COMMENTS
The Council of Ministers has considered the Report and Proposition lodged by Deputy M.R. Higgins of St. Helier . Although in general it would not be appropriate to pay the legal costs of a person who is taking advice or considering taking action against another person in relation to a planning enforcement issue, this is an exceptional case because Mr. Turner did provide assistance to the Planning and Environment Department in gathering evidence for the case against the restaurant involved and was assured that all his costs, including legal costs, would be paid.
In these circumstances the Council of Ministers believes that an ex gratia payment should be made to cover all the costs which Mr. Turner is claiming.
