THE STATES resumed consideration of the draft Standing Orders of the States of Jersey and noted that Standing Order 97 had been withdrawn by the Privileges and Procedures Committee.

THE STATES commenced consideration of Standing Order 105 and adopted an amendment of Senator Stuart Syvret that in paragraph  (2)(h), there be deleted the words"comment upon or".

THE STATES commenced consideration of Standing Order 107 and rejected an amendment of Senator Stuart Syvret that after paragraph  (1), there be inserted the following paragraphs and that the remaining paragraphs be renumbered accordingly

" ( 2)  When a member of the States makes a declaration of an interest in the subject matter of a proposition, but is not required by paragraph (1) to withdraw, another member of the States may propose without notice that the interest declared is of sufficient relevance to the subject matter of the proposition that the

member be required to withdraw from the Chamber for the duration of the debate and any vote on the proposition.

( 3 ) The member of the States who made the declaration may speak again before the proposer replies at the

conclusion of the debate upon the proposal.".

THE STATES adopted Standing Order 115, as amended by the Privileges and Procedures Committee that – ( a ) In paragraph (1) after the words"nomination of" insert the words "an elected member as";

( b ) after paragraph  (2) insert the following paragraph –

"( 3 ) In this standing order "elected member"

(a ) in c l u d es a person who has been elected as a Senator, Deputy or Connétable , but who has not

yet taken his or her oath of office; and

(b ) d o es n ot include a Senator, Deputy or Connétable whose term of office expires upon a person

mentioned in sub-paragraph  (a) taking his or her oath of office."

THE STATES adopted Standing Order 116, as amended by the Privileges and Procedures Committee that in paragraph (5) for the word"20", there be substituted the word "40".

THE STATES commenced consideration of Standing Order 117, and adopted an amendment of Senator Stuart Syvret that Standing Order 117 be renumbered as Standing Order 118 and vice versa.

THE STATES adopted Standing Order 117, as amended.

THE STATES adopted Standing Order 118, as amended by the Privileges and Procedures Committee that for paragraphs (5) and (6), there be substituted the following paragraphs

" (5 )      If more than one person is nominated, the presiding officer shall then, according to the order in which the candidates were nominated, invite each candidate to speak for up to 10  minutes.

( 6 ) After a candidate has spoken, the presiding officer shall allow up to 20  minutes for elected

members to question the candidate.

( 7 ) W hile a candidate is speaking or being questioned, other candidates must withdraw from the

Chamber to a place where they cannot hear the proceedings in it.

(8 ) W hen the speeches and questions are concluded, a secret ballot shall be held.

( 9 ) T he candidate who receives more than half of the votes cast is selected for appointment and

assignment to the Ministerial office proposed.",

and that the remaining paragraphs in Standing Order 118 be renumbered and the cross-reference in them accordingly.

THE STATES commenced consideration of Standing Order 151 and granted leave to Senator Stuart Syvret to withdraw an amendment of Senator Stuart Syvret that in the heading, there be deleted the words "Elected members'", and for the words "an elected member" in each place where they appeared, there be substituted the words "a member of the States", and for the words "the elected member", there be substituted the words "the member of the States".

THE STATES adopted Standing Order 152, having granted leave to Senator Stuart Syvret to withdraw an amendment that –

( a ) after paragraph  (1), there be inserted the following paragraph

" (2 ) A member of the States who is not an elected member must, not less than 30 days after the day the day on which this standing order comes into force and, after that, not less than 30  days after the day on which he or she is appointed to the office by virtue of which he or she is a member of the States, complete a return of his or her interests that must be registered and submit it to the Greffier.";

( b ) for the words "An elected member" in paragraphs (2) to (5), there be substituted the words "A member

of the States";

and the paragraphs in Standing Order 152 be renumbered accordingly.

THE STATES adopted Standing Order 153, as amended by the Privileges and Procedures Committee that paragraph (3) be deleted, having granted leave to Senator Stuart Syvret to withdraw an amendment that in paragraph (1) for the words"elected members", there be substituted the words "members of the States".

THE STATES adopted Standing Orders 154 to 160 together with Schedules 1 and 3.

