Rates assessment - questions and answers (Tape No. 370)
Deputy James Thomas Johns of St. Helier asked the Connétable of St. Clement the following questions -

(J er sey ) Law 1946, as amended,
se t ou t in Annex A of Appendix 2
of t he Wor king Party's report
da t ed 10t h August 1993 (P.124/93), w oul d t he Connétable inform
m em ber s what progress has been m ade t owards introducing the
sy s t e m of Fixed Rateable Value (F R V ) in the Island, as
recom mended in that report.
2 . The States, on 26th September 1995,
appoi nted members of the Parish Rate
A p peal Board for a period of five years w i t h effect from 1st October 1995
( P .10 1/95). Will the Connétable advise m em bers of the work of the Board to
dat e an d of any recommendations for its f ut ur e operation?
3 . Would the Connétable inform members w h at progress has been made towards
achi eving consistency between the
t w el ve parishes in assessing properties
f or r ating purposes?''
The Connétable of St. Clement replied as follows -
1. T he States, on 24th May, 1994 -
( a ) approved the recommendations of the W or king Party on the Review of the P ar ish Rate
(A dm i nistration) (Jersey) Law 1946 as am ende d, set out in Annex A of
A ppen dix 2 of the Working Party's repor t da ted 10th August 1993;
( b ) agreed, in principle, that a new
L aw be drafted to replace the
P ar i s h R ate (Administration)
(J er sey ) Law 1946 as amended, and reques ted the Legislation
C om m ittee to prepare the necessary l egi slation; and
( c ) requested the Policy and
R es our ces Committee to include the dr af ti ng of the new Rates Law in
the S tat es Legislation Programme
for 199 3/94.
T he s ystem of fixed rateable value
( F R V) approved by the States was to be der ived by freezing a specific year's
as ses sed rateable value. For foncier
pur poses actual rent would be totally
di sr egarded and the landlord's
l iability calculated in the
af o rementioned manner. That FRV figure w o ul d remain static from year to year
unl ess there were any improvements, any al t er ations, any additions to the
pr op erty, or any change of status. The
L egi slation Committee was charged by t he S tates with preparing this
l egi slation and met with the
S uper visory Committee to express its conc ern that, if a change in the Law
w a s introduced, inequities could be
bui lt into the system as rateable
val ues are used for other purposes, for exam ple by the Jersey New Waterworks C om pany in assessing water bills. The L egi slation Committee was therefore onl y prepared to bring legislation to
t he S tates if it could be satisfied
t ha t there was a degree of consistency bet w een the parishes. To date, whilst a degr ee of consistency has been achieved i n r espect of rate assessments within
i nd ividual parishes, there has not been uni formity Island-wide and therefore
l it tl e progress has been made towards achi eving the system of FRV. As a
r es ul t the drafting of the new Law has been removed from the current States
L egi slation Programme. Indeed, it is
t he unan imous view of the Parish Rate A p peal Board that a new Law on the
pr inci ple of fixed rateable values on
t he bas is that the current assessed
val ues are fair and reasonable should
be de ferred until there is uniformity
and r ealistic assessment particularly
i n t he area of owner occupied
pr op erties.
2 . The Parish Rate Appeal Board met during 1996 t o decide on the appeals against
dr a ft assessments from seven Parishes.
A t t he conclusion of the appeals the
C hai rman of the Board wrote to the
S uper visory Committee concerning the
appe als received and making a number of r ec om mendations which are currently
bei ng co nsidered by the Supervisory
C om mittee. The Parish Rate Appeal Board al s o s ought legal advice on five
appe als which is also being considered
by t he Supervisory Committee as it will
det er mine the method adopted in future
r at e a ssessments. The Supervisory
C om mittee is responsible for promoting
uni formity in the principles and
pr a ctice of rating and for assisting
as ses sment committees in the
per formance of their functions under
t he L aw and it will be meeting with the
C hai rmen of the Assessment Committees next month to discuss the 1997
as ses sments.
3 . The Supervisory Committee is aware of publ ic concern regarding disparity in
r at e a ssessments and of its
r es pons ibility to promote uniformity.
T he r eport of the Parish Rate Appeal
B oar d has been most helpful in this
r es pec t in making a number of
r ec om mendations which would promote
uni formity within the Island and, as I
have already stated, these
r ec om mendations are currently being
cons idered by the Supervisory Committee and w ill be discussed with the Chairmen
of t he Assessment Committees next
m o nth. I am therefore hopeful that over
t he next few months there will be some
pr og ress towards achieving consistency
bet w een the twelve parishes in
as ses sing properties for rating
pur poses. However, I would point out
t ha t even with uniform rates assessment
t hr ougho ut the Island the actual rates
bi ll received by individuals will
cont inue to vary between Parishes
acc ording to the budget requirements of
t ha t Parish.''
Places of refreshment - access and facilities for disabled people - questions and answers (Tape No. 370)
Senator Nigel Lewis Quérée asked the Connétable of St. John , President of the Planning and Environment Committee, the following questions -

