Machinery of Government Reform: composition and election of the States Assembly – P.151/2004 Amendments & Comments

THE STATES resumed consideration of a proposition of the Special Committee on the Composition and Election of the States Assembly concerning Machinery of Government Reform: composition and election of the States Assembly, and of an amendment of the Deputy of St. Ouen that paragraph (a)(iii) be deleted, and in paragraph (a)(iv), there be deleted all the words after the words"a new category of States member" and be substituted with the words "with 35 such members being elected in the 12 Parishes in the following numbers, thereby making a total of 47 States members including the Parish Connétable s –

St. Helier 12 St. 2

Lawrence

St. Peter 2 St. Brelade 4 St. Ouen 1 St. Mary 1 St. John 1 Trinity 1 St. Martin 1 Grouville 2 St. Saviour 5 St. Clement 3",

and, after paragraph (a), there be inserted the following new paragraph, and renumbered accordingly –

" ( b)  to agree that no elections for Senator should take place in October 2005, and that the membership of the States should be reduced to 47 with effect from December 2005, when the term of office of 6 Senators expires.".

THE STATES rejected the amendment of the Deputy of St. Ouen that paragraph (a)(iii) be deleted, and in paragraph (a)(iv), there be deleted all the words after the words"a new category of States member" and be substituted by the words "with 35 such members being elected in the 12 Parishes in the following numbers, thereby making a total of 47 States members including the Parish Connétable s –

THE STATES granted leave to Deputy Maurice François Dubras of St. Lawrence to withdraw an amendment, (P.151/2004 Amd.(2) lodged "au Greffe" on 12th October 2004), that in paragraph (a)(iv), for the number "47", there be substituted the number "37" and for the table showing the number of members for each of the 6 constituencies, there be substituted the following table –

THE STATES noted that, consequential to the withdrawal of the amendment by the Deputy of St. Martin, a further amendment by Deputy Maurice François Dubras of St. Lawrence, (P.151/2004 Amd.Amd. lodged"au Greffe" on 12th October 2004), that for the word "Senator", there be substituted the word " Deputy ", was deemed to have been withdrawn.

THE STATES noted that, consequential to the rejection of paragraph (a) in its entirety, paragraphs (b) and (c of the proposition requesting them to agree that the proposals in paragraphs (a) should be considered by the electorate in a referendum before they were implemented, and to charge the Privileges and Procedures Committee, in conjunction with other Committees as necessary, to take all necessary steps to implement the changes following the referendum and, in particular, to ensure that appropriate transitional arrangements were put in place to enable all of the proposals to come into effect no later than 2008, were deemed to have been withdrawn.

Shadow Public Accounts Committee: appointment of member – P.197/2004

THE STATES, adopting a proposition of Deputy Sarah Craig Ferguson of St. Brelade,referred to their Act dated 7th July 2004, in which they agreed that the composition of the Shadow Public Accounts Committee should be amended to include 2 additional States members, not being Presidents of Committees or members of the Finance and Economics Committee or Privileges and Procedures Committee, with the additional members being appointed by the States on the nomination of the Shadow Chairman of the Committee, and appointed Deputy Jacqueline Jeannette Huet of St. Helier as a member of the Shadow Public Account Committee for the period ending 27th January 2005.
