Jersey Financial Services Commission: re-appointment of Commissioner and Chairman P.129/2010

THE STATES commenced consideration of a proposition of the Minister for Economic Development concerning the re-appointment of a Commissioner and Chairman of the Jersey Financial Services Commission.

The Deputy Bailiff , in accordance with the provisions of Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate in camera, proceeded to vote in public assembly and, in pursuance of Article 3(2)(a) of the Financial Services Commission (Jersey) Law 1998, re-appointed Mr. Clive Stanley Jones as a Commissioner of the Jersey Financial Services Commission with effect from 23rd October 2010 for a period of 3 years and, in pursuance of Article 3(2)(b) of the Financial Services Commission (Jersey) Law 1998, re-appointed Mr. Clive Stanley Jones as Chairman of the Jersey Financial Services Commission.

THE STATES noted that, in accordance with the provisions of Standing Order 106(1)(a), Senator Ben Edward Shenton declared an interest and withdrew from the Chamber for the duration of the debate. In accordance with Standing Order 106(1)(b) the Connétable of St. Mary and Deputy Ian Joseph Gorst of St. Clement both declared an interest not being of a direct financial nature, and the Connétable of St. Mary withdrew from the Chamber, whilst Deputy Gorst remained.

THE STATES noted that, as there was an equality of votes, the matter had been determined in the negative in accordance with Article 16(2) of the States of Jersey Law 2005.

Property and Infrastructure Regeneration: the States of Jersey Development Company Limited P.73/2010

THE STATES commenced consideration of a proposition of the Council of Ministers concerning the establishment  of  the  States  of  Jersey  Development  Company  Limited  and,  adopting  part 1  of  an amendment of Senator Ben Edward Shenton, agreed that in paragraph (a) after the words "as set out in paragraphs 3–12 of the Report of the Council of Ministers dated 7th June 2010" there should be inserted the words –

"except  that  in  paragraph 7  (Regeneration  Steering  Group),  in  the  section  headed Composition' on page 11, for the words "The Connétable of St. Helier " substitute the words "A member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy )".

THE STATES resumed consideration of the proposition of the Council of Ministers, as amended –

  1. to approve the proposals and structure of the new Property and Infrastructure Regeneration process as set out in paragraphs 3–12 of the Report of the Council of Ministers dated 7th June 2010, except that in paragraph 7 (Regeneration Steering Group), in the section headed Composition' on page 11, for the words "The Connétable of St. Helier " there should be substituted the words "A member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy );
  2. to approve the new Memorandum and Articles of Association of The States of Jersey Development Company Limited as set out in Appendix 2 to the said Report which fundamentally reforms the role and remit of the Waterfront Enterprise Board Limited in accordance with the arrangements set out in the said Report; and
  1. to authorise the Greffier of the States for and on behalf of the States of Jerseyto pass, together with the Treasurer of the States, one or more special resolutions of the Company to adopt such Memorandum and Articles of Association.

The Deputy Bailiff briefly retired from the Chamber during consideration of Senator Ben Edward Shenton's amendments to the proposition of the Council of Ministers entitled Property and Infrastructure Regeneration: the States of Jersey Development Company Limited' (P.73/2010) and the meeting continued under the presidency of Mr. Michael Nelson de la Haye, Greffier of the States until his return.
