Public Elections: amendments to legislation and administration P.110/2013

THE STATES commenced consideration of a proposition of the Privileges and Procedures Committee regarding  amendments  to  the  legislation  and  administration  of  public  elections  and  noted  that,  in accordance  with  Standing  Order  34(1),  the  proposer  had  informed  the  Greffier  of  the  States  that paragraph (F)(a) of the proposition had been withdrawn.

THE  STATES,  adopting  an  amendment  of  the  Comité  des   Connétable s  to  the  proposition  of  the Privileges and Procedures Committee, agreed that in paragraph (A)(d)(i) after the word "persons" there should be inserted the words "whose names are not on any Electoral Register in force in the Island" and in paragraph (A)(e) after the words "in the year of a public election," there should be inserted the words "being a general election for members of the States," and for the words "as soon as may be after the statement" there should be substituted the words "not earlier than 1 month after the deadline for the return of the Annual Statement which".

THE  STATES,  adopting  an  amendment  of  the  Comité  des   Connétable s  to  the  proposition  of  the Privileges and Procedures Committee, agreed that in paragraph (A)(g) the words "the registered long- term sick or disabled persons and" should be deleted and for the words "vote by post", there should be inserted the words "vote by pre-poll".

THE STATES resumed consideration of the proposition of the Privileges and Procedures Committee, as amended and, adopting paragraph (A) with the exception of paragraphs (A)(b) and (A)(j)(iii), agreed that –

(A)  amendments be made to the Public Elections (Jersey) Law 2002 and to the practical procedures relating to the organisation of elections to provide that –

(a)  persons due to attain their 16th birthday on or before the day of an election and residents who would have met the residence requirement on or before the day of an election may register in advance during the 3 month period prior to the closure of the supplementary register, namely 7 days before the day of an election;

  1. online electoral registration be introduced as soon as practicable;
    1. in addition to the main electoral register which closed the day before nomination day, a supplementary register be introduced; and
  1. persons whose names were not on any Electoral Register in force in the Island should be able to request that their name be added to a supplementary electoral register up until 7 days before the election;
  2. for the purposes of any election the electoral register for the district was the one in force 7 days before an election;
  1. in the year of a public election, being a general election for members of the States, a card be sent to all households not earlier than 1 month after the deadline for the return of the Annual Statement which was sent to each household –
  1. notifying the householder of the persons registered to vote at that address, with information on how to check the Register, the cards to be sent out sufficiently in advance of the deadline for registration to allow for corrections to be made;
  2. notifying the householder where no-one was registered to vote at that address with information on how to register;
  1. the period between nomination day and election day to revert to a period of no more than 4½ weeks;
  2. prisoners on remand should be entitled to vote by pre-poll;
  3. the removal of the need for a witness to the declaration of identity form which accompanied a postal vote;
  4. pre-poll voting be offered on a Saturday before election day in a town location and 2 separate out-of-town locations on at least 2 Saturdays;
  5. procedures for recounts should be amended, to include –
  1. that a provision was included to make clear the Autorisé's ability to count the votes again in order to double-check the result before making an announcement;
  2. that (as recommended by the Royal Court in the case of P.V.F. Le Claire

v.  H.M. A.G. Judgment (2011)) the spoilt votes were shown to the candidate in the event of a close result;

  1. that where the result revealed a close vote between 2 candidates, the candidate or his/her duly appointed representative may demand a recount within 24 hours of the announcement of the result, providing that they or their representative was present for the count (The recount may not necessarily be able to be executed the same day.);
  2. the ability for candidates to demand a recount if the difference between 2 votes was 1% or less of the total number of votes cast;
  3. the provisions relating to a recount on the basis of a disputed election should make clear the circumstances in which a recount may be requested of the Royal Court at this stage.

THE STATES, adopting paragraph (B) of the proposition of the Privileges and Procedures Committee, as amended, agreed to request the Comité des Connétable s to implement the administrative improvements as set out on pages 10–13 of the report of the Public Elections Sub-Committee set out at the Appendix of the report accompanying the proposition.

THE STATES, adopting paragraph (C) of the proposition of the Privileges and Procedures Committee, as amended, with the exception of paragraphs (C)(g) and (C)(k), agreed the administrative improvements as set out on pages 10–13 of the report of the Public Elections Sub-Committee set out at the Appendix to the report accompanying the proposition to include –

  1. sample canvassing to establish reasons for non-registration;
  2. increase opportunities to include names on the electoral register;
  3. an online facility to request a pre-poll sick vote' or a postal vote;
  4. revision of the statement/registration form issued by the Parishes;
  5. increased public awareness and information campaigns;
  6. I.T. for electoral purposes to be reviewed and improvement of street order list';
  1. the guidelines for the Autorisés be reviewed regarding candidates' supporters and procedures in the event of a name being left off the electoral register owing to administrative error;
  2. the arrangements for casting a sick vote' on election day to be well publicised;
  3. more eye-catching advertisements publicising pre-poll voting;
  1. a review of procedures for counting, to include where a count needs to resume on a second day, and of procedures for pre-poll voting in a second and subsequent location;
  2. a review of procedures for recounts, to include showing spoilt votes to candidates in the event of a close result and the ability to demand a recount within 24 hours of the announcement of a result at the close of the count;
  3. the revision of the Return made by the district at the end of an election.

THE STATES, adopting paragraph (C)(g) of the proposition of the Privileges and Procedures Committee, as amended, agreed the administrative improvements as set out on pages 10–13 of the report of the Public Elections Sub-Committee set out at the Appendix to the report accompanying the proposition to include ballot papers to be larger, and photos of candidates in polling stations.

THE STATES, adopting paragraph (D) of the proposition of the Privileges and Procedures Committee, as amended, agreed to request the Privileges and Procedures Committee to –

  1. conduct a feasibility study on the use of the Names and Addresses Register for electoral registration, with a view to enabling legislation to be prepared to allow the provision of a service under the Register of Name and Addresses (Jersey) Law 2012 or the Control of Housing and Work (Jersey) Law 2012 (as appropriate);
  2. investigate  electronic  voting,  and  prepare  a  report  within  12 months  on  real-time technology  and  electronic  touch-screen  technology  to enable  electronic  voting  at  a polling station;
  1. investigate and bring forward for approval an amendment to require Jersey Post to deliver one addressed envelope to each elector jointly from candidates in the district.

THE STATES, adopting paragraph (E) of the proposition of the Privileges and Procedures Committee, as amended, agreed to seek to implement the administrative improvements as set out on pages 10–13 of the report of the Public Elections Sub-Committee set out at the Appendix of the report accompanying the proposition;

THE STATES, adopting paragraph (F) of the proposition of the Privileges and Procedures Committee, as  amended,  agreed  to  request  the  Privileges  and  Procedures  Committee  to  bring  forward  the amendments to the States of Jersey Law 2005 to achieve the following –

  1. that the States Assembly should not meet after nominations were announced, save for the deliberation of emergency matters, and ensure that no new policies were formulated, promoted or approved during the election period;
  2. save for the deliberation of emergency matters, the States should not make decisions during the election period;
  3. the newly elected States members to sit in the States Assembly as soon as may be after they had been elected and the swearing in of members to take place at an appropriate time to accommodate this.

THE  STATES commenced consideration of the Draft Community Provisions (Welfare of Animals During Transport) (Jersey) Regulations 201- and adopted the principles.
