In paragraph (a) of the proposition after the words au Greffe' insert the words -

" ex c e p t that all members of the Council of Ministers shall be bound by any rules on collective responsibility which

may be agreed by the States".

Report

The  Policy  and  Resources  Committee  has  already  said  in  its  comments  on Machinery  of  Government:  Freedom  of Representation' (P.25/2002)  that,  in  its  view,  ministerial  government  will  not  work  without  a  measure  of  collective responsibility.

The Policy and Resources Committee has prepared a report and proposition on the functioning of the Executive under the new system of government as approved by the States. This report and proposition includes a section that will ask the States to approve basic rules and exemptions that will apply in relation to collective responsibility and, in the event of the States approving those rules, it would not be appropriate for the present proposition to override them.

This amendment, if approved, will ensure that whatever rules are eventually approved by the States regarding collective responsibility, will be applied without impediment.

There are no financial or manpower implications arising from this amendment.
