Property and Infrastructure Regeneration: the States of Jersey Development Company Limited P.73/2010

THE STATES resumed consideration of a proposition of the Council of Ministers, as amended, concerning the establishment of the States of Jersey Development Company Limited.

THE STATES, adopting the proposition of the Council of Ministers, as amended –

  1. approved the proposals and structure of the new Property and Infrastructure Regeneration process as set out in paragraphs 3–12 of the Report of the Council of Ministers dated 7th June 2010, except that in paragraph 7 (Regeneration Steering Group), in the section headed Composition' on page 11, for the words "The Connétable of St. Helier " there should be substituted the words "A member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy );
  2. approved the new Memorandum and Articles of Association of The States of Jersey Development Company Limited as set out in Appendix 2 to the said Report which fundamentally reformed the role and remit of the Waterfront Enterprise Board Limited in accordance with the arrangements set out in the said Report; and
  3. authorised the Greffier of the States for and on behalf of the States of Jerseyto pass, together with the Treasurer of the States, one or more special resolutions of the Company to adopt such Memorandum and Articles of Association.

Composition of the States: Spring Election and move to 4 year term of office P.118/2010

THE STATES commenced consideration of a proposition of the Privileges and Procedures Committee concerning a move to a Spring election and four year terms of office for all members and rejected an amendment of the Deputy of St. Mary that –

in paragraph (a) the word "Senators" should be deleted;

in paragraph (b) the word "6" should be deleted and for the words "that will become vacant in 2014" there should be substituted the words "referred to at sub-paragraphs (c)(i), (c)(ii) and (c)(iii) below," and the word "common" should be deleted;

in paragraph (c) for the words "the number of Senators should be reduced from 12 to 8 over time and that this" there should be substituted the words "the election for Senators";

in paragraph (c)(i) for the words "4 Senators" there should be substituted the words "2 Senators" and for the words "3½ years" there should be substituted the words "4½ years", and for the words "from 53 to 51" there should be substituted the words "from 53 to 49", and after the words "thereby reducing" there should be inserted the words "for one year";

in paragraph (c) there should be inserted a new sub paragraph (c)(ii) –

"(ii) electing a further 4 Senators for a period of 4½ years in an election for

Senators in October 2012 (thereby restoring the total number of elected members of the Assembly in that year from 49 to 53);"

paragraph (c)(ii) should be renumbered as sub-paragraph (c)(iii), and for the words "4½ years" there should be substituted the words "3½ years", and for the words "from 51 to 49" there should be substituted the words "from 53 to 51".

sub-paragraphs (c)(iii) and (c)(iv) should be deleted and the following new sub-paragraphs inserted –

"(c)(iv) electing 4 Senators for a period of 4 years in an election for Senators in May

2016 (thereby restoring the total number of elected members of the Assembly in that year to 53);

(c)(v)  electing 4 Senators for a period of 4 years in an election for Senators in May 2017 (the number of elected members remaining unchanged);

(c)(vi)  electing 4 Senators for a period of 4 years in an election for Senators in May 2018 (the number of elected members remaining unchanged);

(c)(vii) thereafter electing 4 Senators for a period of 4 years in elections for Senators in May of each year other than the years in which the elections for Deputies and Connétable s are held;".

THE STATES rejected an amendment of Deputy Trevor Mark Pitman of St. Helier that in paragraph (c) for the words "should be reduced from 12 to 8" there should be substituted the words "should be reduced from 12 to 6"; for the words "4 Senators" where they appeared in sub-paragraphs (i), (ii) and (iii) there should be substituted the words "3 Senators"; for the words "53 to 51" in sub-paragraph (i) there should be substituted the words "53 to 50" and for the words "51 to 49" in sub-paragraph (ii) there should be substituted the words "50 to 47"; and for the words "8 Senators" in sub-paragraph (iv) there should be substituted the words "6 Senators".

THE STATES resumed consideration of a proposition of the Privileges and Procedures Committee concerning a move to a Spring election and four year terms of office for all members.

THE STATES, adopting paragraphs (a) and (b) of the proposition of the Privileges and Procedures Committee –

  1. agreed that, from 2015, the single election day in each election year should be held in the Spring, and that all Senators, Connétable s and Deputies elected in October 2011 should be elected for a common term of office of approximately 3½ years ending in May 2015; and,
  2. agreed that, subject to the necessary transitional arrangements in respect of the 6 senatorial positions that will become vacant in 2014, all members of the States should, from May 2015, be elected for a common term of office of 4 years.

THE STATES, adopting paragraph (c) of the proposition of the Privileges and Procedures Committee, agreed that the number of Senators should be reduced from 12 to 8 over time and that this should be achieved by –

  1. electing 4 Senators for a period of 3½ years in the ordinary elections for Senators to be held in October 2011 (thereby reducing the total number of elected members of the Assembly from 53 to 51);
  2. electing a further 4 Senators for a period of 4½ years in the ordinary elections for Senators in October 2014 (thereby reducing the total number of elected members of the Assembly in that year from 51 to 49);
  3. electing 4 Senators for a period of 4 years in the ordinary elections for Senators in May 2015; and
  4. electing 8 Senators for a period of 4 years in the ordinary elections for Senator in May 2019 and every 4 years thereafter.
