Les Pas settlement – question and answer (Tape No. 924)
Deputy Gerard Clifford Lemmens Baudains of St. Clement asked Senator Terence Augustine Le Sueur, Vice- President of the Policy and Resources Committee, the following question –
" Wi th reference to the claim by Les Pas Holdings Limited, will the President inform members –
(a ) at what stage, if any, did the Les Pas claim include La Collette power station land and was this
accepted as valid during any stage of the negotiations? and,
(b ) w hether the Committee is intending to make a claim for compensation against the legal firm
which represented the States in the legal action brought by Les Pas Holdings Limited?"
The Vice-President of the Policy and Resources Committee replied as follows –
" ( a) The claim made by Les Pas included part of the site of the La Collette power station land from the start. It did not cover the entire site, but referred to those parts of the site which were artificially reclaimed in the 1960s and 1970s. If the part of the Power Station which was on land claimed by Les Pas had been lost, and it had become necessary to buy it back, whether by negotiation or by compulsory purchase, the compensation would have reflected not just the value of the part which Les Pas had acquired considered as an isolated site, but also the marriage value, that is, the value to the part which Les Pas had not acquired of reuniting it with the part which had been lost.
N ei t he r this nor any part of the Les Pas claim was accepted at any stage of the negotiations.
( b ) The Policy and Resources Committee does not intend to make a claim against the legal firm which
represented the States. A client can only make a claim against his legal adviser if the legal adviser has been guilty of professional negligence which has resulted in loss or damage to the client, and there is no basis upon which such an action could be brought."
Costs relating to the Bus Service Tendering Process: Committee of Inquiry – questions and answers (Tape No. 924)
The Deputy of St. John asked Senator Terence Augustine Le Sueur, President of the Finance and Economic Committee, the following question –
" 1. The Policy and Resources Committee has stated in P.99/2004 that it believes that the President of the proposed Committee of Inquiry on the Bus Tendering Process should be paid at the same rate as a Royal Court Commissioner, i.e. at £686 a day.
A s the States of Jersey Law states that the Finance and Economics Committee may direct to what
extent a person appointed to a Committee of Inquiry may be remunerated would the President advise members how the other members of the Committee of Inquiry are to be remunerated as the proposition states that they will be paid at a rate to be agreed'.
2. I f the Committee of Inquiry concludes that there were failings on the part of the States members who agreed that Connex should become the bus operator will the Committee consider seeking to recover
the cost of the Committee of Inquiry from those members rather than meeting the cost from general revenues?" The President of the Finance and Economics Committee replied as follows –
" 1. The Finance and Economics Committee has agreed that the two other members of the Committee of Inquiry be remunerated at a rate of half that of the chairman, namely £343 per day.
2. I t is impossible to give a definitive answer to a hypothetical question of this nature because the Committee cannot consider whether any action is appropriate until the Committee of Inquiry, if appointed, has delivered its report. However, it is doubtful whether it is legally possible for the Committee to seek such recovery."

Deputy Maurice François Dubras of St. Lawrence asked the following question of Deputy Francis Gerald Voisin, President of the Economic Development Committee –
" G iven the historic and cultural significance of the 1204-2004 celebrations, is the President satisfied with the efforts of Jersey Tourism and the industry at large in attracting extra visitors to the Island this summer?"
Senator Edward Philip Vibert asked the following question of Deputy Francis Gerald Voisin, President of the Economic Development Committee –
" Wi l l the President inform members of the number of gaming machines installed in bookmakers' premises as well as their average total weekly earnings?
Wou l d the President inform the members of the percentage pay-back of these machines, the maximum stake permitted and what controls are in place to ensure that the machines are operating fairly?"

Draft Community Provisions (Ship and Port Facility – Security) (Jersey) Regulations 200- P.90/2004
THE STATES, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996, and Article 49(1)(e) of the Shipping (Jersey) Law 2002, and, having regard to Regulation (EC) No. 725 of the European Parliament and Council of 31st March 2004, on enhancing ship and port security, made Regulations entitled the Community Provisions (Ship and Port Facility – Security) (Jersey) Regulations 2004.
Elizabeth Harbour Phase I Warehouse lease to Commodore Express (Jersey) Limited – P.54/2004 THE STATES, adopting a proposition of the Harbours and Airport Committee –
( a ) approved the leasing by the public to Commodore Express (Jersey) Limited of the northern half of the
Elizabeth Harbour Phase I Warehouse, lean-to annexe and outside working area, designated E27, E25B and E27A, for a period of 21 years commencing on 1st July 2004, to provide –
( i) an internal warehouse and lean-to annexe area of 10,427 square feet and 1,650 square feet
respectively along with the outside working area E27A measuring 20,372 square feet;
( ii ) the entire demise to continue in its present use in connection with the business of storage,
handling and transit of goods through the harbour;
(i ii ) t he rental for areas E27 and E25B at an annual total of £105,069.90 based on a rate of £8.70 per
square foot, subject to 5-yearly market review;
(i v ) t he rental for E27A at an annual sum of £10,186.00 based on a rate of £0.50 per square foot and
subject to review in line with the market on 1st September 2004, and 5-yearly thereafter;
( b ) authorised the Attorney General and the Greffier of the States to pass the necessary contracts on
behalf of the public; and,
( c ) authorised the Treasurer of the States to receive the rents as they became due.

