THE STATES resumed consideration of the proposition of the Minister for Planning and Environment concerning the approval of the Island Plan 2011 (P.48/2011).

THE STATES, adopting a proposition of the Minister for Planning and Environment, agreed that, in accordance with the provisions of paragraph (4) of Article 4A of the Planning and Building (Jersey) Law 2002, an amendment to Amendment (54) lodged au Greffe' by the Minister for Planning and Environment (Amendment (54) Amendment) could be considered during the debate on the Island Plan 2011: approval'.

THE STATES, adopting an amendment of the Minister for Planning and Environment (Amendment (54)), as amended, agreed that in the inserted "Proposal 18 – Affordable Housing", after the words "following consultation with relevant stakeholders" there should be inserted the words "and the endorsement of the States.".

After the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in the section relating to Affordable housing –

  1. in paragraph 6.119 (page 251) the following words should be deleted –

this case the commuted sum will equate to the difference in value between an affordable home and a market home of the same type. The amount of the commuted payment should be capable of purchasing at least as much affordable housing as that which would have been provided on-site, or may be pooled to fund the construction of affordable homes elsewhere';

  1. in paragraph 6.120 (page 251) the following words should be deleted –

again, the commuted sum will equate to the difference in value between an affordable home and a market home of the same type. The amount of the commuted payment should be capable of purchasing at least as much affordable housing as that which would have been provided on-site, or may be pooled to fund the construction of affordable homes elsewhere.';

  1. paragraph 6.131 (page 253)." should be deleted.

After the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in the section relating to Affordable housing, after paragraph 6.132 (page 253) there should be inserted the following new proposal 18 –

Proposal 18: Affordable Housing

The Minister for Planning and Environment will carry out consultation, adopt and publish supplementary planning guidance on the operation of Policy H3: affordable housing. This will provide detail on the calculation of on-site and commuted sum values for any given housing development, together with practical information on the application of the policy, the use of planning obligation agreements, and policy procedure.

Policy H3 will not be applied until such a time that this guidance has been approved and published by the Minister for Planning and Environment, following consultation with relevant stakeholders and the endorsement of the States.".

and the subsequent proposals renumbered accordingly.".

"except  that  in  Policy H3  Affordable  Housing  (page 255)  paragraph 3,  after  the  words supplementary planning guidance' there should be inserted the words which, amongst other matters, will provide that the validity of such permissions will normally be limited to 3 years, with any extension being conditional upon the full ground works being completed during the 3 year period'.".

THE STATES, adopting an amendment of the Deputy of St. Mary (Amendment (20), Paragraph 3), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

THE STATES commenced consideration of an amendment of the Deputy of St. Martin (Amendment (5)) and, adopting an amendment of the Minister for Planning and Environment (Amendment (5) Amendment), agreed that in sub-paragraph 3, after the words "can be identified" there should be inserted the following words –

"and where the rezoning of land for this purpose is approved by the States as a draft revision of the Island Plan".

"except that in Policy SCO2 Healthcare facilities (page 277) after the words 2. within the Built-up Area,' there should be inserted the following words –

or where;

  1. in exceptional circumstances, the provision of other specialist healthcare facilities is supported by the Health and Social Services Department, where it can be demonstrated that no other suitable site within the grounds of existing healthcare facilities or the Built-up Area can be identified and where the rezoning of land for this purpose is approved by the States as a draft revision of the Island Plan'.".

THE STATES, adopting an amendment of the Minister for Planning and Environment (Amendment 57), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

  1. "except that in the Social, Community and Open Space chapter (page 278) after the words Proposal 13 Local Development Plans'.' There should be inserted the following paragraph, and those that follow renumbered accordingly –

7.38 To ensure and enable the development of community facilities which would

benefit from a harbour-side location, to include the development of a new headquarters facility for the Jersey Sea Cadets, it is considered appropriate to safeguard some land at St. Helier harbour specifically for this purpose.';

  1. and in Policy SCO3 Community facilities (pages 278–279) after the words within the Built-up Area;' there should be inserted the following paragraph –

To address deficiencies in the provision of community facilities, the following site is safeguarded for the development of community facilities, to include development of a building suitable to accommodate the headquarters facility for the Jersey Sea Cadets –

Following the adoption of the amendment of the Minister for Planning and Environment (Amendment (57)), the Bailiff informed the Assembly that the amendment of Deputy Ian Joseph Gorst of St. Clement (Amendment (25)) was deemed to have been withdrawn.

