The Bailiff , on behalf of the

States, welcomed Leonard René Hamel, Connétable of St. Clement, on his return to the House after his illness.

House Committee: appointment of President

There were nominated for appointment as President of the House Committee -

S enator Anne Baal, proposed by Senator P ierre François Horsfall; and

T erence Augustine Le Sueur, Deputy of S t. Helier, proposed by Leonard

N orman, Deputy of St. Clement.

THE STATES having proceeded to a secret ballot, the Bailiff declared that Deputy Le Sueur had been elected President of the House Committee.

The result of the ballot was as follows -

D eputy T.A. Le Sueur 23 votes S enator A. Baal 2 0 votes.

Education Committee: resignation of member

THE STATES noted the resignation

of Deputy Derek Ryder Maltwood of St. Mary from the Education Committee.

Finance and Economics Committee: appointment of member

THE STATES appointed Deputy Derek Ryder Maltwood of St. Mary as a member of the Finance and Economics Committee.

The Policy and Resources Committee

by Act dated 16th January 1990 presented to the States The Jersey Energy Supply Study prepared by W.S. Atkins Consultants with Merz and McLellan.

THE STATES decided to take the abovementioned subjects into consideration on 6th February, 1990.

Review Board hearing: Highland

House, St. Lawrence - Housing Committee's refusal to alter decision. Statement.

Senator Reginald Robert Jeune , Chairman of the Review Board, made a statement in the following terms -

  Article 9(4) of the Administrative

 D ecisions (Review) (Jersey) Law 1982  p rovides that where a Board, having

 r equested reconsideration by a

 c ommittee, department or person, is of  t he opinion that the findings of the

 B oard have been insufficiently

 c onsidered or implemented, it may

r efer the matter to the States.

A s the result of a Review Board

h earing which took place on 5th

S eptember 1989 in relation to a

c omplaint by Mr. J.F. Billington about a decision of the Housing Committee in r elation to a condition imposed on the

o ccupancy of two units of

a ccommodation at Highland House, St. L awrence, the Board asked the

C ommittee to reconsider its decision.

T he Board was subsequently informed,

i n writing, that although the

C ommittee had considered the Board's

r ecommendation, the Committee was not p repared to alter its decision.

T he Board regrets, therefore, that

u nder Article 9(4) of the Law it has t o inform the States of the Housing C ommittee's refusal to give effect to t he Board's findings.''

Magistrate: appointment of Advocate T.A. Dorey

THE STATES, adopting a Proposition

of the Establishment Committee, appointed Advocate Thomas Alan Dorey to the post of Magistrate for the period 1st July 1990 to 23rd March 1993.

Waterfront area of St. Helier: development. P.151/90

THE STATES commenced consideration of the Island Development Committee regarding the development of the waterfront area of St. Helier.

The States accepted an amendment of Deputy Leonard Norman of St. Clement that in paragraph 1(c) after the words the

provision of'' there should be deleted the words a large'' and after the word

marina'' there should be inserted the

word facilities'' and that in paragraph

1(d) for the word that'' there should be substituted the word a''. After further discussion, the Committee withdrew sub- paragraph (d) of paragraph 1, renumbered the subsequent sub-paragraphs and the States, adopting the Proposition as amended -

 1 .  noted the planning brief for the S t . Helier waterfront area and

a p p roved the inclusion in that

b r ie f of -

( a ) the protection of the

ap p roach to, and the setting

o f, E l i zabeth Castle as an

is la n d in St. Aubin's Bay;

( b ) the need for an additional la n d re clamation site in the w a te r f ront area (as defined

o n M  a p No. 01.226.3 in the

b ri e f) to meet future needs fo r t h e disposal of inert,

n o n -c o mbustible waste

m a t er i als;

( c ) the provision of new

y ac h t m arina facilities in th e w aterfront area;

( d ) the requirement to repair

ex i s ti n g visual damage in the w a te r f ront area by the

cr e a ti v e use of tipping and

fu r th e r land reclamation as

d es c r ib ed in paragraphs 7.9- 7 .1 2 o f the brief;

( e ) the substantial provision for n ew   h o using development in th e w a terfront area in

ac c o r d ance with the

g u id e l ines set out in

p ar agraphs 8.3-8.5 of the

b ri e f;  

( f) the significant provision for p u b li c open spaces and safe p ed e s t rian movement in the w a te r f ront area;

( g ) the adequate provision for th e fu t ure commercial and

o p er a t ional requirements of

S t. H  e lier Harbour;

( h ) the adequate provision for th e fu t ure fuel

st o r ag e and electricity

g en e r a ting require-ments of

th e Is l and at La Collette;

 2 .  approved the conservation of the

g r a nite buildings on the

W  e ighbridge island'' site and

t h e New North Quay by designating t h em as sites of special interest

u n d er Article 9A of the Island

P l a nning Law.
