Note:  After this amendment, the proposition would read as follows –

THE STATES are asked to decide whether they are of opinion

to agree, in accordance with the provisions of Regulation 4(5) of the Gambling (Channel Islands  Lottery) (Jersey) Regulations  1975, to allocate no more than £1,762,380 to be paid in tranches of £250,000 at intervals of not less than 2 weeks, to the Association of Jersey Charities to  enable  the  charitable  sector  in  Jersey  to  support  the  Island community in its response to the impact of Covid-19; such arrangement to remain in place until the earlier of: (i) the Minister for Economic Development, Tourism, Sport and Culture determining the Covid-19 crisis is over; or (ii) new distribution agreements are put in place, at which time funds forming part of the said £1,762,380 which have not been paid will be subject to any such new distribution arrangements; and to request the Minister for Economic Development, Tourism, Sport and Culture to ensure that the quarterly reports provided to him by the Association of Jersey Charities are presented to the States Assembly within 5 working days of having been received.

REPORT

This amendment has been lodged to ensure that the appropriate checks and balances are in place in respect of this Proposition.

The Proposition refers to the allocation of £1,762,380 million "in tranches of £250,000", but it does not stipulate how frequently. Therefore, the Panel's amendment provides more certainty over the wording to include "at intervals of not less than 2 weeks". This will ensure that large sums of money (no more than £250,000) are not being distributed within too short a time period.

The Proposition also stipulates that arrangements will remain in place until either the Covid-19 crisis is over or new arrangements are in place. The Proposition does not in itself deal with what happens to any balance unpaid at the time of the crisis being deemed over. The Panel has therefore inserted that "new distribution agreements are put in place at which time funds forming part of the said £1,762,380 million which have not then been paid will be subject to new distribution arrangements to be put in place". This will ensure that any money left over from the distribution amount for the purpose of the Covid-19 crisis can be distributed appropriately once it is deemed over. The Panel has also inserted that the Minister for Economic Development, Tourism, Sport and Culture can deem the crisis to be over in terms of charities no longer requiring funding specifically for Covid-19 purposes.

In order to ensure that appropriate levels of due diligence are in place, the Panel has also inserted that the quarterly reports provided to the Minister for Economic Development, Tourism, Sport and Culture by the Association of Jersey Charities are presented to the States Assembly within 5 working days of having been received.

Financial and manpower implications

There are no additional financial or manpower implications for the States arising from this amendment.
