Comments
Whilst the Finance and Economics Committee has every sympathy for Mr. Le Gastelois' circumstances, it believes that for the States to make such a payment on account of the treatment which Mr. Le Gastelois received from individuals for which no public body was responsible, could establish a precedent in the eyes of all who believe they have suffered injustice, with unquantifiable financial consequences.
The public of Jersey would also be likely to regard the payment as an admission of liability, especially if made on the basis of the wording used in the report and proposition.
However, the Committee believes that every effort should be made to ensure that Mr. Le Gastelois receives all benefits that his age and health entitle him to and which are available from the appropriate agencies.