THE STATES adopted Standing Order 161, as amended by the Privileges and Procedures Committee that – ( a ) for paragraph  (3), there be substituted the following paragraph –

" ( 3) The Minister for Treasury and Resources must, at least 15 working days before any binding arrangement is made for the disposal, acquisition, letting or rental of land on behalf of the public of Jersey which does not, by virtue of paragraph  (2), require the prior agreement of the States, present to the States a document setting out the recommendation which he or she has accepted.";

( b ) after paragraph  (3), there be inserted the following paragraph –

" ( 4 )     Nothing in this standing order requires the States to agree, or the Minister for Treasury and

Resources to accept or present to the States any information regarding, the grant, renewal, extension or variation

of a tenancy that is terminable upon giving one month's notice or less."

THE STATES granted leave to Senator Stuart Syvret to withdraw an amendment that after sub-paragraph  (4), there be added the following sub-paragraph

" ( 5)  A member of the States who is not an elected member is not required to register remuneration which he or she receives in respect of the office by virtue of which he or she is a member of the States.".

" ( 3)  For the purposes of this paragraph, a person owns shares if he or she owns them in his or her own name or if the shares are held, on his or her behalf, or for his or her benefit, by any other person.".

" 4  Financial and other support

(1 ) A n elected member must register the name and address of any person, company, trust, professional

association, union, political party or other organisation who gives him or her money or any other benefit for the purpose of enabling the member to remain as, or carry out his or her duties as an elected member.

(2 ) P aragraph  (1) does not apply to any money or benefit given to an elected member pursuant to any

enactment or to any remuneration that the elected member is not required to register.

(3 ) W hen registering the name and address of the person or organisation giving the money or benefit,

the member of the States must state the amount of any money given and the monetary value of any benefit given.".

(1 ) A n elected member must register the name and address of any trust of which he or she or his or

her spouse or cohabitee, is a beneficiary.

( 2 ) W hen registering the name and address of the trust, the elected member must provide a brief

description of any benefit received from the trust.

( 3 ) A n elected member is not required to declare the name and address of any trust of which the

member is a beneficiary of which the member is not aware.".

THE STATES noted that, consequential to the rejection of the above amendment of Senator Stuart Syvret to paragraph 6 of Schedule 2, his amendment to Standing Order 151 that, at thebeginning of paragraph (3), there be inserted the words "Save as specified in Schedule 2,", was deemed to have been withdrawn.

THE STATES commenced consideration of paragraph  7 of Schedule  2 and granted leave to Senator Stuart Syvre to withdraw his amendment that for sub-paragraph  (1), there be substituted the following sub-paragraphs and the remaining paragraphs be renumbered accordingly

" ( 1) An elected member must register a description of any land sufficient to identify it, which is wholly owned, or jointly owned with another person

(a ) b y or on behalf of the elected member or his or her spouse or cohabitee; or

(b ) b y or on behalf of the elected member and his or her spouse or cohabitee jointly.

( 2 ) No declaration is required in respect of land so owned which is the principal place of residence of the

elected member or of his or her spouse or cohabitee.".

THE STATES granted leave to Senator Stuart Syvret to withdraw his amendment that after sub-paragraph  (2), there be added the following sub-paragraph

" ( 3) An elected member must register a brief description of any land sufficient to identify it, in which he or she, or his or her spouse or cohabitee, has any legal, prospective, usufructuary, equitable or beneficial interest which is not otherwise to be required to be registered under this paragraph, apart from any such interest in land which is the principal place of residence of the elected member or of his or her spouse or cohabitee.".

THE STATES adopted paragraph 7 of Schedule 2, as amended by the Privileges and Procedures Committee tha in paragraph 7(2), there be inserted the words"spouse or" before the word "cohabitee".

The Bailiff retired from the Chair following members voting on the amendment of Senator Stuart Syvret to Standing Order 107 of the draft Standing Orders of the States of Jersey, (P.162/2005 lodged "au Greffe" on 9th August 2005), and the meeting continued under the presidency of Mr. Michael Nelson de la Haye, Greffier of th States.

The Deputy Bailiff assumed the presidency from Mr. Michael Nelson de la Haye, Greffier of the States, during consideration of Standing Order 107 of the draft Standing Orders of the States of Jersey, (P.162/2005 lodged "au Greffe" on 9th August 2005), and the meeting continued under his presidency.

The Deputy Bailiff retired from the Chair during consideration of the amendment of Senator Stuart Syvret to Standing Order 112 of the draft Standing Orders of the States of Jersey, (P.162/2005 lodged "au Greffe" on 9th August 2005), and the meeting continued under the presidency of Mr. Michael Nelson de la Haye, Greffier of th States.
