requiring that – following a review of the performance of the new Health and Care Jersey Partnership Board after 18 months – the Minister must determine whether the Board should continue to operate under these (or amended) terms of reference, or be disbanded.

The States Assembly voted to REJECT the Panel’s amendment with 16 votes for, 30 votes against and 0 abstentions.
The Assembly then opted to vote on the Minister’s unamended proposition in two parts:
Part A: The Health and Community Services Advisory Board should continue to operate and provide improved governance and oversight for the services delivered by Health and Care Jersey.
The States Assembly voted to APPROVE Part A of the Minister's proposition with 45 votes for, 0 votes against and 0 abstentions.
Part B: That the Minister for Health and Social Services should establish a new non-statutory Health and Care Jersey Partnership Board.
The States Assembly voted to APPROVE Part B of the Minister's proposition with 33 votes for, 7 votes against and 5 abstentions.

P.53/2025 Draft Sea Fisheries (Minimum Size Limits) (Jersey) Amendment Regulations 202-.
The Minister for the Environment, Deputy Steve Luce, proposed an amendment to the Sea Fisheries (Minimum Size Limits) (Jersey) Regulations 2001 which will see the minimum size for a lobster that can be landed, sold, exposed, offered for sale or retained, rising from 88mm to 89mm. This will be read as amended.

P.61/2025 - Statutory Pre-Sale Agreements for Standard Residential Property Transactions
Deputy Max Andrews proposed that all residential property transactions – excluding some specific cases, such as intra-family transfers - must include a legally binding pre-sale agreement between seller and purchaser; and that these agreements must include a financial penalty to be paid by the seller or purchaser should they default on the agreement without a legitimate reason.
The Deputy has also requested the Chief Minister brings forward for approval the necessary legislation to give effect to this decision no later than June 2028.

P.61/2025 - Statutory Pre-Sale Agreements for Standard Residential Property Transactions – amendment
The Council of Ministers proposed an amendment to Deputy Max Andrews’ proposition, asking the States to undertake a consultation on the effectiveness of the residential property transaction process, and consider whether residential property transactions should include a legally binding pre-sale agreement between seller and purchaser.
The amendment also requests the Chief Minister to present a report to the Assembly on the outcome of the consultation, including the role and scope of the use of pre-sale agreements and whether these should be considered as part of future legislation, no later than June 2027.
