COMMENTS
The effect of the Amendment to P.44/2009 lodged by the Deputy of St. Martin would be to modify the membership of the Panel appointed to conduct a review of the roles of the Bailiff , the Attorney General and Solicitor General. The proposal would increase the Panel from a Chairman and two other independent members of the Jersey community to comprise, instead, of a Chairman and four independent members of the Jersey community.
The Council of Ministers has, in principle, no objection to increasing the membership of the Panel. However, they are mindful of the wishes of the Assembly that the review should be conducted efficiently and as soon as possible within limited resources. It is however important that the Chairman and members of the Panel should all be independent and impartial and be well versed in the matters to be considered.
The Council of Ministers accepts the Amendment subject to an understanding that if, in spite of its best endeavours, it is impossible to propose four suitable independent members of the Jersey community for the Panel it will report back to the States accordingly.
Financial and manpower implications
On the assumption that the additional members are appointed from within Jersey the amendment should have no material implication for the cost of the review.
