Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Corruption) (Jersey) Order 2021.
Minister for External Relations and Financial Services.
This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Global Anti-Corruption Sanctions Regulations 2021 of the United Kingdom. Those Regulations revoke the Misappropriation (Sanctions) (EU Exit) Regulations 2020, and impose asset freezes and immigration sanctions on persons designated by the United Kingdom on the basis of suspected involvement in (or association with persons involved in) serious bribery or serious misappropriation of property.
The Order also ensures that, if provisions of UK sanctions Regulations are repealed and re-enacted by subsequent UK sanctions Regulations, then the references in the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to the repealed UK provisions are treated as references to the re-enacted UK provisions.
The Order was made on 26th April 2021 and came into force on 27th April 2021.

Control of Housing and Work (Exemptions) (Amendment No. 5) (Jersey) Order 2021. Chief Minister.
This Order amends the Control of Housing and Work (Exemptions) (Jersey) Order 2013 ("the principal Order") to implement obligations under the World Trade Organisation General Agreement on Trade in Services (GATS) relating to business visitors in Jersey for establishment purposes.
Article 1 introduces the amendments to the principal Order.
Article 2 amends Article 1 of the principal Order to add a definition of "business visitor for establishment purposes" and related definitions.
Article 3 amends Article 2 of the principal Order so that a person who is a business visitor for establishment purposes and who is in Jersey for an aggregate period of 90 days or less in any 12 month period does not need a registration card for work.
Article 4 amends Article 3 of the principal Order so that an undertaking is not required to have a business licence in respect of a business visitor for establishment purposes who is in Jersey for an aggregate period of 90 days or less in any 12 month period.
Article 5 amends Article 4 of the principal Order to disregard from the maximum numbers condition in a business licence any business visitor for establishment purposes who is in Jersey for an aggregate period of 90 days or less in any 12 month period.
Article 6 sets out the name by which the Order may be known and that it comes into force 7 days after it is made.

Covid-19 (Workplace Restrictions) (Amendment No. 11) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to remove the requirement for food and drink premises to close by 11.30 p.m. It does not remove the requirement that the food and drink (other than to take away) are consumed only while seated at a table, or the requirement for customers to wear masks indoors while not seated at a table. It also does not affect any other legal obligation to close at a certain time, such as for premises holding an alcohol licence.

Pedal Cycles (Amendment No. 4) (Jersey) Order 2021. Minister for Infrastructure.
This Order amends the Pedal Cycles (Jersey) Order 1998 ("1998 Order") by changing the requirements for a bicycle or tricycle to be classed as an "electrically assisted pedal cycle" and not a "motor vehicle" under the Road Traffic (Jersey) Law 1956.
Article 1 is an interpretation provision.
Article 2 amends definitions in the 1998 Order including updating references to technical standards.
Article 3 amends the requirements with which an electrically assisted bicycle or tricycle must comply to enable it to be excluded from the definition of "motor vehicle" in the Road Traffic (Jersey) Law 1956. Article 3 removes the current requirement specifying a maximum weight for the vehicle and increases the maximum speed at which the motor can propel the vehicle from 15 miles per hour to 15.5 miles per hour. The maximum power output of the motor remains unchanged at 250 watts.
Article 4 amends the requirements concerning when an electrically assisted bicycle or tricycle can be ridden on a road or cycle track. Alternative provision is made to the existing requirement for such a cycle to be fitted with a plate showing the battery voltage and continuous motor output as defined in British Standard 1727: 1987. Instead such a pedal cycle may be visibly and durably marked showing the maximum speed at which it can be propelled by a motor and the maximum motor output. Article 4 also updates the requirements for braking systems to refer to the relevant 2014 British Standard in place of the current reference to the relevant 1981 British Standard.
Article 5 sets out the name of this Order and provides for it to come into force 7 days after the day it is made.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Myanmar (Sanctions) Regulations 2021 of the United Kingdom, which replace the Burma (Sanctions) (EU Exit) Regulations 2019.

Planning and Building (General Development) (Amendment No. 7 – Covid19) (Jersey) Order 2021. Minister for the Environment.
This Order amends Part 9 of Schedule 1 to the Planning and Building (General Development) (Jersey) Order 2011, which gives general permission for temporary development in respect of emergency medical and related facilities for government to deal with the Covid-19 pandemic.
The effect of the amendment is to add a further year to the limitation of time for the developments and changes of use of land, allowing the facilities which have been temporarily created to remain in place until May 2022.
The Order was made on 4th May 2021 and came into force on 5th May 2021.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 6) (Jersey) Order 2021. Minister for Health and Social Services.
This Order makes further relaxations to the restrictions imposed as a consequence of Covid-19.
Article 1 amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to remove the final category of workplace which had to be closed for all purposes, namely jacuzzies, plunge pools, steam rooms, saunas, Turkish baths, and the like. These workplaces are now able to open for all purposes.
Article 2 amends the Covid-19 (Gathering Control) (Jersey) Order 2020. The definition "open air" is amended to include structures open on half of their sides. The restriction on gathering in private gardens is extended to cover 50 people aged 5 and over for outdoor wedding and civil partnership receptions as well as celebrations. There are now no limits on numbers gathering in private gardens previously hired out or booked for hire by non-family members before the Order came into force. These provisions apply to all outdoor spaces associated with homes, including marquees or other temporary structures placed there.
Article 3 provides for how the Order is to be cited and for it to come into force on 10th May 2021. The Order was made on 7th May 2021 and came into force on 10th May 2021.

"Will the Minister advise whether the St. Helier Open Space Survey of 2018 included analysis of access to open spaces in relation to specific areas of St. Helier – for example, by Vingtaine, the Ring Road, the North of Town; and, if so, will he provide a breakdown of the quality standards and access standards in all such areas in relation to the 5 typologies, namely parks, play space, outdoor sports facility, amenity greenspace and natural greenspace?"

"Will the Minister advise what standards are currently used for the provision of outdoor space per pupil in primary schools in Jersey; and to what extent do Janvrin, Rouge Bouillon, Springfield and St. Luke's Schools comply with these standards?"
- The Minister for Children and Education tabled an answer on 11th May 2021 to the following question asked by Deputy I. Gardiner of St. Helier –
"Will the Minister advise –
- which town schools, if any, have reached capacity;
- how many pupils, if any, are unable to attend school in their catchment area because of such capacity issues;
- what criteria are used to determine the catchment area for a school; and
- when the school catchment areas were last reviewed?"

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