The President of the Planning and Environment Committee replied as follows -
1. ( a) To ensure reasonable provision

( b ) To ensure reasonable provision is m ade f or disabled persons to use
the bui lding.
( c ) To ensure reasonable provision is m ade f or disabled persons wherever sa ni tar y conveniences are provided in t h e bui lding.
( d ) To ensure reasonable provision is m ade for disabled persons
w her eve r audience or spectator se at ing a re provided in the
bui l d ing.
2 . The application for the new West Park
C af é was considered under the existing
B ui lding Bye-laws. The new Bye-laws do not take effect until 1st January 1997.
Whi le the existing bye-laws do not
i nc l ude any requirements in respect of
di sabl ed access, my Committee has,
s ince J uly 1992 operated a policy
ent i tled Access and Facilities for
A l l '. Waterfront Enterprise Board
L i m ited's architect submitted plans
w h i ch had been drawn up to comply with t ha t policy.
T hi s policy will be superseded in
J anu ary with the coming into force of
t he new bye-laws, which as members will know , makes requirements for disabled acc ess to buildings.
T he a pplication for the new café
com plied with the existing bye-laws and t he Access and Facilities for All'
pol icy. Indeed, it complies with the
r eq uirements of the new bye-laws.
A c cor dingly we had no option but to appr ove the application. However, in so doi ng, we asked W.E.B Limited to
cons ider amending their plans to
pr ov ide lift access to the mezzanine
f loor .
I un derstand that Waterfront Enterprise B oar d Limited had agreed to that
r eq uest, and has found a lift that is
s ui t able for the building. At the
pr e sent time we await a revised
appl ication to accommodate the lift.
3 . The requirements in Part 8 of the
S econ d Schedule to Building Bye-laws ( Je r sey) 1996 become effective on 1st
J anu ary 1997. I explained the
r eq uirements in answering Question 1.
I t i s impossible to be specific on such
a ge neral question, as each application r eq uires a judgement to be made on the i nd ividual merits of the design and
pur pose of the building. There are many des ign factors which need to be
cons idered. What is reasonable for one bui lding may not be reasonable for anot her.
I n m ost cases a lift will be required t o e nsure that access to upper floors i s achi eved.
H o w ever, given the disproportionate cos t and intrusion into usable floor
s pac e in small buildings it is, in the
C om mittee's view, unreasonable to
r eq uire all buildings constructed under t he new bye-laws to have a lift as a
m andat ory requirement.
G u i dance on the circumstances where a l if t m ust be provided can be found in
t he T echnical Guidance Document for P ar t 8. This document is one of a
s er i es approved by my Committee and pr ov ides guidance for the more common bui lding situations.
T he t echnical guidance document for P ar t 8 recommends that a lift is
pr ov ided -
( a ) in two storey buildings where the
st or ey ab ove or below the
pr i nc ipa l entrance has a floor
ar ea exceeding 280m2 (3,000 square feet ) ;
( b ) in a building of more than two st or eys where any storey has a fl oor ar ea of more than 200 m2 (2,150 s quare feet)
I f a s torey is not large enough to
w a r rant a passenger lift, but has an ar ea ove r 1,075 square feet which is us ed for a unique' facility, this
f loor should still be accessible to
w h eel chair users.
T he de cision as to whether a lift is
r eq uired in a building will be based on t he f loor size of the building, and it
w i l l depend on whether unique'
f ac i lities are provided on different
f loor s.''
Social security scheme: continuity and change - P.132/96
THE STATES, adopting a proposition of the Employment and Social Security Committee, agreed -
1 . to develop the existing social security s che me so that -
