THE STATES noted Acts of the Finance and Economics Committee dated 30th June, 25th August, 8th September and 22nd September, 1982, showing that, in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –
- as recommended by the Housing Committee, the purchase from Mrs. Joyce Leslie Greening, née Picot, of No. 8 Parade Road, St. Helier , together with the ground opposite on the south side of the road, for a consideration of £70,000 and on the basis of each party paying its own legal fees and Mrs. Greening to remain in the property rent free for a period of three months from the date of completion. The Committee rescinded sub- paragraph (i) of Act No. 7 of 13th January, 1982, which had been notified to the States on 19th January, 1982;
- as recommended by the Housing Committee, the grant to Mr. Francis Philip Le Poidevin and Mrs. Mary Le Poidevin, née Lowe, of an easement to ratify the establishment of two windows and two overflow pipes in the gable end of their property 151, Clos des Sables, St. Brelade , which was adjacent to property administered by that Committee;
- as recommended by the Education Committee, the grant to Mr. John Donald Ribar and Mrs. Marie Virgine Patritia Ribar, née Oliver, of 5 Belgreve Terrace, Dicq Road, St. Saviour of the right to retain, maintain and replace as necessary, mains water pipes serving their property, routed through the private land bought by the States as part of the property "Mandalay", subject to the deed containing appropriate safeguards for the Education Committee to move services in the future, and all legal charges being paid by Mr. and Mrs. Ribar;
- as recommended by the Public Works Committee, the leasing to Mr. Sean Anthony Heatley Faulkner of a German bunker at L'Etacq, St. Ouen , measuring 110 square metres, for the establishment of a viviers and lobster breeding station, for a period of nine years, effective from 29th September, 1980, at an annual rent of £165.00, representing a rate of £1.50 a square metre, and subject to rent reviews at the end of the third and sixth years of the lease;
- as recommended by the Resources Recovery Board, the acceptance by the Board from the Overseas Trading Corporation (1939) Limited of an easement through land owned by the Company at First Tower, St. Helier , as shown on Drawing No. G.962A, for the purpose of renewing power cables between the Bellozanne Plant and First Tower Pumping Station and for subsequent access to the cable for maintenance purposes, for a period of 99 years at a rate of £1 a year, to be paid in one sum of £99 when the Agreement was signed;
- as recommended by the Fort Regent Development Committee, the leasing to Mr. Richard Ian Roulson and Mrs. Catherine Lawrencia Roulson, née Joseph, of the Day Nursery premises at Fort Regent, for a period of five years, with effect from 1st September, 1982, at an annual rent of £1,800 subject to rent reviews at the end of the second and fourth years of the lease;
- as recommended by the Housing Committee, the cession to the public free of charge, by Mr. James Edward Colback, Madok Limited and Gala Holidays (C.I.) Limited of all such rights as they might have in that portion of Devonshire Lane, St. Helier , hatched in Red on Drawing No. 2663/19, measuring approximately 1,950 square feet, subject to the conditions that –
- the land in question should be used exclusively for such units of dwelling accommodation as might be erected on the site of Homeville and that there should be no through road to Journeaux Court;
- the properties of both Mr. J.E. Colback and Madok Limited should be allowed to have accesses onto Devonshire Lane and that vehicular rights of way should be granted to those properties;
- the pedestrian access serving Gala Holidays (C.I.) Limited should be allowed to remain as it was and that a pedestrian right of way should be granted to the property;
- the Housing Committee should be responsible for the maintenance and upkeep of the road and the disposal of surface water without any contribution from the owners;
- the existing drains and services in the road should be taken over by the Housing Committee and treated as being in public ownership and that ifit should be necessary to relay the drains or service connexions to the properties belonging to the three parties, this would be at the expense of the Housing Committee;
- the Housing Committee should be responsible for all legal costs;
(The Committee rescinded paragraph (a) of Act No. 3 dated 30th June, 1982, which was notified to the States on 27th July, 1982).
- as recommended by the Housing Committee, the sale toTheJersey Electricity Company Limited of a site for a sub-station at the Maufant Development Phase II, St. Saviour , measuring approximately 130 square metres, as shown coloured Yellow on Plan No. 2714-54, together with cable wayleaves as shown coloured Red on the same Plan, for a consideration of £1;
- as recommended by the Housing Committee, the sale to TheJersey Electricity Company of a site for a Sub-Station in the Bashfords Nursery Development, measuring approximately 22 square metres as shown coloured Red on Drawing No. 235.68A, for a consideration of £1.00; the Jersey Electricity Company having the right to install and maintain a section pillar and cables in the roads and pavements of the development;
- as recommended by the Harbours and Airport Committee, the lease to Mr. Anthony John Smith of 216 sq.ft. of land on the Albert Pier for a period of 3 years with effect from 1st September, 1982, at an annual rent of £324, representing a rate of £1.50 a sq.ft.;
- as recommended by the Education Committee, the renewal of the lease from the Estate of the late Glen Arthur Mathew of No. 4 Isipingo Villas, Beaumont, St. Peter , for a period of 1 year with effect from 1st June, 1982, at an annual rent of £2,275, for use as teachers' accommodation;
- as recommended by the Public Works Committee, the renewal of the lease to Mr. Roy Thérin of a meadow at Rozel measuring approximately 2 vergées (purchased by the public of the Island in 1965 to provide a car park) for a period of 1 year from 29th September, 1982, at an annual rent of £25;
- as recommended by the Public Works Committee, the cession to the public free of charge by Mrs. Elaine May Langley, née Bryant, of 259 sq.ft. of land for road improvements at Le Hocq, St. Clement , subject to the condition that a small wall abutting Mrs. Langley's garage was demolished; the cost of the accommodation works involved being estimated at £1,500.