THE STATES adopting an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (Amendment (28)), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that –

  1. in the Proposals Map forming part of the Plan, the area surrounding the community building at La Providence, La Vallée de St. Pierre, St. Lawrence , which is currently in the Built-up Area, should be included within the Green Zone as shown in the Map attached at the Appendix;
  2. in Policy SCO3 – Community facilities (pages 278–279) after the words to meet the needs of the local community' there should be inserted the words There will be a presumption against the alternative development of community facilities that do not liein the Built-up Area.' ".

THE STATES commenced consideration of an amendment of the Deputy of St. Mary (Amendment (20), Paragraph 4) and, adopting an amendment of the Minister for Planning and Environment (Amendment (20), Paragraph 4 Amendment), agreed that in paragraph 4 of the amendment, for the words including for' there should be substituted the words which include considerations of safety, convenience and ease of access, with particular regard given to'.

THE STATES resumed consideration of the amendment of the Deputy of St. Mary (Amendment (20), Paragraph 4) as amended and agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in Proposal 18 – Open Space Strategy (page 283), in the second bullet point, after the words accessibility of open space' there should be inserted the words which include considerations of safety, convenience and ease of access, with particular regard given to the mobility-impaired and the elderly when living communally' ".

THE STATES, adopting paragraph 5 of an amendment of the Deputy of St. Mary (Amendment (20), Paragraph 5), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that –

  1. in Proposal 18 – Open Space Strategy (page 283), after the fourth bullet point there should be inserted a new bullet point as follows –
  • include a review of the ability of States-owned and privately-owned land to contribute towards the need for, and quality of, open space provision, particularly in St. Helier and other parts of the Built-up Area.'
  1. in paragraph 8.127 (page 325) for the words for other forms of built development' substitute the words for other forms of development, including the provision of open space' ".

THE STATES, adopting an amendment of the Minister for Planning and Environment (Amendment (40)), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in Policy TT1 – Protection of the Island's footpaths and cycle network (page 299), after the words of any part of the' delete the word existing'.

THE STATES, adopting paragraphs 1 and 2 of an amendment of the Deputy of St. Mary (Amendment (21), Paragraphs 1 and 2), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in paragraph 8.31 (page 299), after the words the Institution of Highways and Transportation guidelines' there should be inserted the words , interpreted and modified as necessary to Jersey conditions, with such adaptations to be consulted on with users.' ".

THE STATES, adopting paragraphs 16 and 17 of an amendment of the Connétable of St. Helier (Amendment (38), Paragraphs 16 and 17), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in section 8.36 – Footpath provision and enhancement (page 300) delete from the list of improvement lines to be abandoned La Pouquelaye' and Tower Road'.".

  1. In the title, after the word enhancement' there should be inserted the words , and walking routes';

THE STATES commenced consideration of an amendment of the Deputy of Grouville (Amendment (19)) proposed in her absence on States business, and in accordance with Standing Order 70(1A)(b), by the Connétable of St. Helier and, adopting an amendment of the Deputy of St. Mary (Amendment (19) Amendment), agreed that in Appendix 1 on page 4 of the amendment, in paragraph 8.55, for the word "provide" there should be substituted the word "include" and for the first bullet point there should be substituted the following bullet point –

  • safe facilities, both on and off-road, which link centres of population and community facilities,  particularly  schools, in the east of the Island with each other and which provide a linear route to St. Helier ; and'.

In Appendix 1 on page 4 of the amendment, in paragraph 8.58, for the words "enhancement of the route" there should be substituted the words "enhancement of the network".

In Appendix 1 on page 4 of the amendment, in paragraph 8.59, for the words "cycle path" there should be substituted the words "cycle network".

After the words "there should be inserted the word network'" there should be inserted the words "and for  the  words  "development  or  enhancement  of  the  route"  there  should  be  substituted  the  words "development or enhancement of the network".

THE STATES, adopting an amendment of the Deputy of Grouville (Amendment (19)), as amended, agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that –

  1. for paragraphs 8.55 to 8.59 (pages 305 to 307) there should be substituted the revised paragraphs 8.55 to 8.60 set out in the attached Appendix 1 (as amended);
  2. in Policy TT3 – Cycle routes (page 307) for the words Eastern Cycle Route Corridor' there should be substituted the words Eastern Cycle Route network area' and after the words contribute towards the further development of the Eastern Cycle Route' there should be inserted the word network'and for the words "development or enhancement of the route" there should be substituted the words "development or enhancement of the network";
  3. for Map 8.1 (page 306); there should be substituted the revised Map 8.1 set out in the attached Appendix 2;
  4. the Proposals Map be amended to reflect the adoption of (c).".

