Matters noted – land transactions

THE STATES noted an Act of the Finance and Economics Committee, dated 22nd May 1998, recording the following decisions of the Treasurer of the States under delegated powers, in pursuance of Standing Orders relating to certain transactions in land –

( a ) as recommended by the Planning and Environment Committee, leases to the Jersey Electricity

Company Limited of areas of land at the development site known as Belle Vue, St.  Brelade, for the purpose of housing two sub-stations and two four-way section pillars as follows –

99 year lease at an annual rental of £1.00 to be paid upon signing the contract and with effect from the date of signature;

99 year lease at an annual rental of £1.00 to be paid upon signing the contract and with effect from the date of signature;

99 year lease for each section pillar for a consideration of £10.00 to be paid upon signing the contract and with effect from the date of signature;

o n th e b as is that each party would be responsible for its own legal costs arising from the transactions;

(b ) a s recommended by the Planning and Environment Committee, the acquisition by the public from the

Crown of the fonds of the Havre des Pas Swimming Pool, Havre des Pas, St. Helier, for the sum of £10.00. The Crown would also grant the public access rights across the foreshore in order to reconstruct the footbridge, as well as rights over a five metre wide area around the outer perimeter of the pool in order to repair and maintain the property. The Crown would grant the public a monthly licence at a nil fee to occupy, manage and administer the foreshore area;

(c ) a s recommended by the Health and Social Services Committee, the renewal of the lease to Miss Lois

Hesford of the upper flat of La Pouclée Lodge, La Pouquelaye, St. Helier, for a period of three years, commencing 26th March 1998, at an annual rent of £7,091, the rent to be reviewed every 12 months in line with the Jersey cost of living index;

(d ) as recommended by the Public Services Committee, the entering into a Contrat de Transaction with

Mr. Colin Francis Journeaux to establish a pedestrian and vehicular right of way from the rear of the property known as No. 35 St. Saviou'rs Road, St. Helier, over land owned by the public of the Island, for a consideration of £250, with Mr. Journeaux being responsible for all legal costs involved in the transaction and the public having the right to cancel the right of way, subject to three months notice in writing, with Mr. Journeaux being responsible for all legal costs involved in the transaction;

(e ) as recommended by the Harbours and Airport Committee, the renewal of the lease to D.K. Collins,

Marine Limited of a small shop/storage area (S22) on the South Pier, St. Helier, measuring 631 square feet, commencing 1st April 1998, at an annual rent of £4,097.52 (representing a rate of

approximately £6.49 per square foot); the rent to be subject to annual review in line with the Jersey cost of living

index.

Sea Fisheries Advisory Panel – questions and answers (Tape No. 447)

Deputy Philip John Rondel of St.  John asked Deputy Harry Hall ewell Baudains of St. Clement , President of the Agriculture and Fisheries Committee, the following questions –

"1 . W ould the President give details of how the Sea Fisheries Advisory Panel is funded?

2 . W ho records the official minutes of the Panel and are they obtainable for States members other than

by way of extracts reported in the general minutes of the Agriculture and Fisheries Committee?

3 . W ould the President undertake to review the Panel's procedures and report back to members with

recommendations on ways to ensure that appointments to the Panel are made democratically?"

The President of the Agriculture and Fisheries Committee replied as follows –

" 1 . The Panel has no real expenses. It meets at the Howard Davis Farm and such services as the distribution of agendas, duplication of papers, etc. etc. are met from within the Committee's budget.

2 . T he Greffier of the States, who kindly makes available a Committee Clerk. This is an advisory body

set up to advise the Agriculture and Fisheries Committee. It is not a decision-making body and its minutes are circulated to and discussed by the Agriculture and Fisheries Committee, and of course to the members of the Panel, who are expected to consult with the industry. The Sea Fisheries Advisory Panel is an important link between the Committee and the industry. Not only does the Committee seek the views of the Panel on matters under discussion, the Panel also draws the attention of the Committee to areas where it believes action needs to be considered.

3 . N o. The Agriculture and Fisheries Committee, in May of 1997, considered the composition of the

Panel, and agreed that its membership enabled the interests of all sections of the industry to be fully represented. I have neither read nor heard anything that would make me disagree with this view. The associations that make up the membership of the Panel nominate their own representatives, and in addition, there are members who are invited to join because of their long and valuable experience in these matters. The Committee believes that this is the perfect model for a panel. Naturally, if the Committee felt at any time there was a section of the industry whose views were not being heard it could change the membership."

