REFERENDUM COMMISSION AND STATES MEMBERS' REMUNERATION REVIEW BODY: APPOINTMENT OF MEMBERS

REPORT

This report has been presented to advise the States Assembly of the intention of the Privileges  and  Procedures  Committee  to  make  appointments  of  members  to  the Referendum Commission and the States Members' Remuneration Review Body.

Referendum Commission

PPC  intends  to  appoint  the  following  persons  as  members  of  the  Referendum Commission for 5 years under the Referendum (Jersey) Law 2017 ("the Law") –

Mr. Mike Entwistle, Chairman Advocate Mark Boothman

Dr. Sandra Mountford

Mr. Terence Le Sueur , O.B.E. Ms. Charlotte Littleboy.

Brief biographical details for each appointee have been included at the end of this report. Under the terms of the Law, the Committee is obliged to present to the Assembly a notice of its intention to appoint at least 2 weeks before the appointments take formal effect.

Under the provisions of the Law, the Committee must not appoint a person to the Commission unless that person has been recommended to the Committee by a Panel comprising the Greffier of the States and 2 other persons. In this instance, one of the Assistant Greffiers of the States acted on the Greffier's behalf on the Interview Panel, and  the  2  other  independent  members  of  the  Panel  were  the  Chairman  of  the Employment Forum and a former employee of the Electoral Commission in the U.K. The Interview Panel was chaired by a member of the Jersey Appointments Commission, but he was not involved in scoring or recommending candidates for appointment.

There were initially 10 applications in response to the advertised positions on the Referendum Commission. Six people were shortlisted for interview and, of those 6 people, 4 of the interviewees were also interviewed for the position of Chairman. That process led to a recommendation from the Interview Panel to the Committee to appoint the named individuals. The Committee has approved that recommendation.

Mr. Mike Entwistle, Chairman

Mr. Mike Entwistle was employed by the States of Jersey from 1983, initially in Health and Social Services, and later with the Department of Policy and Resources. In 2003, he became the International Relations Officer, and he worked in External Relations until his retirement in 2016, at which time he was Deputy Director of External Relations. In 2008, he was assigned lead responsibility for implementing the decision to hold a referendum  on  the  adoption  of  Central  European  Time.  From  2006  to  2016, Mr. Entwistle also held a part-time position as a lecturer at Highlands College.

Advocate Mark Boothman

Advocate Mark Boothman was born in Jersey and returned to the Island permanently in 2010 after studying in the U.K. Since his return, he has qualified as an English Solicitor and Jersey Advocate. His main practice area is litigation, and he regularly

appears before the Jersey courts in civil and criminal matters, including acting on a number of Legal Aid cases.

Dr. Sandra Mountford

Dr. Sandra Mountford trained as a psychiatric nurse and then as a general nurse. She is a Chartered Psychologist and an Associate Fellow of the British Psychological Society. She retired in 2011 from the Department of Education, where she had been Head of Childcare Registration since 1993. From 1984 to 2014, Dr. Mountford was also a part- time lecturer in psychology and related topics at Highlands College. In 2009, she was a member of the independent review of the roles of the Crown Officers.

Mr. Terence Le Sueur , O.B.E.

Mr. Terence Le Sueur was a member of the States from 1987 until 2011, during which time he was Chief Minister from 2008 to 2011. He is now retired, although he remains on the Boards of Management of the Public Employees' Pension Fund and the Jersey Teachers' Superannuation Fund.

Ms. Charlotte Littleboy

From 1999 to 2015, Ms. Charlotte Littleboy worked as a  Clerk in the House of Commons. She continues to work in Parliament in a non-political role and has lived in Jersey for 2 years. She has worked extensively with select committees, was Clerk to the Standards and Privileges Committee and the Procedure Committee; and has also worked as Secretary to the Speaker's Commission on the Electoral Commission. Since 2000, she has also worked to support the Parliamentary Assembly of the Council of Europe.

States Members' Remuneration Review Body

PPC also intends to appoint Ms. Nicola Santos-Costa and Mr. Andrew Wicks to the States Members' Remuneration Review Body for a term of 5 years, to replace Mr. John Mills, C.B.E. and Mr. Maurice Dubras, whose terms of office had expired.

Under the terms of reference of the Review Body set by the States, the members shall be appointed by PPC following requisite consultation with the Jersey Appointments Commission. Before making any appointments, the Committee shall nevertheless be required  to  present  a  report to the  States setting  out the  names  of  the  proposed appointees, and the appointments shall not be confirmed by the Committee until at least 15 days after the presentation of this report.

On  this  occasion,  the  Recruitment  Panel  consisted  of   Connétable  L. Norman  of St. Clement , Chairman of PPC; Dr. M. Egan, Greffier of the States; and Mr. G. White, States Members' Remuneration Review Body. Ms. G. Liew from the Appointments Commission was the non-voting chairman. There were 6 applicants, of whom 5 were interviewed. The 2 preferred candidates have been approved for appointment by PPC.

Biographies of Ms. Nicola Santos-Costa and Mr. Andrew Wicks are set out below.

Ms. Nicola Santos-Costa

Ms. Nicola Santos-Costa retired as the Chairman of the Employment and Discrimination Tribunal at the end of April 2017. She held the post of Chairman for 5 years, having previously been the sole Deputy Chairman for 7 years. Prior to that appointment, Ms. Santos-Costa worked as a company and commercial lawyer in local law firms. She is the Chairman of the NSPCC fundraising committee in Jersey and has held that office for over 10 years. She also served as a member of the Youth Court Panel for 9 years and was a member of the first Board of Independent Visitors to the Children's Homes in the Island. Ms. Santos-Costa has lived in Jersey for over 30 years.

Mr. Andrew Wicks

Mr. Andrew Wicks has spent his working life in the I.T. industry, in a variety of roles and organisations, including U.K. local government, insurance, the legal sector and the finance industry. He has lived in Jersey for 13 years and co-founded Calligo, which offers cloud-based services, 6 years ago. He recently retired from the business to pursue other non-business interests. He is a member of the Institute of Directors and is also an independent police custody visitor.
