REPORT
- Article 9A(6) of the Planning and Building (Jersey) Law 2002 came into force on 11th April 2015. It requires that –
The Planning Committee shall, within the period of 3 months following the end of a year, report to the States –
- the number of decisions made by the Committee under this Law during that year;
- the number of appeals made during that year against decisions made by the Committee under this Law;
- the Committee's assessment of planning policy and any recommendations it has for its revision.
- This report is presented to the States for the purposes of complying with this new provision.
- Between 26th January and 21st December 2017, the Planning Committee has determined 106 applications.
- Between 26th January 2017 and 21st December 2017, 19 of the Committee's previous decisions were appealed under the new planning appeals system (12 of which were upheld and 3 of which was reversed) – 4 remain pending at this time.
- Committee Members have made the following comments to the Minister during 2017.
- The Committee expressed some frustration at the length of time it was taking to review the existing policy in relation to the replacement of historic windows and requested that this be addressed.
Minister's response
The policy for the replacement of historic windows is set out at Policy HE2 of the Revised 2011 Island Plan, which was approved by the States Assembly in July 2014. Changing this policy would entail a review of the Island Plan itself, which is not envisaged until the end of the current plan period when the current plan is replaced: this is not timetabled to take place until the end of 2020.
The Minister has indicated his desire to revise the regulatory regime and the need for planning permission as it applies to listed buildings and places. This work, involving changes to the General Development Order, is in train, and will likely include associated revision of the supplementary planning guidance about historic windows and doors. Publication of revised guidance is envisaged during the first quarter of 2018.

- The Committee had been advised during its consideration of an application which related to a mobile catering unit in the Coastal National Park, that the absence of public toilets in the area was problematic given the number of businesses in the vicinity. In this connection the use of temporary toilets had been raised, and the Committee had decided to request the Minister for the Environment to raise this issue with the Minister for Infrastructure, as a proliferation of temporary toilets in the Coastal National Park was not considered to be appropriate (Minute No. A5 of 29th June 2017 gives context).
Minister's response
The Minister has written to the Minister for Infrastructure, requesting that he consider whether there are sufficient public conveniences in the locality.
- The Committee agreed to urge the Minister to bring forward proposals for a development plan for St. Brelade 's Bay, as envisaged in the Island Plan, in order to assist the Committee in its future deliberations on applications in the Bay (Minute No. A22 of 19th October 2017 gives context).
Minister's response
The Minister is committed to developing Supplementary Planning Guidance ("SPG") for St. Brelade 's Bay, subject to the availability of resources, and relative to other competing priorities for the development of new/revised current guidance. The context for this work is provided by Proposal 16 of the Revised 2011 Island Plan.
This work will be funded from within the Department of the Environment expenditure limits, and it is expected that any new supplementary planning guidance will be adopted during the current MTFP period.
In the meantime, the Minister is of the view that the Revised 2011 Island Plan provides a perfectly robust planning policy framework for the determination of planning applications in the Bay, and elsewhere in the Island, provided that it is applied comprehensively and consistently.