Code of Practice on Public Access to Official Information: measures to improve implementation – P.80/2004
Comments
THE STATES, adopting a proposition of the Privileges and Procedures Committee, referred to their Act dated 26th July 1999, in which they adopted a Code of Practice on Public Access to Official information, and –
( a ) commencing three months after adoption by the States, amended the Code of Practice on Public
Access to Official Information as follows –
(i ) i n P art II, paragraph 2.1, after sub-paragraph (k) add the following sub-paragraph –
" ( l) und ertake the drafting of Committee and sub-committee agendas, agenda support papers and minutes so as to allow maximum disclosure;
(i i) i n P art II, insert a new paragraph 2.1.2 as follows –
" 2.1.2 An authority shall –
( a ) f or w ar d t o the States Greffe the names of strategic and/or policy reports
prepared by the authority after the date of adoption of this amendment, to be added to a central list to be called the Information Asset Register (the Register');
(b ) not withstanding paragraph 2.1.2 (a), the name of any report deemed to be of
public interest shall be included on the Register;
(c ) w h er e t he cos t of third party reports or consultancy documents, which have been
prepared for the authority or which are under preparation, exceeds an amount fixed from time to time by the Privileges and Procedures Committee, an authority shall forward to the States Greffe the names of such reports to be added to the Register, together with details of the cost of preparation and details of their status;
( d ) s u bj e ct to the exemptions of the Code, make available to the public all
unpublished third party reports or consultancy documents after a period of five years."
(i ii ) i n Part III, paragraph 3.1, after the number1.2.3' add the words and 2.1(k) and (l)'; (i v ) I n Part III, for paragraph 3.1(a) substitute the following paragraph –
" (a ) an aut hority shall grant access to all information in its possession, and Committees of the States, and their sub-committees, shall make available before each meeting their agendas, and supplementary agendas, and grant access to all supporting papers, ensuring as far as possible that agenda support papers are prepared in a form which excludes exempt information, and shall make available the minutes of their meetings,"; and,
( b ) requested the Greffier of the States to take the necessary steps to ensure that all matters recorded in
Part B of the minutes were properly exempt from disclosure in accordance with the provisions of the Code.

THE STATES, adopting a proposition of the Education, Sport and Culture Committee –
( a ) approved the passing of a Deed of Arrangement between the Public as owner of D'Hautrée School,
St. Saviour, and Ceralbi Limited as owner of D'Hautrée Gardens, abrogating the covenant which currently existed in favour of D'Hautrée School restricting development on D'Hautrée Gardens, for a consideration of £90,000 with each party to bear its respective costs;
( b ) authorised the Greffier of the States to sign the said drawing and authorised the Attorney General and
the Greffier of the States to pass, on behalf of the public, and contracts or agreements as might be necessary; and,

Jersey Community Relations Trust: appointment of Chairman and a Trustee – P.87/2004 Amendment
THE STATES commenced consideration of a proposition of the Policy and Resources Committee requesting them, in pursuance of paragraph 5.1 of the Constitution of the Jersey Community Relations Trust, to appoint –
( a ) the Rev. Lewis William Matthews as the Chairman of the Jersey Community Relations Trust; and, ( b ) Senator Philip Francis Cyril Ozouf as a Trustee of the Jersey Community Relations Trust;
for a period of three years from the date of appointment, and adopted an amendment of Senator Edward Philip Vibert that for sub paragraph (b) there be substituted with the following sub paragraph –
" ( b) following a ballot, as a Trustee of the Jersey Community Relations Trust, either
(i ) S ena tor Philip Francis Cyril Ozouf ; or
(i i) D e puty Geoffrey Peter Southern of St. Helier."
THE STATES, having adopted the proposition, as amended, of the Policy and Resources Committee, thereupon proceeded to a secret ballot, following which the Bailiff declared the following result –
