Deputy Geoffrey Peter Southern of St. Helier asked the following question of the Chief Minister which the Bailiff had allowed in accordance with Standing Order 15 relating to urgent oral questions –
"In light of the assurance from the Minister for Treasury and Resources that Jersey only had a minor issue with deemed distribution' in relation to the Island's compliance with the EU Code of Conduct on Business Taxation and that the EU decision awaited a further meeting in February, what response does the Chief Minister have to the statement from HM Treasury, following a meeting with ECOFIN Ministers, that states that ECOFIN noted the view of the Business Taxation Group that Jersey's zero/10 corporate tax regime gave rise to harmful effects and was not compliant with the Code and that the UK Government therefore expects Jersey to abide by commitments to comply with the Code and implement the abolition of the harmful measures?"

THE STATES, having resumed consideration of the of the Expenditure Proposals for 2012 and 2013 and Draft Budget Statement 2011 (P.157/2010), commenced consideration of an amendment of the Deputy of Grouville to paragraph (b) of the Expenditure Proposals for 2012 and 2013 and Draft Budget Statement 2011 (P.157/2010) and adopting a proposition of the Minister for Treasury and Resources, agreed that, in accordance with the provisions of Article 20(3) of the Public Finances (Jersey) Law 2005, an amendment of the Minister for Treasury and Resources could be debated at the present meeting –

THE STATES, adopting an amendment of the Minister for Treasury and Resources to the amendment of the Deputy of Grouville to the Expenditure Proposals for 2012 and 2013 and Draft Budget Statement 2011 (P.157/2010), agreed that the substituted paragraph (c), for the words "an equivalent amount of tax" there should be substituted the word "additional"; for the words "in relation to the profits of" there should be substituted the words "from certain"; for the words "through the mechanisms in place in relation to the profits of similar" there should be substituted the word "from"; and after the words "1st January 2012" there should be inserted the words "provided that to do so would not jeopardise the integrity of Jersey's business tax regime or its international competitive position".

THE STATES resumed consideration of an amendment of the Deputy of Grouville to paragraph (b) of the Expenditure Proposals for 2012 and 2013 and Draft Budget Statement 2011 (P.157/2010), as amended and agreed that after paragraph (b) there should be inserted a new paragraph (c) as follows –
"(c) to agree that a new mechanism should be put in place to ensure that additional revenue is raised from certain non-locally owned non-finance companies trading in Jersey as is raised from similar locally owned companies trading in the Island, and to request the Minister for Treasury and Resources to bring forward for approval the necessary legislation to give effect to this decision so that the new system can be
fully implemented by 1st January 2012 provided that to do so would not jeopardise the integrity of Jersey's business tax regime or its international competitive position;"
and the remaining paragraphs renumbered accordingly.

THE STATES, adopting paragraphs (b), (c), (d) and (e) of the Expenditure Proposals for 2012 and 2013 and Draft Budget Statement 2011 (P.157/2010), as amended, agreed –
- to approve the estimate of total taxation revenue in 2011 of £521,319,000 as set out in Summary Table B on page 74 of the Budget Statement, with the sum to be raised through existing taxation measures and the proposed changes to income tax, goods and services tax, impôts duty, stamp duty and land transactions tax for 2011 as set out in the Budget Statement;
- that a new mechanism should be put in place to ensure that an additional revenue was raised from certain non-locally owned non-finance companies trading inJersey as was raised from similar locally owned companies trading in the Island, and to request the Minister for Treasury and Resources to bring forward for approval the necessary legislation to give effect to this decision so that the new system could be fully implemented by 1st January 2012 provided that to do so would not jeopardise the integrity of Jersey's business tax regime or its international competitive position;
- that the sum of £31,000,000 be transferred from the Stabilisation Fund to the Consolidated Fund in 2010, in addition to the amount of £37,000,000 agreed on 19th December 2009 in P.179/2009, resulting in a total transfer of £68,000,000;
- that the sum of £46,000,000 be transferred from the Stabilisation Fund to the Consolidated Fund in 2011.

THE STATES commenced consideration of the Draft Income Tax (Amendment No. 37) (Jersey) Law 201- and adopted the principles.
THE STATES adopted Article 1.
THE STATES, adopting an amendment of the Minister for Treasury and Resources, agreed that for Article 2 there should be substituted the following Article –
"2 Article 16 amended
After Article 16(4) there shall be inserted the following paragraph –
(4A) A person required by a general or particular notice to deliver a statement and who is
chargeable, for the period specified in the notice, under Case VIII of Schedule D on deemed dividends of a company or under Article 85F on the profits of a company, shall furnish in support of the statement –
- the person's computation of –
- in the case of a person chargeable under Case VIII of Schedule D, the relevant profits of the company, as defined in Article 81B, and the person's income chargeable under that Case in respect of the company, or
- in the case of a person chargeable under Article 85F, the relevant profits of the company, as defined in that Article, and the person's portion of the relevant profits; and
- a copy of the company's accounts for each financial period by reference to which the computation is made.'."
and that for Article 3 there should be substituted the following Article –
"3 Article 17A amended
In Article 17A –
- in paragraph (1) for the words described in Article 16' there shall be substituted the words or return';
- for paragraph (2) there shall be substituted the following paragraph –
(2) In this Article specified time' means in relation to a requirement to deliver a
statement or return in respect of a year of assessment that is imposed by a notice served in the following year –
- in the case of a statement delivered on behalf of a person by another person whose business or profession includes the preparation of such statements and in the course of that other person's business or profession, 6 p.m. on the last Friday inJulyin the year in which the notice is served;
- in the case of a statement delivered by a company in respect of its own charge to tax, 6 p.m. on the last Friday inJulyin the year in which the notice is served;
- in the case of a return, 6 p.m. on the last Friday inJulyin the year in which the notice is served;
- in any other case, 6 p.m. on the last Friday in May in the year in which the notice is served.';
(c) for paragraph (3) there shall be substituted the following paragraph – (3) Paragraph (1) shall not apply –
- to an individual who is not liable to pay any tax for the period to which the statement relates; or
- where the notice is served less than 30 days before the day on which the specified time applicable in the person's case expires.';
- in paragraph (4) –
- for the words a person' there shall be substituted the words an individual',
- in sub-paragraph (a) for the words the person's' there shall be substituted the words the individual's',
- in sub-paragraph (b) for the words the person' in each place that they appear, there shall be substituted the words the individual';
- in paragraph (7)(a) after the words a statement' there shall be inserted the words or return';
- in paragraph (7)(b) after the words the statement' there shall be inserted the words or return';
- after paragraph (12) there shall be added the following paragraph – (12A) In this Article –
return' means a return required under Article 20B;
statement' means a statement required under Article 16.'."

THE STATES commenced consideration of the Draft Community Provisions (Mortality in Oysters) (Amendment) (Jersey) Regulations 201- and adopted the principles.
THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 and 2.
THE STATES, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996, made Regulations entitled the Community Provisions (Mortality in Oysters) (Amendment) (Jersey) Regulations 2010.
