COMMENTS

  1. T h e pollution control measures inplaceatthe old Fire Training Ground(FTG) set up were unsound in that they relied upon a soakaway arrangement to dispose of fire fighting residues. Irrespective of the additional contamination caused by the fire fighting foam the arrangement would not be deemed satisfactory today for thedisposaloffireresidues.
  2. P o l lution and harm has been causedby the releaseof pollutants from the FTG and this has been mitigated by connecting affected properties tomainswatersupplieswherethehouseholder has agreed to this course of action.
  3. T h e main pollutants ofconcern, Perfluorooctyl sulphonate (PFOS) and Perfluorohexyl sulphonate (PFHS) are persistent in the environment and the attenuation of their concentration ingroundwatersis likely to be very slow.
  4. T h e remediation measures to deal with thepollutionwerereasonableand were approved bythe regulator.
  5. T h e proposed settlement should relate entirely to the costs incurredby Jersey Airport and should not, therefore, preclude further action by individuals in relation totheirexposuretothe pollutant.
  6. A s long as the reinstated FTG site isoperatedwithin its designparameters and no further pollutants move outside the site into controlled water, including surface waterandgroundwater,thesite will be compliant with theprovisionsof the WaterPollution(Jersey)Law2000.
