Senator John Stephen Rothwell asked

Deputy Hendricus Adolphus Vandevliet of St. Lawrence, President of the Housing Committee, the following questions -

Question 1

  In view of the failure of D.

 S atchwell Limited, builders, to

 c omplete the States' loan houses at

 C los Morel , St. Ouen, causing hardship  t o many young couples who paid their

£ 5,000 deposit three years ago, would

 t he President give an assurance that

 h is Committee will now consider taking  i mmediate steps to acquire the site

 a nd ensure that no-one loses the

 i nterest on their deposits?''

The President of the Housing Committee replied as follows -

  Before answering these questions

 s pecifically, I should like to give

M embers information on the background t o this problem.

T he fields in question were zoned by

t he States in 1984 for States' loan or

r ental housing as part of the St.

O uen's Village development. At the

t ime, the States empowered the Island D evelopment Committee to acquire the f ields by compulsory purchase if a

f air and proper price could not be

a greed with the owner.

F or one reason or another, the Island

D evelopment Committee chose not to use t hose powers, and the landowner sold

t he fields to a private developer, D.

S atchwell Limited, in 1988. A planning

p ermit for 33 States' loan houses was

i ssued on 11th October 1987, and a

d evelopment permit issued on 13th July 1 988.

S tage payments were provided to the

d eveloper by the Housing Committee in a ccordance with normal procedures - i .e. specified amounts were paid from i ndividual borrowers' loan accounts

f or completed works based on

a rchitect's certificates. The houses

w ere intended to be sold for #42,500 e ach, the developer having already

t aken a #5,000 deposit from each

p rospective purchaser.

I n 1989 the developer advised the

H ousing Committee that although he had a lready conveyed 24 of the plots with

h ouses at varying stages of

c onstruction, the price for each of

w hich, when completed, being #42,500, h e intended selling the remaining nine

a t #50,000 each because of increased

b uilding costs. My Committee felt that

i t had no choice but to agree to this

r equest, given that the proposed price

o f #50,000 was well below the new loan h ouse price limit of #65,000; the

p rice was justified in terms of what

w as to be provided to the buyers; and

t he alternative offered by the

d eveloper was not to build the houses

a t all.

E arly this year work on the

d evelopment, for all practical

p urposes, ceased. I understand that

t he developer is effectively bankrupt,

t hough he has not been declared en

d ésastre' as such. At this stage, 19

h ouses were complete and occupied,

t hough the six months latent defects

w ork ( snagging') had yet to be

c arried out by the developer - e.g.

m inor repairs. Five houses were almost c omplete, but not yet able to be

o ccupied. Work on the remaining nine h ouses had not yet started and a

c ontract between the nine prospective b uyers and the developer had not yet

b een registered.

F or some time now, my Committee has b een considering a possible rescue

p ackage, proposed by one of the

d irectors of the development company. T he proposal is that a new' company,

D . Satchwell (1990) Limited, would buy f rom the old' company the land on

w hich the remaining nine houses are to b e built; build and sell the nine

 h ouses to the prospective purchasers  f or #50,000 each (including their

o riginal deposits); complete remedial

 w orks on the 19 houses which are

o ccupied; complete the five which are

  nearly finished but still unoccupied;  a nd lay the roads.

T he package has been a difficult one t o consider for a number of reasons, a m ajor one being the legal position of t rade creditors in any transaction

 c ontemplated. There are also such

m atters as the willingness of the

  old' company to sell; the view of the  f inancial institution, Hambros Bank

 ( Jersey) Limited, which has a major

 c harge over the land in question,

 f inancial backing for the new'

 c ompany; and, not least of all, the

 v iews of the nine prospective buyers.  E ventually, having satisfied itself to

 a point on these various issues, and

 h aving consulted through its Chief

 E xecutive Officer with the nine

 p urchasers in person, my Committee  c onsented to the old' company selling  t he land to the new' company.

O n Friday, 19th October 1990, the sale

o f the land to the new company was

r egistered in the Royal Court and we

c an now look forward to all

o utstanding work in the estate being

c ompleted, and work on the nine

r emaining houses commencing.

R eturning to the specific questions

p ut to me, I can confirm that my

C ommittee had indeed taken steps to

a cquire the site had this been

n ecessary, having already enlisted the

s upport of both the Island Development a nd Finance and Economics Committees t o this effect. The question of

d eposits and interest no longer

a rises, as D. Satchwell (1990) Limited

p roposes to build the houses at

# 50,000 each, including the sum of

# 5,000 already paid by way of deposit.

I should say here, moreover, that had

t he proposed transaction failed to

m aterialise, Hambros Bank had given a w ritten assurance to the Committee

t hat it would ensure that each of the

n ine purchasers would have his/her

d eposit returned, with interest,

d espite no legal obligation on the

p art of the Bank to do so. The support

o f this Bank throughout these

d ifficult negotiations has been highly c ommendable.''

S upplementary question and answer

S enator J.S. Rothwell - First of all

I too share the view that the Bank

h ave acted exceptionally well in these v ery difficult circumstances and it is

p leasing to hear that work will now go a head and I hope everything is going

t o be alright with the new company and c ertainly the people on that

u nfinished estate do. A group of

h ouses of five have been virtually

c ompleted for over a year, and I

u nderstand only merely await mains

s ervicing, by and large, could the

P resident urge the new company to give p riority to those five houses?''

P resident, Housing Committee - The a nswers to these questions have been

e xtremely carefully drawn up between t he Chief Executive Officer and myself a nd we have given all the information t hat we feel justified to give at this

p resent time. In view of the very

d ifficult legal position and the very

e motional issues involved I would ask t he House to allow me to refuse to

a nswer supplementary questions, not

b ecause I want to hide information, I

a m prepared to divulge all the

i nformation available, but I cannot,

a nd it would be most unwise of me, to a nswer questions off the cuff.''

