Draft Employment Tribunal (Amendment) (Jersey) Regulations 200- P.135/2006 Amendment

THE STATES commenced consideration of the Draft Employment Tribunal (Amendment) (Jersey) Regulations 200- and adopted the principles.

Regulations 1 to 6 were adopted, the States having adopted amendments of the Minister for Social Security that, in Regulation 6, for paragraph (3) there be substituted the following paragraphs –

"(3) Regulation 5 shall be taken to have come into force on 1st November 2006. (4) Regulations 2 and 3 shall come into force 7 days after these Regulations are made."

THE STATES, in pursuance of Articles 2, 6 and 8 of the Sea Fisheries (Jersey) Law 1994, and having consulted the Secretary of State and obtained his concurrence, made Regulations entitled the Sea Fisheries (Minimum Size Limits) (Amendment No. 3) (Jersey) Regulations 2007.

Draft Sea Fisheries (Log Books and Landing Declarations) (Jersey) Regulations 200- P.149/2006

THE STATES, in pursuance of Articles 2, 8 and 29 of the Sea Fisheries (Jersey) Law 1994, and having consulted with the Secretary of States and obtained the Secretary of State's concurrence, made Regulations entitled the Sea Fisheries (Log Books and Landing Declarations) (Jersey) Regulations 2007.

Fulfilment Industry Policy – P.152/2006 Comments

THE STATES commenced consideration of a proposition of the Economic Affairs Scrutiny Panel concerning Fulfilment Industry Policy.

Deputy Geoffrey Peter Southern of St. Helier, Chairman of the Economic Affairs Scrutiny Panel, proposed an amendment that, in paragraph (b), for the date"30th April 2007" there be substituted the date "31st December 2007". The States agreed to reduce the minimum lodging period in accordance with Standing Order 26(8) to enable it to be debated immediately. The amendment was adopted.

After discussion the States agreed that the Economic Affairs Scrutiny Panel be permitted to withdraw paragraph (a)(iii) of the proposition.

THE STATES, adopting a proposition of the Economic Affairs Scrutiny Panel, as amended – (a ) agr eed to request the Minister for Economic Development –

( i) t o cent ralise policy regarding the fulfilment industry under a dedicated post for e-

commerce to offer more direct political support for the industry and promote diversification through the growing e-commerce sector;

(i i) t o und ertake a further review of the fulfilment industry, in order to obtain a fuller and

more comprehensive understanding of its current and potential rôle in the Island's economy; and

( b ) a gr eed to request the Chief Minister, following consultation as appropriate with other

Ministers and the Attorney General, to review the current mechanisms across all ministerial departments for appeals against ministerial decisions under statutory powers, and the mechanisms to deal with requests for reconsideration of such decisions, and to establish a code of practice in respect of such appeals and requests for reconsideration to ensure that they were just and fair, and to bring the code to the Assembly for approval by 31st December 2007.

Draft Planning and Building (Amendment No. 4) (Jersey) Law 200- P .157/2006 Amendment

THE STATES commenced consideration of the Draft Planning and Building (Amendment No. 4) (Jersey) Law 200-, and adopted the principles.

Article 1 was adopted.

THE STATES commenced consideration of Article 2 and adopted an amendment of Senator Leonard Norman that in the proposed new Article 9(3), for proposed sub-paragraph (b), there be substituted the following sub- paragraph –

"(b) if the applicant is not the owner of the land to be developed, a certificate by the owner of the

land certifying that the owner approves the application being made.".

THE STATES adopted an amendment of the Minister for Planning and Environment to Article 2 that in the proposed new Article 9, after paragraph (3), there be inserted the following paragraph –

"(4) Whe re –

  1. par agraph (3)(b) applies in respect of a proposed application; and
  2. the owner of the land refuses or is unable, for any reason, to certify his or her approval of the application being made,

the Minister may nevertheless accept the application for consideration if the Minister is satisfied that to do so would be in the public interest."

and t he subsequent paragraphs be renumbered accordingly." Article 2 as amended was adopted.

Articles 3 to 5 were adopted.
