THE STATES commenced consideration of the Draft Budget 2012 (P.159/2011) and rejected an amendment of Deputy Geoffrey Peter Southern of St. Helier that after the words "as set out in the Budget Statement" there should be inserted the words –
"except that estimate from New Company Fees via Financial Services Commission' shall be increased by £3,700,000 by increasing the additional charge payable to the States from the annual company registration fee from £115 to £230 and the estimate of income tax from Employees shall be decreased by £3,700,000 by increasing income tax exemption thresholds by 6.85% and not by 4.5% as proposed in the Budget Statement".

THE STATES, adopting a proposition of the Minister for Treasury and Resources, agreed that in accordance with the provisions of Article 20(3) of the Public Finances (Jersey) Law 2005, the amendment of the Minister for Treasury and Resources to the Draft Budget 2012 (P.159/2011), which was lodged less than 2 weeks before the debate, could be considered at the present meeting.
THE STATES, adopting paragraph (i) of an amendment of the Minister for Treasury and Resources to the Draft Budget 2012 (P.159/2011), agreed that after the words "as set out in the Budget Statement" there should be inserted the words –
"except that the estimate from stamp duty, which includes land transaction tax, shall be decreased by £200,000 by increasing the ceiling up to which first-time buyers are eligible for relief from stamp duty and land transaction tax from £400,000 to £450,000".

THE STATES rejected an amendment of Deputy Geoffrey Peter Southern of St. Helier to the Draft Budget 2012 (P.159/2011) that the proposition should be numbered as paragraph (a) and a new paragraph inserted as follows –
"(b) to request the Minister for Treasury and Resources to lodge a proposition in
accordance with Article 4(3) of the Public Finances (Jersey) Law 2005 asking the States to agree to transfer £20 million from the interest on the Strategic Reserve Fund to the Consolidated Fund so that the Minister for Treasury and Resources would have sufficient resources to maintain appropriate Fiscal Stimulus measures to support the economy through 2012."

THE STATES, having noted that Deputy Tracey Anne Vallois of St. Saviour , who was absent from the States through illness, had not, in accordance with Standing Order 70 (1A), made arrangements for another member of the States to propose her amendment to the Draft Budget 2012 (P.159/2011), were advised by the Deputy Bailiff that her amendment entitled Draft Budget 2012 (P.159/2011): third amendment' (P.159/2011 Amd.(3)) was therefore deemed to have been withdrawn.
THE STATES resumed consideration of the Draft Budget 2012 (P.159/2011) (as amended) and approved the estimate of total taxation revenue in 2012 of £574,778,000 as set out in summary Table A on page 48 of the Budget Statement, with the sum to be raised through existing taxation measures and the proposed changes to income tax, goods and services tax, impôts duty, and land transaction tax and stamp duty court fees for 2012 as set out in the Budget Statement, except that the estimate from stamp duty, which included land transaction tax, should be decreased by £200,000 by increasing the ceiling up to which first-time buyers were eligible for relief from stamp duty and land transaction tax from £400,000 to £450,000 and that the estimate from stamp duty court fees should be decreased by £2,000 by maintaining the fee for actions in the Petty Debts Court where the claim did not exceed £100, at £7 rather than increasing it to £15.

Draft Finance (2012 Budget) (Jersey) Law 201- P.160/2011
THE STATES commenced consideration of the Draft Finance (2012 Budget) (Jersey) Law 201- and adopted the principles.
THE STATES adopted Articles 1 to 8, as amended by the Minister for Treasury and Resources as follows –
that after Article 7(1)(c), there should be inserted the following sub-paragraph –
"(ca) in the table, in the proviso to item 1 –
- in paragraph (A) of the proviso, for the figure £60' there shall be substituted the words rate F',
- in paragraph (B) of the proviso, for the figure £6' there shall be substituted the words rate B';".
that in Article 7, in the table in paragraph (1)(c), under the heading "2(1) Actions in the Petty Debts Court", the item and entries relating to item 2(1)(a) of Part 1 of the Schedule to the Stamp Duties and Fees (Jersey) Law 1998 should be deleted.
that after Article 7 there should be inserted the following Article –
"8 Stamp duty and land transactions tax: first time buyers
- In Part 1 of the Schedule to the Stamp Duties and Fees (Jersey) Law 1998 –
- in item 1(a)(iv) for the words does not exceed £400,000' there should be substituted the words , in respect of duty due before 1st December 2012, does not exceed £450,000, or, in respect of duty due on or after that date, does not exceed £400,000';
- in item 1(a)(B) for the words but does not exceed £400,000' there should be substituted the words (but does not exceed the amount determined under sub- paragraph (iv))';
- for item 13(b)(ii) there should be substituted the following sub-paragraph –
| (ii) | exceeds £300,000 but, in respect of duty due before 1st December 2012, does not exceed £450,000, or, in respect of duty due on or after that date, does not exceed £400,000 | NIL in respect of the first £300,000 plus £1 for each £100 or part of £100 in excess thereof | Contract | Greffier'; |

(c) where the amount secured by the security agreement exceeds £400,000
but –
- the LTT isto be charged before 1st December 2012, and
- the amount secured by the security agreement does not exceed £450,000,
nil in respect of the first £300,000 plus 25p for each £100 or part of £100 in excess the first £300,000, subject to a minimum of £25.'.
- This Article should come into force on 1st December 2011.".
that the current Article 8 should be renumbered as Article 9 and for Article 9(2) as renumbered there should be substituted the following paragraph –
