Springfield, St. Helier : petition. P.110/91

Deputy P.A. Bailhache of St. Helier presented to the States a petition of

Alfred Moignard and others, asking the States to grant the prayer of the petition

and direct the Island Development Committee to prepare for the approval of the States a development plan for Springfield for a

mixed development of sport, in particular football, and Category A' housing, with

road improvements at the Robin Hood junction.

THE STATES referred the said petition to

Maintenance payments in separation and divorce proceedings. Question and answer

Deputy Shirley Margaret Baudains of

St. Helier asked Deputy Edgar John Becquet, President of the Legislation Committee the following question -

On 12th June 1990, the States

a dopted P.56/90 and requested the

L egislation Committee to consider the p ossibility of preparing the necessary l egislation to ensure that the

i nnocent parties (including children)

i n separation and divorce proceedings d o not suffer financial hardship

b ecause of the failure of the other

p arty to make his or her payments at

t he proper time for maintenance and

s upport and to report thereon.

W ill the President please inform the

S tates how much progress has been made i n this matter so far?''

The President of the Legislation Committee replied as follows -

In consultation with the Attorney

G eneral and the Viscount my Committee h as given careful consideration to the

q uestion of maintenance payments and

w ays in which to ensure that innocent

p arties do not suffer financial

h ardship as a result of defaults in

p ayments.

T he Committee felt that, in many

c ases, hardship was being caused as a r esult of delays in obtaining Court O rders when a default occurred and,

f ollowing discussions with Deputy S.M. B audains, agreed that the States

s hould be asked to enact legislation

t o make additional provision for the

e nforcement of maintenance orders and t o accelerate the procedures for an

a rrest on wages should a default occur w hilst protecting the conscientious

p ayer of maintenance. The draft

l egislation has been prepared and is

c urrently under discussion with all

i nterested parties.

T he Committee also received the

a ssurance of the Connétable of St.

H elier that, whilst litigation was

p roceeding, in instances where it

c ould be proved that the individuals

c oncerned had no other alternative but t o seek financial help from the

P arish, every effort would be made to e nsure that the family was supported i n the short term.''

Special Committee on Sex Discrimination. Statement

Senator Corrie Stein, chairman of

the Special Committee on Sex Discrimination made a statement in the following terms -

1. It is now some five months

s ince t he Special Committee on S ex D iscrimination was

es tab l ished. In that time the

C om m ittee has looked at a wide r a nge o f issues.

T he on e, which in particular

caus es many women great anxiety, i s our present Inheritance Law and t he r efore we are eagerly awaiting t he i ntroduction of the new

l egi slation, which is in draft

f or m .

2 . Many approaches were also made to us on maternity rights and

t he r efore we have proposed a

cons ultation paper on maternity

r ight s that we would like to

pr om ote as a Code of Good

P r ac tice. We specifically did not

choos e to introduce a Code of Best

P r ac tice, as the Committee

bel i eved it would achieve a better

l evel of co-operation from all

i nv olved by introducing a code w h i ch we believe everyone can adopt .

3 . In Jersey, where the States are

pur suing a policy of limiting

i m m igration, it is particularly

i mportant that the skills and work expe rience of women in the Island s houl d not be lost to the labour

m ar ket. The experience of

em pl oyers in the United Kingdom, and e lsewhere, suggests that the

i nt r oduction of maternity rights

gi v es women a greater incentive to r em ain with their employer and to t rai n for more senior positions.

O n t  he other hand, the lack of

m at ernity rights has frequently

m eant that women who wish to

r et ur n to paid work after

chi l dbirth are faced with a need

t o a ccept a job where their

pr e vious skills are unused and

t he i r earnings potential is

r ed uced. Not surprisingly, this

di scour ages further career

deve lopment.

4 . In preparing a draft Code of Good P r ac tice the Committee has

cons idered the position of small

and l arge employers, and the

var ious sectors of the economy.

T he C ommittee is also aware that

m any em ployers in Jersey already

oper ate schemes for maternity

r ight s that are equivalent to, or

exce ed, the proposals stated in

t hi s Code of Good Practice. In

m any E uropean countries and North A m erica maternity rights are a

s tat utory right. However, the

C om mittee believes that much can

be a chieved in Jersey through the

pr om otion of a Code of Good

P r ac tice, and that legislation

need only be contemplated if

evi denc e suggests that employers

ar e f ailing to respond to such a

C ode on a voluntary basis.

5 . The message the Committee would w i s h to convey is that the Code of

G o od P ractice is of value to

em pl oyers as well as to their

em pl oyees. The benefits of the

cont inued availability and

ef fec tive use of the skills and

expe rience already possessed by

t he m any working women in the

I sl and in employment, and the

cont inued development of these

s ki l ls, should be of particular

val ue t o employers. The Committee bel i eves that implementing this

C ode w ill greatly assist the many w o m en who wish to combine the

r ôl es of a career and motherhood, w i t hout adversely affecting the com petitiveness of Island

bus inesses.

6 . The draft Code of Practice is

f oun ded on the following basic pr e cepts -

A l l women who have been in paid em pl oyment when they become pr e gnant should be entitled to -

* t he right to protection

fr om di s m issal owing to p regn ancy ;

* t he right to reasonable

ti m e of f f or ante-natal car e .

A l l w omen who have been in pai d e mployment for a period

of 12 m onths or more with

thei r current employer when

t hey be come pregnant and who hav e bee n contributory members of t he Social Security Scheme,

s ho ul d be entitled to -

* t he right to maternity

lea ve;

* t he right to maternity

p ay;

* t he right to

rei ns t at em ent in the same

o r s i m il ar job.

T hes e r ights should apply to

w om en w hether they are working f u ll -t i me or part-time.

7 . We are in discussion with the

I ndu strial Relations Officer to

es tabl ish a complaints procedure

once the code has been adopted and w e w ould hope that by the end of

S ept ember of this year employers

w i l l be moving towards

i m pl ementing the code on a

vol untary basis.

s uppo rt and co-operation.''