The Bailiff , in pursuance of sub-paragraph  (b) of Article  1 of the Financial Services Commission (Amendment (Jersey) Law 1998, and in accordance with Standing Order No.  46(2), ordered the withdrawal of strangers and the closing of the doors of the Chamber in order that the appointment of the Commissioners of the Jersey Financial Services Commission be debated in camera.

Investment Business (Jersey) Law 199 – P.59/98 and P.107/98

THE STATES commenced consideration of the draft Investment Business (Jersey) Law 199  and adopted the Preamble.

Article 1 was adopted, the States having accepted amendments of the Finance and Economics Committee that in paragraph  (1) –

af t e r the definition of "collective investment fund" there should be inserted the following definition –

" th e C o mmission' means the Jersey Financial Services Commission established by the Financial Services Commission (Jersey) Law 199 ;"

i n t h e definition of "prescribed", after the word "Order" there should be inserted the words "of the

Committee on the recommendation of the Commission";

in th e definitions of "registered person", "registration" and "relevant supervisory authority", for the word

"Committee" there should be substituted the word "Commission".

Articles 2 and 3 were adopted.

Article 4 was adopted, the States having accepted amendments of the Finance and Economics Committee that in paragraph (1) after the words"Committee may" there should be inserted the words ", on the recommendation of the Commission," and in paragraph (4) for the word "Committee" there should be substituted the word "Commission".

Article  5 was adopted, the States having accepted an amendment of the Finance and Economics Committee that for Article  5 there should be substituted the following two Articles –

"ARTICLE 5 Functions of the Commission

T he Commission shall have the powers conferred on it by this Law and the duty generally to supervise the persons registered by it in the exercise of those powers.

ARTICLE 5A Limitation of liability

( 1 ) No person or body to whom this Article applies shall be liable in damages for anything done or omitted in the discharge or purported discharge of any functions under this Law or any enactment made, or purportedly made, under this Law unless it is shown that the act or omission was in bad faith.

( 2 ) This Article applies to ( a ) th e States;

( b ) t h e Committee, any member of the Committee, or any person who is, or is acting as, an

officer, servant or agent of the Committee or performing any duty or exercising any power on behalf of the Committee; and

( c ) th e Commission, any Commissioner or any person who is, or is acting as, an officer, servant

or agent of the Commission or who is a person appointed by the Commission to conduct an investigation under Article  30 or who is performing any duty or exercising any power on behalf of the Commission.".

Article 6 was adopted, the States having accepted amendments of the Finance and Economics Committee that in paragraph (2) –

fo r c l ause  (ii) of sub-paragraph  (a) there should be substituted the following clause

" ( ii ) s u b ject to such conditions or restrictions as may be prescribed, any other prescribed person or institution;"; and

fo r s u b-paragraph  (b) there should be substituted the following sub-paragraph –

" ( b ) s u b j ect to such conditions or restrictions as may be prescribed, any prescribed transaction.".

Article 7 was adopted, the States having accepted amendments of the Finance and Economics Committee that – in p a ragraph (1) for the word "Committee" there should be substituted the word "Commission";

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Investment Business (Jersey) Law 199  .

Bellozanne sewage treatment works upgrade – P.93/98.

THE STATES, adopting a proposition of the Public Services Committee

( a) approved drawing No.  97011-0-321A showing the proposed upgrade of the Bellozanne Treatment

Works, St.  Helier, as detailed in the report dated 6th April 1998 of the Public Services Committee, and authorised the Greffier of the States to sign the said drawing on behalf of the States;

(b  ) authorised the Public Services Committee to enter into a Partnering Agreement, as detailed in the

report dated 6th April 1998, of the Public Services Committee, for the construction of the works, with the selected contractors, Degremont UK Limited and M.J. Gleeson Group PLC, on the basis of the Actual Target Cost and Share Mechanism, with the Agreement being underpinned' by a formal Contract, and authorised the Greffier of the States to sign the said Agreement and Contract on behalf of the States.

Church of England: ordination of women measures – P.105/98

THE STATES, adopting a proposition of the Legislation Committee, requested the Bailiff to inform the Secretary of State that it is the wish of the Assembly that the draft Women Priests (Channel Islands) Order 1998, which would have the effect of applying to Jersey the Priests (Ordination of Women) Measure 1993 and the Ordination of Women (Financial Provisions) Measure 1993, be applied to Jersey.