( a ) the current pay as you go'
fundi ng be r eplaced by a partial
fundi ng ar rangement so as to carry the s c hem e through the maximum ef f e ct of an ageing population
pr edi ct ed to occur towards the
m i dd le of the next century;
( b ) the principle of equivalent
fundi ng bet ween employer, employee an d t he States be restored;
( c ) the earnings ceiling and the
st and ar d rates of benefit be
indexe d annually by the same
pe r ce nt age increase as the annual incr eas e in the earnings index;
( d ) the States' supplementing of
co nt r ibu tions be applied to those
pe opl e whose monthly income was ge nui n ely below the earnings
ce i li ng ;
2 . to amend the old age pension provisions s o t hat -
( a ) a full pension would become pa yabl e after 45 years'
co nt r ibu tion to the scheme;
( b ) the age at which a pension is paid be m a de m ore flexible within the
range 63 t o 65 years of age;
3 . to replace widow's benefits by
s ur vi vor's benefits so that both men and w omen can benefit from
cont ributions paid by their late
s pous e;
4 . to replace the incapacity and accident bene fits by a new series of sickness
and d isability benefits and to
i nt r oduce a new invalidity pension to
m eet the changes in long-term sickness pat t erns;
5 . to meet the cost of the proposed chan ges by -
( a ) increasing contribution rates from ei ght per cent to 10½ per cent in
gr adua l steps of 0.5 per cent over
the ne xt five years;
( b ) increasing the monthly earnings ce i li ng by £50 a month in addition to t h e ann ual indexation, each
ye ar f or the next five years;
6 . to agree that the existing non-
cont ributory benefits continue to be
f und ed from general revenues so that
t he di sadvantaged are supported through t he w ider net of taxation;
7 . to increase the level of invalid care al l ow ance to the standard rate of
cont ributory benefit;
8 . to approve, in principle, the setting up of -
( a ) a Management Committee to su per v ise the Social Security (R es er ve) Fund;
( b ) a Social Security Agency to ad m i ni ster the social security sc hem e.
9 . to charge the Employment and Social
S ecur ity Committee to present to the
S t a tes for approval the legislation
nece ssary to implement these proposals.
Senator Antony Beresford Chinn, having received an assurance by the President of the Employment and Social Security Committee that the Committee would investigate secondary pension provision, decided not to present his report and
proposition requesting the Committee to do so.
Channel Islands Electricity Grid - P.136/96
THE STATES, adopting a proposition of the Finance and Economics Committee, expressed their support for the decision of the Finance and Economics Committee, in exercising its power and duty under Article 31 of the Electricity
(Jersey) Law 1937, that the proposals by the
Jersey Electricity Company Limited to reinforce
its electricity importation capability and to
create with Guernsey Electricity a Channel
Islands Electricity Grid', safeguarded the
public interest.

THE STATES, adopting a proposition of the Planning and Environment Committee, supported that Committee's intention to grant permission for the development of a new dwelling on land at Les Buissons, La Route de Beaumont, St. Peter (as shown on drawing No. 541/1) which is situated within an area designated as Aircraft Noise Zone 1 on the Island Map, as amended, 1-87, as an exception to the States' policies regarding the development of land within that area.

THE STATES, adopting a proposition of the Planning and Environment Committee, supported the intention of that Committee to grant
planning permission for the construction of an agricultural building and four portacabins on Field 284, La Rue de Maupertuis, St. Mary , the land being situated within an area designated as Green Zone on the Island Map, as amended, 1-87.
