The Deputy Bailiff made a statement in the following terms -

C ommittee to conduct a review into
l egal practice in Jersey.
T he terms of reference which have been a greed by the Bailiff , the Chairman of
t he Committee and the Legislation
C ommittee are as follows -
1 . The availability and cost of legal s e rv ices.
2 . The fixing of fees in non-
c o n tentious civil matters by the R o y al Court.
3 . The level of taxed costs allowed i n c ivil and criminal cases.
4 . The legal aid scheme.
5 . The methods of dealing with c o m plaints.
6 . Disciplinary proceedings against p r a ctitioners, and to consider
s u c h other matters concerning the p r a ctice of law in Jersey as it

The President of the Policy and Resources Committee replied as follows -
Yes. My Committee has benefited, and c ontinues to benefit, from the
i ndependent advice received from a v aluer employed by Devon County C ouncil who has assisted as a valuer a nd negotiator in respect of major
p roperty transactions in which the
S tates have had or have an interest.
F or the future, the Property
M anagement Office, approved by the S tates earlier this year, will be
r esponsible for all property
a cquisitions. However, it was also
m ade clear in the report supporting
t he setting up of that office that
a ssistance would be obtained through
t he employment of external valuers and s urveyors as required.''

3 . Is a similar procedure used when t h e States are negotiating to buy
a n y areas of land that may be

w at erfront scheme?
4 . What, if any, precautions are to
b e t aken to prevent the area for
p r iv ate development to be sold by t h e States from being bought by
o n e developer, thereby creating a
m o nopolistic situation that would n o t be in the best interest of the
c o m munity?
5 . Will all the development options b e a dvertised?
6 . Has any agreement been reached on t h e sale and development of any
p a r t of the Weighbridge island
s it e ?

d e v eloper. As the Public Services D ep artment is concerned that the
b u s station site as originally
p r o posed might not be large
e n o ugh, would the President of

The President of the Island Development Committee replied as follows -
1. My Committee has not yet given
a n y c o nsideration as to how
t h e S t ates owned land in the
w at e r front area might be
a l lo c a ted, either by sale or
l e as e , to private developers.
T h e C ommittee has taken the
v i e w t hat its first objective
i s to g ain approval for the
c o n t en t of the Waterfront Plan
a n d t o consider its
i m p l e mentation thereafter.
C l e a rl y as far as the land
r e c la m ation site is concerned,
t im e i s on our side inasmuch
a s l a n d is unlikely to be
a v a il a ble for development for
a t l ea s t two/three years.
2 . When States owned land is disposed
o f e ither by sale or lease it is
u s u ally at its market value, that
v a lu e being determined by
i n d ependent valuers and being
b a s ed on the existing or proposed u s e of the land.
3 . The same principles apply in
r e la tion to the valuation of land f o r purchase by the States.
4 . The Committee has yet to address t h is question and will not do so
u n t il such time as there is an
a p p roved waterfront plan.
H o wever, I think it is safe to say
t h at the Committee would be
l o o king to ensure that development

Census for 1991. Statement
The President of the Etat Civil
Committee made a statement in the following terms -
Members will know that in March of t his year a census of population was
h eld, the main purpose being to
m onitor the rate of population growth a nd to analyse the causes of that
g rowth.
I am pleased now to be able to give M embers the first results of that
c ensus. The total resident population
o f the Island in March of this year - t hat is those present on the census
n ight of 10th/11th March, excluding v isitors, plus those normally resident b ut absent on census night - was
8 4,082 or 1,273 more than in 1989.
O f that increase 427 is accounted for
b y the natural increase of the
p opulation - that is, the excess of
l ive births over deaths - and 846 by
n et immigration. This represents a
r ate of net immigration of 423 a year
b etween 1989 and 1991, which compares w ith a figure of 699 a year between
1 986 and 1989 and 820 a year between
1 981 and 1986.
T he Census Officer has prepared a
s hort preliminary report on the census
f or my Committee, and this will be
c irculated to members during this
m orning's sitting. A full report on
t he census will be prepared by the
C ensus Officer, and my Committee will p resent this to the States at the
e arliest possible date.
I should like to take this opportunity
