THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 3.

Social Security Fund: research into alternative funding mechanisms P.153/2009

THE STATES, adopting a proposition of Deputy Geoffrey Peter Southern of St. Helier , agreed to refer to their Act dated 10th June 2009 in which they approved the States Strategic Plan 2009 – 2014 and, in the light of Strategic Priorities 1, 4 and 6 of that Plan –

  1. requested the Chief Minister to re-prioritise the Policy budget of the Chief Minister's Department to enable funding to be made available to the Minister for Social Security to research mechanisms to eliminate the need for supplementation of social security funding from general revenues;
  2. requested the Minister for Social Security to report back to the States as a matter of urgency, and in any case no later than September 2010, with the results of the research and recommendations, including analysis of the mechanisms outlined in the Appendix to the attached report; and
  3. requested the Minister for Social Security to bring forward for approval the necessary legislation to give effect to any proposals arising from the research and recommendations to enable any amendments to the current system to be in place no later than January 2012.

Channel Islands Lottery: allocation of profits for 2009 – 2010 P.155/2009

THE STATES, adopting a proposition of the Minister for Economic Development, agreed, in accordance with the provisions of Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, that all monies standing to the credit of the Channel Islands Lottery (Jersey) Fund which had not already been set aside by the Minister (representing 90% of the total Jersey portion of the profits of the Channel Islands Lottery from 2009 and 2010) should be paid to the Association of Jersey Charities for the benefit of the community and the charitable needs of the Island.

Ratification of the Agreement for the Exchange of Information with Respect to Taxes between the States of Jersey and the Government of Australia P.160/2009

THE STATES, adopting a proposition of the Chief Minister, agreed to ratify the agreement for the exchange of information with respect to taxes between the States of Jersey and Australia as set out in the Appendix to the report of the Chief Minister dated 5th August 2009.

Draft Taxation (Exchange of Information with Third Countries) (Amendment No. 4) (Jersey) Regulations 200- P.162/2009

THE STATES commenced consideration of the Draft Taxation (Exchange of Information with Third Countries) (Amendment No. 4) (Jersey) Regulations 200- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 and 2.

THE STATES, in pursuance of Article 2(1) of the Taxation (Implementation) (Jersey) Law 2004 and paragraph 1.8.5 of the Strategic Plan 2006 to 2011 approved by the States on 27th June 2006 and following the decision of the States, taken on the day these Regulations were made, to adopt Projet 160 of 2009 and Projet 161 of 2009, made Regulations entitled the Taxation (Exchange of Information with Third Countries) (Amendment No. 4) (Jersey) Regulations 2009.

Employment of States of Jersey Employees Law – proposed changes P.175/2009

THE STATES commenced consideration of a proposition of the Deputy of St. Martin concerning proposed changes to the Employment of States of Jersey Employees Law. The States, in accordance with Standing Order 26(8), agreed to reduce the lodging period of an amendment to the amendment of the Chief Minister, so that his amendment to paragraph (a)(i) of the proposition read as follows –

that in sub-paragraph (a)(i), for the words "one other Minister" there should be substituted the words "2 other Ministers or Assistant Ministers",

and agreed that the remainder of the amendment (for the words "and 2 elected members of the States who are neither Ministers nor Assistant Ministers elected by the States." substitute the words "and 2 elected members of the States, who are not Ministers, to be nominated by the Chief Minister.") should be disregarded.

THE STATES, adopting an amendment of the Chief Minister, as amended, agreed that in sub- paragraph (a)(i), for the words "one other Minister" there should be substituted the words "2 other Ministers or Assistant Ministers".