THE STATES noted Acts of the Finance and Economics Committee dated 16th June, 28th July and 8th September, 1982, showing that, in pursuance of Rule 5 of the Public Finances (General) (Jersey) Rules, 1967, as amended, the Committee had noted that –
- the Housing Committee had accepted the lowest tenders received for each of the three phases for the development of Bashfords Nurseries, as follows –

The President of the Finance and Economics Committee informed the States that the debate on the 1983 Budget would be held on Tuesday, 30th November, 1982.
Scrapyard in Bellozanne Valley. Questions and answers.
Senator John Philip de Carteret asked Deputy John Le Gallais of St. Saviour , President of the Resources Recovery Board, the following questions –
"In the Island Development Committee's report of June, 1980, the basic concept and the clear intention of the Board in regard to the acquisition of land for scrap metal at Bellozanne was to concentrate the major operation in the valley and reduce the site presently used on the North Marine Drive by the contractor. This was carried by a majority of 28 – 21. Can the President inform the House –
- Why has it taken over two years to get the lease signed, and why did the management of the Resources Recovery Board not agree the conditions BEFORE buying the land?
- Why the site has taken so long to prepare, and as the cost two years ago was £338,000 to buy and prepare, what is the TOTAL cost now so far?
- If the present contractor is not to continue the operation who will be responsible for buying the equipment estimated at some £100,000 minimum to set up the site with a new contractor?
- On how many occasions has the Board met the present contractor to reach agreement on rental, use and conditions of the new site?
- How does the management at Bellozanne propose to concentrate the activities of waste disposal at Bellozanne Valley as stated in the report, when itis unable to close the badly located site at St. John , it has an unsigned lease with its present contractor, and a virgin site without plant and machinery?"
The President of the Resources Recovery Board replied as follows –
"1. The first question is in two parts. The answer to the
first part is that no lease has yet been signed. The answer to the second party of the question is that no record exists in the Board's Minutes or papers to show that it was a positive decision to delay the drawing up of an agreement for the lease of the site until the site had been purchased. However, although not a member of the Board at that time, I can see good practical reasons for the procedure that was adopted.
- In order to acquire an adequate site, land was purchased from four landowners, the last transaction being completed in March, 1981.
Before the site could be used, two watercourses passing through it had to be culverted. Surface levels over the whole area had to be graded with hardcore to ensure proper drainage and the entire site was covered with concrete.
On one boundary a considerable rock face had to be excavated and on another a gabion wall, screened by selected imported trees, has been constructed. New fencing around the remainder of the perimeter was necessary.
In addition a contractual agreement had to be reached with Jersey Coal Distributors Limited for access to the site over their roadway and a wayleave negotiated for services which were provided for the operation of the Yard machinery.
The cost of land purchase, legal fees and the work described above was £420,000.
- The successful Contractor will be responsible for providing the equipment he needs.
- Meetings took place in 1981 when a verbal agreement on the rental and the withdrawal of the current £6 car subsidy was received.
Since the lease has been prepared this year, representatives of my Board have met the Contractor on probably five occasions, on one of those occasions with his Accountant and on another with his Commercial Advisers.
The Contractor, while acknowledging that the lease was on the terms and conditions which had been discussed previously, claimed that because of the continuing recession in the Scrap Metal Industry, he was unable to accept the financial conditions of the lease.
My Board decided that before negotiating financial terms with the present Contractor, the facilities of the new Yard should be advertised locally.
The Board on the one hand is concerned that the collection and concession of Scrap Metal should have as little adverse effect on the environment as possible and, on the other, that the level of public subsidy should be kept within reasonable bounds.
The present position is that there have been three applications for inclusion on a Select List of firms wishing to submit a Tender and the Board is in the process of interviewing the applicants.
The Board is confident that for a variety of reasons the site it has at Bellozanne offers several commercial advantages for processing scrap metal over any other site elsewhere in the Island."