Senator Rothwell Question 2

  Would the President confirm that all  t he couples involved were allocated

 s ites on the understanding that the

c ost of each house would be £42,500?''

President, Housing Committee

  When D. Satchwell Limited allocated t he sites, it was on the understanding t hat each house would be sold for

# 42,500 (which was the ceiling price f or a States' loan property at the

t ime). Whilst legal contracts to this

e ffect were entered into for the first 2 4 houses, no such contracts exist for t he purchasers of the remaining nine s ites. The intention now is for the

r emaining nine to be sold at #50,000 e ach, though over three years will

h ave passed between the time of

a llocation and date of final

c ompletion.''

Senator Rothwell Question 3

  What steps does the Committee intend  t o take in respect of the poor

 w orkmanship on some of the completed  h ouses?''

President, Housing Committee

  As I have stated already, D.

 S atchwell (1990) Limited has

 u ndertaken in writing, through his

 a dvocate, to carry out remedial

 r epairs on those houses already

 c omplete or near completion. The

 H ousing Committee has retained monies  f rom individual loan accounts in

 r espect of these outstanding works,

 a nd proposes to release the payments

o nce it is able to do so following

 c ompletion of the work in question.

 I n conclusion, I should add that the

u nfortunate circumstances described in m y answers underlines how important it w as for a house building guarantee

 s cheme to be introduced into the

 I sland. States loan developments in

 f uture will be constructed under the

M unicipal Mutual Insurance Company's Foundation 15' scheme, recently

 i ntroduced into the Island by my

 C ommittee, which not only offers a 15  y ear guarantee once a house is built,

 b ut also guarantees the property

 d uring the construction phase.''

S upplementary question and answer C onnétable of St. Ouen - I certainly a m delighted to hear these comments f rom the President of Housing. Could t he President of Housing inform the H ouse whether a completion date has b een agreed for the remainder of the p roject?''

P resident, Housing Committee - I s aid in the first place that I really

w ant notice of any further questions

o n this. It is important that precise

l egal answers be given, fully

c onsidered by our legal advisers.''

Field 1007, St. John: comments during debate. Personal statement

The Connétable of St. John made a personal statement in the following terms -

  When the proposition to rezone Field

 1 007 was debated on 9th October  1990,  I left the Chamber because I felt that

 b ecause I owned property next door it

m ight have been thought that I had an

 i ndirect or direct interest. Senator

 S henton spoke in this debate and made

 s ome very misleading personal remarks  a bout the President of the Island

 D evelopment Committee which I cannot  l et go unchallenged. What the Senator

 s aid was, and I quote there was a

 f ile something like four inches thick

 w hich had been outstanding because of  t he Island Development Committee of

 t he day, previous to me, wanting to

 t ake action against the unauthorised

 u se of that particular site.' As he

o ften does, Senator Shenton made

 c omments without researching the facts  a nd I feel that I must make my

 p osition absolutely clear.

I purchased Les Ruettes, St. John in 1 958 and from there carried out

v arious business activities until I

f ormed John Le Sueur and Company L imited in 1963. This was an

a gricultural and general merchants

b usiness.

L ike most businesses that are

s uccessful the company grew in size a nd it was in 1974 that I applied to t he Island Development Committee to

e xtend the building to provide

s torage, offices and a homes and

g ardens centre. The building was

c ompleted in 1975. Senator Shenton

b ecame President of the Island

D evelopment Committee in 1975. The Les R uettes file was indeed sent to the

A ttorney General by Senator Shenton

b ut the Attorney General found that I

h ad not acted improperly and in the

c orrespondence suggested that the

I sland Development Committee of the

d ay was very naive when they gave me

p ermission to develop the site.

K osangas C.I. Limited applied to build a n LPG filling station at Les Ruettes

i n 1967. They were given approval. A

t wo-storey building containing offices a nd showrooms were approved in 1979.

U p to that time I was simply a Jersey b usinessman applying when the need a rose for permission from appropriate C ommittees.

I became Connétable of St. John in

1 980. I became President of the Island

D evelopment Committee in 1984. In 1986 K osangas C.I. Limited asked to

i ncrease the storage of LPG because of

t heir successful sales and the need to

s tore bigger amounts to ensure against

s torms disrupting their service. This

s torage was placed underground and was f ully supported by the Health and

S afety Executive, through the Social

S ecurity Department, and the Fire

S ervice. Safety was able to be much

i mproved.

D uring Senator Shenton's term of

o ffice his own Committee allowed a big t win span concrete block extension

t ogether with a large glasshouse at

L es Ruettes and, in fact, a wooden

b uilding was replaced by another

c oncrete block building at the request

o f his own Committee. This building is n ow let to the Jersey Farmers Trading U nion Limited.

 S enator Shenton's snide remarks about   empires', takeovers' and improper

 a ctions' are totally unfounded. In f act, following another complaint from M r. Manning in 1987 the Attorney

G eneral wrote to him saying the

c omplaint had been fully investigated a nd everything had been found to be in

o rder. Sir, on 9th October I

c hallenged Senator Shenton outside

t his Chamber and he apologised to me a nd said that when the opportunity

a rose he would put this matter right.

I don't trust his memory and therefore m ake this statement.''

12 Caledonia Place, St. Helier : sub- lease

of the Public Services Committee, agreed to grant a sub-lease of 1,118 square feet of office accommodation at 12 Caledonia Place, St. Helier to H. & H. Jersey Growers (1972) Limited for a period of three years eight months from 1st November 1990 to 24th June 1994 at a fixed rental of #11,180 a year.

building sand and, on completion, restored

to its former use, subject to the work

being carried out in accordance with conditions laid down by the Island Development Committee.