THE STATES commenced consideration of an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (Amendment (37), Paragraph 6) and, adopting an amendment of the Minister for Planning and Environment (Amendment (37), Paragraph 6) (Amendment 2), agreed that in Proposal 20 – Island path network', for the words development and maintenance of a network' there should be substituted the words improvement and expansion of the existing provision' and for the words across the Island, including the protection, improvement and expansion of the existing network.' there should be substituted the words aiming for Island-wide coverage, and a plan for developing a coherent network (both on-road and along the road side) for cyclists and walkers across the Island.'.

8.61 Whilst the earlier policies seek to protect the loss of the existing pedestrian or

cycle network (or other rights of way), and also consider the potential to provide new or enhanced footpaths, or off road cycle facilities, there is also a recognition that there should be a holistic approach to such provision.

8.62  Accordingly the Minister will seek to produce a holistic plan of the network in order to complement and inform the existing policies and to complement existing provision within the Island.

Proposal 20 – Island path network

The Minister for Planning and Environment will, in partnership with all other relevant stakeholders, seek to develop a plan for the improvement and expansion of the existing provision of off-road footpaths, bridle paths and cycle routes across the Island, including the protection, improvement and expansion of the existing network.'

and the Plan be renumbered accordingly;

THE STATES, adopting an amendment of the Minister for Planning and Environment (Amendment (41)); agreed that for the words "the revised draft Island Plan 2011" there should be inserted the words –

Following the adoption of the amendments of the Minister for Planning and Environment (Amendments (52) and (41)), the Bailiff informed the Assembly that the amendments of the Deputy of St. Mary (Amendment (22)) and the Connétable of St. Helier (Amendment (38), Paragraph 19) were deemed to have been withdrawn.

THE STATES, adopting an amendment of the Connétable of St. Helier (Amendment (38), Paragraph 20) agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in paragraph 8.119 (page 323) after the words the public realm' there should be inserted the words , including the provision of cycle routes' ".

THE STATES commenced consideration of an amendment of the Connétable of St. Helier (Amendment (38), Paragraph 21) and, adopting an amendment of the Minister for Planning and Environment (Amendment (38), Paragraph 21 Amendment) agreed that in paragraph 21, after the words except where' there should be added a semi-colon and a bullet point on a new line before the remaining words; after the words core areas' there should be inserted a semi-colon, and there should be inserted two further bullet points as follows –

  • such car parks replace an existing private non-residential car park within the Ring Road; and
  • there is no net increase in the provision of private non-residential car parking spaces.'

  • the provision of such car parks will contribute to reducing vehicular penetration of, and congestion in, core areas;
  • such car parks replace an existing private non-residential car park within the Ring Road; and
  • there is no net increase in the provision of private non-residential car parking spaces."

"except that in Policy NR7 – Renewable energy in new developments (page 364) after the second exception there should be inserted a new exception as follows –

  1. at least an equivalent impact on carbon emissions can be met by alternative means' ".

THE STATES, adopting an amendment of the Connétable of St. Helier (Amendment (38), Paragraph 23), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that in Policy NR8 – Safety zones for hazardous installations (page 366) in the last paragraph –

  1. after the word public', for the words will be the overriding consideration' there should be substituted the words and the extent to which any risks can be managed or mitigated will be the overriding considerations';

THE STATES, adopting an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (Amendment (16)), agreed that after the words "the revised draft Island Plan 2011" there should be inserted the words –

"except that after Policy IM1 – Plan, monitor and change (page 459) there should be inserted the following new Policy –

Policy IM2 – Governance

Procedures will be applied to ensure proper segregation of duties, particularly between –

Policy  Planning –  development  of  policy;  site  identification;  production  of development briefs, and

Island Plan 2011: approval P.48/2011

THE STATES commenced consideration of an amendment of Deputy Ian Joseph Gorst of St. Clement (Amendment (11)) proposed in his absence on States business, and in accordance with Standing Order 70(1A)(b), by Deputy John Alexander Nicholas Le Fondré of St. Lawrence , and an amendment to that amendment by Deputy Paul Vincent Francis Le Claire of St. Helier that field numbers 21A, 38, 38A, 39 and 59A should be deleted.

THE STATES noted that, in accordance with the provisions of Standing Order 106(1)(a), Deputy Edward James Noel of St. Lawrence declared an interest and withdrew from the Chamber for the duration of the debate on Amendment (11).
