THE STATES resumed consideration of Article 1 of the Draft Control of Housing and Work (Jersey) Law 201-, and rejected an amendment of the Corporate Services Scrutiny Panel to the amendment of Deputy Sean Seamus Patrick Augustine Power of St. Brelade that for the words "Minister for Housing" there should be substituted the words "Minister for Social Security".

  1. in paragraphs (4), (5), (6) and (7) for the words "3 months" in each place those words appeared there should be substituted the words "7 days";
  2. in paragraph (6) for the words "3 month" there should be substituted the words "7 day".

Following the rejection of his amendment to Article 1, the Bailiff informed the Assembly that the amendments of Deputy Sean Seamus Patrick Augustine Power of St. Brelade to Articles 13 and 48 were deemed to have been withdrawn.

THE STATES adopted Articles 11 to 24.

THE STATES commenced consideration of Article 25 as amended by an amendment of the Chief Minister that for paragraph (3) there should be substituted the following paragraph –

"(3) Subject to paragraphs (4) to (7), an undertaking which does not have a non-resident

trading licence does not have an appropriate licence if

  1. there is any significant change in the ownership of the undertaking after the date that this Article comes into force;
  2. more than 60 days have elapsed since that change took place; and
  3. the person carrying on the undertaking did not make an application, by the date of the expiry of that 60 day period, for the grant of a licence, or, if such an application was made, it was withdrawn or, under Article 26(7), treated as having been withdrawn.";

and for paragraph (10) there should be substituted the following paragraphs –

"(10) The Minister may, by Order –

  1. amend any expression of time referred to in sub-paragraphs (b) and (c) of paragraph (3);
  2. amend paragraphs (4) to (7) in respect of the circumstances in which there is deemed to be a significant change in the ownership of an undertaking for the purposes of paragraph (3).

(11)  The States may, by Regulations, repeal paragraphs (3) to (7), (10) and this paragraph.".

THE STATES re-assembled after the lunch adjournment under the Presidency of Mr. Michael Nelson de la Haye, Greffier of the States.

Mr. Michael Nelson de la Haye, Greffier of the States, retired from the Chair during consideration of Articles 9 and 10 of the Draft Control of Housing and Work (Jersey) Law 201-' (P.37/2011) and the meeting continued under the Presidency of the Bailiff . The Bailiff retired from the Chair during consideration of Articles 40 and 53 of the Draft Control of Housing and Work (Jersey) Law 201-' (P.37/2011) and the meeting continued under the Presidency of Mr. Michael Nelson de la Haye, Greffier of the States.

Clos des Sables: further development – petition P.121/2011

Deputy Montfort Tadier of St. Brelade presented to the States a petition on behalf of certain of the residents of Clos des Sables praying that the Minister for Treasury and Resources instruct the Property Holdings Department not to proceed with plans for the proposed sale of 2 plots of public land (one adjoining 116 and 123 Le Clos des Sables and the other separating 132 and 145 Le Clos des Sables).

THE STATES referred the petition to the Minister for Treasury and Resources and Deputy Montfort Tadier of St. Brelade lodged "au Greffe" a proposition to the effect that the prayer of the petition be granted.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Article 1, as amended by an amendment of the Chief Minister, that in Article 1 –

  1. the existing text should be numbered as paragraph (1);
  2. for the definition "public authority" there should be substituted the following definition –

" public authority' means any of the following –

  1. a Minister;
  2. a parish;";
  1. after paragraph (1) there should be inserted the following paragraph –

"(2)  The  States  may  by  Regulations  amend  the  definition  public  authority'  in

paragraph (1).".

THE STATES commenced consideration of a proposition of Deputy Trevor Mark Pitman of St. Helier , to refer to their Act dated 15th March 2011 in which they agreed that an Electoral Commission should be established, and to agree that it was undesirable that further proposals seeking to change the composition of the elected membership of the States Assembly, or to overturn decisions already taken in relation to the composition of the elected membership, should be debated by the States until after the findings of the Electoral Commission had been reported to, and considered by, the States (other than any proposition(s) needed to take forward the Commission's recommendations) and to agree that all members should be requested not to lodge any propositions on these matters until the Electoral Commission had concluded its work.
