In the list setting out the proposed composition of the Panel

  1. d e le tethewords "the senior Senator" and "the senior Deputy ";
  2. fo r the words "three other members elected by ballot" substitute the words "five other members elected by ballot"; and
  3. d e lete the words "except that if either the senior Senator or Deputy are already members of the Panel by virtue of holding another office their place on the Panel shall be filled by the next most senior Senator or Deputy in the roll of elected members who is not already a member of the Panel."

When the composition of the Bailiff 's Consultative Panel was revised in 2003, it was amended to include, the senior Senator, the senior Connétable , and the senior Deputy '. I do not think that there is any justification for appointments to be based purely on time served except, perhaps, in the selection of persons charged with giving the traditional Christmas messages in the Assembly. The purpose of this amendment is to ensure that all States' members involved in this advisory body are either on the Panel by virtue of being elected to positions which are considered to be relevant to the Panel's operation, or by virtue of being elected to fill one of the vacancies for other States' members whom the States, as a whole, wish to select to do so.

(The Chairman of the Comité des Connétable s is elected by the Comité and not appointed on the basis of seniority.)

To achieve this outcome I am proposing that neither the senior Senator nor the senior Deputy has the automatic right to be on the Panel, and accordingly that the number of additional States' members be increased from three to five.

There are no financial or manpower implications for the States arising from the adoption of this amendment.
