THE STATES are asked to decide whether they are of opinion

to request the Minister for the Environment to rescind the Ministerial Decision MD-PE-2018-0060 relating to the planning application in respect of Retreat Farm, La Rue de la Frontière, St. Mary and Rue des Varvots, St. Lawrence (known as Tamba Park).

REPORT

After consultation with the Bailiff and the Greffier of the States, I have taken advice to amend  the  proposition,  removing  the  requirement  to  refer  the  matter  for  the consideration by the Planning Committee, due to a concern that it would not be legal under Article 12(2)(a) of the Planning and Building (Jersey) Law 2002.

There are no additional financial or manpower implications for the States arising from this amendment.
