STATES OF JERSEY
POLICE STATION RELOCATION: REVIEW OF DECISION (P.92/2012) – COMMENTS
Presented to the States on 20th November 2012 by the Minister for Planning and Environment
STATES GREFFE
2012 Price code: A P.92 Com.(2)
COMMENTS
The Minister for Planning and Environment is the appropriate Minister to make decisions under the Planning and Building (Jersey) Law 2002, in determining planning applications. The Minister cannot be bound by decisions of the States Assembly in discharging his functions under this Law.
The amendment to the proposition rightly recognises this.
It is inappropriate for me as the Minister to comment upon any site or application specific matters, as I have the duty to determine a current live planning application for the police station proposal. I have called this application in for my determination. The issue does not apply to members of the Planning Applications Panel, who will form no part of the planning decision on this proposal.
I can however inform Members that, if the States Assembly is minded to support the proposition parts (b) and (c), then I shall reasonably listen to the will of the Assembly and conduct the work as outlined in the proposition.

Statement under Standing Order 37A [Presentation of comment relating to a proposition]
The Minister for Planning and Environment has submitted these comments later than anticipated as he was awaiting the receipt of advice as to what role he could or could not play in the debate, as he has a regulatory position under the Planning and Building (Jersey) Law 2002. The advice was later than anticipated, which has had a subsequent impact on the delivery of these comments.
