COMMENTS

The Environment and Public Services Committee considers that the new Law should be introduced in the second quarter of 2006. It is considered that the ministerial system of government will bring with it a considerable number of changes in procedures, as will the new Law, and it is better that time be allowed for the former to be completed before the new Law comes into force.

It had been intended to introduce third party appeal provisions at a later stage, owing to the limitations on resources. Should the Deputy 's amendment be successful then, of course, it will be possible to bring in the third party appeal provisions at the outset.

The Planning Department has indicated to Deputy Scott Warr en that it anticipates between 6 and 12 third party cases per annum. On a cautionary note, the Committee must stress that in the absence of any directly comparable process in other jurisdictions, this range is very much a "best guess". What happens in practice may be different, and the resources available to the Royal Court, Crown Officers and Planning Department for third party appeals may need future adjustment based on experience.