Deputy Terence John Le Main of St. Helier asked Deputy John Le Gallais of St. Saviour , President of the Resources Recovery Board, the following question –
"Will the President give the House an undertaking that, in view of the Evening Post report that three companies have been invited to submit tenders for the new scrapyard at Bellozanne Valley, and the fact that only of these companies is recognised as being solely in the business of dealing in scrap metal and vehicle disposal, a condition will be included in any agreement that the premises will be used solely in relation to work associated with scrap metal dealing and vehicle disposal and will not be used for any other purpose?"
The President of the Resources Recovery Board replied as follows –
"The answer to the question is YES."

Deputy Hendricus Adolphus Vandervliet of St. Lawrence , Vice-President of the Housing Committee made the following statements –
"1. During the Debate, following which the States rejected my Committee's proposals to build four one- bedroomed flats on the green at La Grande Pièce, the former Connétable of St. Peter informed the House that there was an alternative area of land adjacent to La Grande Pièce and that the owner was willing to sell it to my Committee for residential development.
I now wish to inform the House that the owner of the land has changed his mind and will not sell the land to the Committee for residential development.
My Committee will await the outcome of the review of the Island Plan before deciding whether or not to pursue the matter further.
2. On 8th June, 1982, in answer to questions asked by Senator Horsfall, I undertook to make further approaches to the J.S.P.C.A. regarding the possible acquisition of the Animals' Shelter land for residential development.
I have now been informed by the J.S.P.C.A. that, since the previous Committee's decision not to purchase the site, a comprehensive programme of refurbishment has been commenced and it does not wish to interrupt that programme. The Committee of the Society is unanimously of the opinion that the Animals' Shelter should remain on its present site in St. Saviour 's Road.
The Housing Committee proposes not to take any further action."

THE STATES, adopting a Proposition of the Housing Committee –
- approved the leasing from Mr. Nicholas Le Quesne Blampied of The New House, Clos de la Marquanderie, St. Brelade , for a further period of one year, with effect from 1st July, 1982, at an annual rent of £4,250, plus costs;
- authorised the Greffier of the States to sign the necessary agreement;

Request for a Report on certain aspects of the Health Scheme.
THE STATES, adopting a Proposition of Senator Richard Joseph Shenton, together with the Amendment of the Social Security Committee, requested that Committee to prepare a report for debate in the current Session on the Health Scheme, including the following matters –
- the scale of doctors' charges and rebates with a view to reducing the burden on the sick;
- the practicability of exemption from prescription charges for children under sixteen years of age, women aged sixty years and over, men aged sixty- five years and over, expectant mothers and people suffering from certain specified conditions, such as diabetes, epilepsy, etc.;
- the introduction of a new Sickness Benefit Form which would dispense with the need for sick notes from doctors;
- the raising of the present Health Insurance Exemption ceiling to a more realistic level; and
- the presentation to the House of costs related to the introduction of the proposed changes in the Health Insurance Scheme, and suggestions for funding these changes.
