Note:  After this amendment, the amendment would read as follows – 1  PAGE 2 –

Designate the existing paragraph as paragraph (a) and, after that paragraph, insert the following –

"(b)  to request the Minister for the Environment to establish a framework,

timeline  and tracker for monitoring the  implementation of the  Jersey Marine Spatial Plan and for conducting any further research on areas remaining for inclusion in the Marine Protected Area Network, with a final status to be assigned to areas undergoing such further research by the end of 2025 and with all subsequent amendments to the Marine Spatial Plan to be completed by the end of the Assembly's current term of office."

Note:  After this amendment, the proposition would read as follows –

THE STATES are asked to decide whether they are of opinion

  1. to agree the proposed Jersey Marine Spatial Plan as the roadmap to managing Jersey's marine environment, as set out in Appendix 1 to the report accompanying this proposition.
  2. to  request  the  Minister  for  the  Environment  to  establish  a framework, timeline and tracker for monitoring the implementation of the Jersey Marine Spatial Plan and for conducting any further research on areas remaining for inclusion in the Marine Protected Area  Network,  with  a  final  status  to  be  assigned  to  areas undergoing such further research by the end of 2025 and with all subsequent amendments to the Marine Spatial Plan to be completed by the end of the Assembly's current term of office.

REPORT

This simple amendment is designed to build on the EHI Panel's 2nd amendment to P.44/2024, by putting in place a deadline for the actions relating to the Marine Protected Area Network to be completed. It is a two-stage process. The first deadline (end 2025) would require the minister to reach a decision on all the areas marked down for "further research" in the Marine Spatial Plan EITHER by adding them to the Marine Protected Areas OR removing them from consideration for MPA status. This is a relatively relaxed deadline, in that the Minister reported in WQ.271/2024 that the habitat mapping work that is being done relating to the "further research" areas is already underway and should be complete in spring/summer 2025. Data analysis was reported in the same answer to be  undertaken  concurrently  during  spring/summer  2025.  Hence,  a  deadline  for  a decision building on this data analysis should be easily possible by the end of the year.

It is not entirely clear what process would be required to give effect to any decision to add areas to the MPA network. Therefore, the second deadline in the amendment allows a further 5 months for any law drafting or other work that might be required to give effect to the minister's decisions.

It is hoped that these deadlines would help provide clarity to all stakeholders about not just the process that will be followed relating to the "further research" areas, but also when results can be expected.

It is expected that this amendment will not result in any additional costs either financial or staffing.
