In paragraph (a)(iii), delete the words"applicant for, or holder of, a permit", and substitute the word "person".

REPORT

As the Report to P.107/2004 correctly states, "the one group of people who have been... ignored in this whole debate is... the general public."

As drafted, paragraph (a)(iii) of P.107 would restrict the right of appeal on a decision to grant or revoke a permit, to people who happened to be applicants for, or holders of, a permit (even if that permit was not the one in dispute). Therefore only traders would have a say in the matter.

If the voice of the general public is to have effect, any interested person should be able to appeal to the Connétable against any decision in this sphere.

This amendment has no implications for the financial or manpower resources of the States.
