Bishop of Basingstoke - welcome

The Bailiff welcomed to the States the Bishop of Basingstoke, the Right Reverend Geoffrey Rowell.

M.V. St. Malo'' catamaran - rescue

The Bailiff , on behalf of the States, referred

to the rescue at sea of over 300 people from the Channiland catamaran M.V. St. Malo'' and paid tribute to everyone involved at the scene declaring that it had been a magnificent collective effort'', special mention being made of the Harbourmaster, Captain Roy Bullen, for his calm and professional response to the crisis.

Channel Television - States Meeting 8th May 1995

THE STATES acceded to the request of Channel Television to film the States Meeting to be held

on Monday, 8th May 1995, to commemorate the 50th anniversary of the liberation of the Island from enemy forces.

Childcare provision and cost in the Island - questions and answers (Tape No. 278)

Deputy Gary Matthews of St. Brelade asked Senator Reginald Robert Jeune , President of the Policy and Resources Committee, the following questions -

1.  F ollowing my recent meeting with

th e P o licy and Resources Committee to d is c uss the Social Charter for

Je r s e y , would the President agree

th a t a review body or working

p ar t y s hould be urgently

es t a b li shed to look at the

q u es t io n of childcare provision

an d c o st in the Island, such a

b o d y t o have representation from

th e v ar ious States departments,

em  p l o yers and parents, and its

p o li c y recommendations to be

p re s e n ted to the States as soon as

p o ss i b le for debate?

 2 .  Would the President agree that the

q u e stion of childcare provision and

c o s t is extremely important and that

t h e issue has been highlighted in

s u b sequent Annual Reports of the Chief A  d viser over the last few years and now r e q uires action?''

The President of the Policy and Resources Committee replied as follows -

1.  A t the meeting of the Policy and

R e s o u rces Committee on 7th March 1 9 9 5 t o which the Deputy is

re f e rr i ng it was agreed that with

th e p as sage of time it might be n ec e s s ary for the Deputy to amend h is p r o position P.100/94 in which

h e p r o posed amendments to the

p ro p o s ition entitled Social

C h a rt e r' lodged by Senator Shenton

o n 1 4 t h June 1994 (P.81/94), to

re f le c t his current views on

ch i l d ca re provision. The Committee h as y e t to hear from the Deputy on th i s p o int. However, since that

m e e ti n g, the matter of a working

p ar t y t o consider childcare

p ro v i s ion has been raised by

D e p u ty Dorey, and I understand

th a t m  eetings are being arranged

to p ro g ress this matter. I assume

th a t D  eputy Dorey will be inviting th e D e puty and other members of th e H o use who have expressed an in t e re s t in this matter to join

h im i n discussions on what form a w o r k in g party should take and what it s t er m s of reference should be.

A  t my request the Chief Adviser,

t h ro ugh the support he is prepared to g i v e to such a working party, if asked, w  il l also represent the declared

i n te rest of my Committee in childcare p r o vision.

 2 .  The answer to the Deputy 's question is

y e s , I do agree that the question of

c h il dcare provision is an important

i ss u e to address. The Deputy will be

a w a re that one of the issues' being

a d d ressed in the Strategic Policy

R e v iew consultation exercise is whether

m  o re should be done to encourage women w  it h young children to remain in

e m p loyment or take up employment and, i f s o, how this should be done.

C h i ldcare provision therefore is one of

t h e matters that will be addressed in

t h is year's Strategic Policy Report.''

Investigations into costs of childcare - questions and answers (Tape No. 278)

Deputy Gary Matthews of St. Brelade asked Deputy Derek Ryder Maltwood of St. Mary, Vice-President of the Finance and Economics Committee the following questions -

C o m m  ittee undertook to investigate th i s m  atter. Would the Vice-

P re s i d ent inform the House what

p ro g r e ss there has been on this?

 2 .  Will the Vice-President ensure that the F i n ance and Economics Committee

i n v estigates the possibility of

i n tr oducing childcare costs in the

f o rt hcoming debate on the 1996 budget?

 3 .  Has the Finance and Economics Committee i n v estigated the possibility of

i n tr oducing -

( a ) a voucher scheme for childcare;

( b ) tax relief for employers who p ro v i d e childcare services;

( c ) any other financial or fiscal in c e n ti ves in this area?''

The Vice-President of the Finance and Economics Committee replied as follows -

1.  I refer the Deputy to the answer

g iv e n a moment ago by the

P re s i d ent of the Policy and

R e s o u rces Committee when he stated th a t t h e matter of setting up a

w o r k in g party to consider

ch i l d ca re provision has been

ra i se d by Deputy J.L. Dorey, and I

u n d er s tand that meetings are being

ar r a n g ed to progress the matter.

