REPORT

On 20th February 2012, the Minister for Economic Development made a Ministerial Decision delegating certain of his functions under Article 28 of the States of Jersey Law 2005 (MD-E-2012-0019, available at www.gov.je).

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below.

This  replaces  the  Report  attached  to  MD-E-2012-0002,  which  is  rescinded  by MD-E-2012-0019.

  1. Introduction

Article 28 of the States of Jersey Law 2005 permits a Minister to delegate, wholly or partly, functions to an Assistant Minister or an officer.

The Law states, inter alia

"28  Power of Minister to delegate functions

  1. A Minister may delegate, wholly or partly, functions conferred upon or vested in the Minister by or under this Law or any other enactment or any enactment of the United Kingdom having effect in Jersey, to
  1. one of his or her Assistant Ministers;
  2. an officer.
  1. A Minister shall not delegate –
    1. any power to make an enactment;
    2. any power to decide an appeal under an enactment;
    3. any function the delegation of which is prohibited by an enactment.
  2. The delegation of functions by a Minister under this Article shall not prevent the Minister exercising those functions personally.
  3. Where  any  licence,  permit  or  authorization  is granted  in  purported exercise  of  functions  delegated  under  paragraph (1),  no  criminal proceedings shall lie against any person for any act done, or omitted to be done, in good faith and in accordance with the terms of the licence, permit  or  authorization,  by  reason  that  the  functions  had  not  been delegated,  or  that  any  requirement  attached  to the  delegation  of  the functions had not been complied with.
  4. In this Article –

"Minister" includes the Chief Minister;

"officer"  means  a  States'  employee  within  the  meaning  of  the Employment  of  States  of  Jersey  Employees  (Jersey)  Law 2005  and includes a member of the States of Jersey Police Force and an officer appointed  under  paragraph 1(1)  of  Part 1  of  Schedule 2  to  the Immigration Act 1971 as extended to Jersey by the Immigration (Jersey) Order 1993.

  1. The States  may  by Regulations  amend  the  definition  "officer"  in paragraph (5)."
  1. Delegations

As per MD-E-2011-0200, the Minister has delegated political responsibilities for the Harbours and Airport to Assistant Minister, Deputy J.P.G. Baker of St. Helier ; and responsibilities for Agriculture and Fisheries to Assistant Minister, the Deputy of Grouville (C.F. Labey ). The Schedule below outlines specific delegations both to Assistant Ministers and Officers.

The  Minister  therefore  approves  the  delegated  functions  listed  in  the  attached Schedule.

Article 6 transfer to the Commission the function of supervising banks and other deposit taking institutions under the Banking Business (Jersey) Law 1991, insurance business under the Insurance Business (Jersey) Law 1996 and collective investment funds and the functionaries of such funds under the Collective Investment Funds (Jersey) Law 1988. In addition, the Article charges the Commission (largely acting through the registrar, a Commission appointee) with administering the Control of Borrowing (Jersey) Law 1947, the Registration of Business Names (Jersey) Law 1956, the Companies (Jersey) Law 1991, the Limited Partnerships (Jersey) Law 1994 and the Limited Liability Partnerships (Jersey) Law 1997.

Article 6(4) – to state in writing the reasons for a decision that refused a licence or attached any condition to that licence.

Article 6(5) and (6) – to revoke a licence if satisfied that –

  1. any information furnished in connection with the application for the licence was false or misleading in a material particular; or
  1. there has been a failure to comply with any condition subject to which the licence was granted.

A licence shall not be revoked unless not less than 14 days notice has been given in writing of the intention so to do and a statement in writing of the reasons for so doing.

The delegations as outlined above will only be exercised in accordance with the published General Statement of Policy as issued from time to time in relation to the Regulation of Undertakings and Development (Jersey) Law 1973 (RUDL').

The Agriculture Loans Board does not now exist, but recommendations could be made to the Minister from the Director of the Rural Economy. This would only be for deferments as the scheme is no longer available for new loans.

 The Finance Director is delegated to take appropriate action with borrowers who are in arrears with repayments.

The Minister will continue to consider cases, only where a formal decision is required to give the Law Officers instructions to carry out certain functions, i.e. registering of new loans, changes in security and legal action.

Shipping (Fishing Vessels – Safety Training) (Jersey) Order 2004

Exemption may apply to fishermen operating vessels under 6 metres in length and where they have attended the approved alternative training.

Temporary exemptions for fishermen operating any size vessel who have not attended any approved training must be time- limited and dependent on there being on-board safety and emergency briefings.