 2 .  If the working party is set up and

r e co mmends funding for childcare costs, t h is issue will be considered alongside

a l l other budget requests for future

y e a rs.

 3 .  Members will note that in the report

e n ti tled Equity in the Income Tax

S y s tem' which was submitted to the

S t a tes on 27th September 1994, the

F i n ance and Economics Committee had c o n sidered the issue of childcare

p a y ments. The report stated that the

i n co me tax system already helps parents w  h o pay tax; non-taxpayers could be

g i v en assistance via the family a l lo wance system and employers should p e r haps be encouraged to do more to

h e lp '. These issues could be considered

i n m ore detail by the working party who c o u ld make specific recommendations in d u e course to the Finance and Economics C o m mittee.''

International conventions - questions and answers (Tape No. 278)

Deputy Gary Matthews of St. Brelade asked Senator Reginald Robert Jeune , President of the Policy and Resources Committee, the following questions -

1.  W ill the President inform the

H o u s e whether the United Kingdom h as ra t ified the UNESCO Convention co n c e r ning the Protection of the

W o r l d Cultural and Natural

H e r it a ge ( the UNESCO Cultural

C o n v e ntion'') on Jersey's behalf?

 2 .  Is the President aware that at a recent

A  rt s and Heritage Conference both the

M  u seums Director and the Arts Centre

D  ir ector called for Jersey to accede to

t h e UNESCO Cultural Convention? Will t h e President ensure that this matter

i s p rioritised and that the appropriate

s te p s are taken without delay?

 3 .  Can the President explain to the States w  h y Jersey has not yet acceded to the

C o u ncil of Europe's European Social

C h a rter?

 4 .  Can the President explain why Jersey h a s agreed to the ratification on its

b e h alf of the United Nations

I n te rnational Covenant on Economic, S o c ial and Cultural Rights, which

c o n tains similar provisions, and yet

a p p ears not to want to sign up to the

E u r opean Social Charter? Is there

c o n tradiction in this position?

 5 .  Would the President agree that a modern d e m ocracy and international finance

c e n tre such as ours should seek to

c o m ply with international standards and t h at the best way of determining best

p r a ctice internationally is by Jersey

b e in g proactive in reviewing, acceding t o a nd implementing international c o n ventions?''

The President of the Policy and Resources Committee replied as follows -

1.  T he present position is that the

U n i te d Kingdom ratified the UNESCO (U  n it e d Nations Educational,

S c ie n t ific and Cultural

O r g a n isation) Cultural Convention

in 1 9 8 3 but at that time the then

Is l an d Development Committee could se e n o benefit in the Convention

b ei n g extended to Jersey and

th e r e fo re the Island was not

in c l u d ed in the ratification of

th e C o nvention by Her Majesty's

G o v e r nment.

T h e Policy and Resources Committee

r e v iewed the Island's position with

r e g ard to this Convention in August

1 9 9 4 and decided that there could be

a d v antages to be gained from Jersey

b e in g associated with the Convention. F o r example, membership would entitle t h e Island to apply for the

c l as sification of cultural and natural

h e r itage sites under the World

H  er itage List'. It would also

d e m onstrate the Island's commitment to p r e serving its heritage. However, a

n u m ber of questions arose from the

C o m mittee's consideration of the

C o n vention, concerning eligibility,

c o s ts and listing and reporting

r e q uirements, which H.M. Government w er e asked to answer. The response of H .M . Government was received earlier t h is month and the matter is now being f u rt her considered by the Policy and

R e s ources Committee.

 2 .  Members will be informed of the outcome

o f m y Committee's further consideration

o f t he Convention which will be

u n d ertaken without delay. Her Majesty's

G  o vernment has expressed the view that,

p r o vided Jersey has the necessary

l e gi slation in place to enable it to

f u lf ill all of the obligations which

a r is e under the Convention, which is

u n d erstood to be the case, the United

K  in gdom's ratification can be extended

t o J ersey.

 3 .  The Policy and Resources Committee is

o f t he view that the Island should

p u r sue those social policy objectives

t h at best meet the needs of the Island.

C u r rent States policies satisfy the

u n d ertakings required for the Island to

a c c ede to the Social Charter, but the

C o m mittee is not yet convinced of the

n e e d for the Island authorities

f o rm ally to accede to the Charter. The

C o m mittee is of the opinion that the

S t a tes should be in a position to

p u r sue policies that are in accord with

t h e principles of international

C o n ventions without necessarily being

c o m mitted to the legislation which may b e a condition of being a party to a

C o n vention.

T h e States have recently agreed to give

o v e rall strategic responsibility for

s o c ial services to the Public Health

C o m mittee, to be renamed the Health and S o c ial Services Committee. If that

C o m mittee should make representations

t o t he Policy and Resources Committee

t h at social policies are being

f ru s trated because the States is not a

p a r ty to the European Social Charter, I

c a n assure the Deputy that my Committee w  o uld be quick to make representations

t o H er Majesty's Government through

o f fi cial channels for the Social

C h a rter to be extended to the Island.

4 . The reason why the Policy and Resources C o m mittee has not yet recommended that J e rs ey accede to the European Social

C h a rter has been given in the answer to

t h e previous question. The Island is

c u r rently as able to comply with the

p r o visions of the Social Charter as it

i s a ble to honour similar obligations

u n d er the United Nations International

C o v enant on Economic, Social and

C u l tural Rights, which was extended to

J e rs ey in 1976. My Committee is not

a w a re that the decision to date not to

a c c ede to the European Social Charter

h a s limited, or will limit in the

f u tu re, the States ability to pursue

t h e social policy aims to which the

S o c ial Charter refers. My Committee is

o f t he view that, whatever the status

o f t he Island in respect of the

C h a rter, such policies should continue t o b e advanced in accordance with the n e e ds of the Island and with the

a p p roval of the States, subject to

w h atever resource restraints may apply f ro m time to time.

 5 .  I agree that the Island should seek to

c o m ply with international standards.

H  o wever, the best way of measuring the I s la nd's success in this respect is to

c o m pare the current standards in the

I s la nd with those in Europe and

e l se where. There are many countries

t h at have acceded to, and are said to

b e i mplementing, international

c o n ventions such as the United Nations I n te rnational Covenant on Economic,

S o c ial and Cultural Rights with which

i t is believed the Island compares

e x tr emely favourably. This does not

a r is e because the Island has been

l o o king over its shoulder at its

o b l igations under this or other

i n te rnational Conventions. It arises

b e c ause of the Island's own policies

    a n d in particular the success in

c r ea ting a strong economy and a

p o s itive budgetary situation upon

w  h ich, at the end of the day, the range

a n d quality of social services must

u l ti mately depend.''

16+ education - question and answer (Tape No. 278)

Deputy Leonard Norman of St. Clement asked the Connétable of St. Lawrence, President of the Education Committee, the following question -

  Will the President confirm, as she

 i ndicated at the last meeting of the States

o n 28th March 1995, that the Education

 C ommittee will be considering the report of  t he working party charged to investigate

 t he future of 16+ education at the

 C ommittee's meeting on 26th April 1995?''

The President of the Education Committee replied as follows -

  The working party has nearly completed

 i ts work but due to the complexity of the

 t ask and the intervening Easter holiday, it

 h as proved impossible to meet the demanding d eadline set by the Education Committee. T he Committee will now receive the report

o n 5th May 1995.''

Strategic Policy Review - statement

The President of the Policy and Resources Committee made a statement in the following terms -

  I should like to inform the House of the  p resent position regarding the Policy and  R esources Committee's Strategic Policy  R eview consultation exercise.

M eetings have been held to-date with 55

o rganisations or groups of individuals

d rawn from a cross section of the Island

c ommunity. The Committee also has been in r eceipt of written submissions from 25

o rganisations. A general questionnaire, to

w hich all residents of the Island are being

e ncouraged to respond, will be distributed

t hroughout the Island at the beginning of

n ext week.

T he consultation process has been responded t o with great enthusiasm. The many who have t aken part have welcomed the opportunity to p articipate for the first time in

d iscussions on the future of the Island for

t he year 2000 and beyond.

B ecause of the enthusiastic response to the c onsultation process it has taken longer to c omplete than the Committee had initially e xpected. Given the interest shown the

C ommittee also would wish to give the

r elevant organisations, the general public

a nd States' members a sufficient period

b etween the publication of the Strategic

P olicy Review report and the States debate t o allow for the conclusions and

r ecommendations in that report to be fully d iscussed. The Committee intends to hold a n umber of briefing meetings to assist in

t his process.

W ith this in mind the Committee would seek t he agreement of the House to the

p ostponement of the debate on the Strategic P olicy Review from 20th/21st June to

1 2th/13th September. The Committee is sure t he House will agree that this year's

S trategic Policy Debate will be one of m ajor importance for the Island, and that f or this reason the report both in its

p reparation, and in its consideration prior t o a States' debate, should not be unduly r ushed.

I have agreed with the President of the

F inance and Economics Committee that this d elay will not present his Committee with

a ny problems in preparing the budget for

1 996. The delay also will provide my

C ommittee with more time to discuss with P residents of Committees the prioritisation

o f the Law Drafting programme, and to this e nd I am proposing to hold a meeting of

P residents to discuss my Committee's

r ecommendations in the second half of
