Planning Applications Committee – appointment of member

In accordance with Standing Order 125A(1) the Connétable of St. Mary, Chairman of the Planning Applications Committee, indicated that she wished to have a Committee of 7 members, including the chair, and nominated Deputy Scott Michael Wickenden of St. Helier as a member of the Planning Applications Committee.

There  being  no  other  nominations,  the   Bailiff  declared  that   Deputy   Scott  Michael  Wickenden  of St. Helier had been duly appointed as a member of the Planning Applications Committee.

Economic Affairs Scrutiny Panel – appointment of Chairman

In accordance with the provisions of Standing Order 120(1), the Connétable of Grouville nominated Deputy Simon Muir Brée of St. Clement as Chairman of the Economic Affairs Scrutiny Panel.

There being no other nominations, the Bailiff declared that Deputy Simon Muir Brée of St. Clement had been duly appointed as Chairman of the Economic Affairs Scrutiny Panel.

THE STATES, having been informed that the relevant scrutiny panel did not wish to scrutinise the draft legislation, commenced consideration of Regulation 1 and an amendment of the Corporate Services Scrutiny Panel.

THE STATES, adopting an amendment of the Minister for Treasury and Resources to the amendment of the Corporate Services Scrutiny Panel, agreed that for paragraphs (d) and (e) of the amendment there should be substituted the following paragraph and the remaining paragraphs should be renumbered accordingly –

"(d) for paragraph (2)(d) of the inserted Article 8A, there should be substituted the following

sub-paragraph –

(d) a draft addition must be lodged no later than 30th June 2016.'.".

THE STATES, adopting an amendment of the Corporate Services Scrutiny Panel, as amended, agreed that, in paragraph (c) –

  1. in the heading to the inserted Article 8A after the words "Medium term financial plan" there should be inserted the words "for 2016 to 2019";
  2. in paragraph (1) of the inserted Article 8A, for the words "A draft medium term financial plan" there should be substituted the words "The draft medium term financial plan for the financial years 2016 to 2019";
  1. in paragraph (2) of the inserted Article 8A, for the words "Where such amounts for the second or a subsequent financial year are omitted from a draft medium term financial plan -" there should be substituted the words "If such amounts for the second or a subsequent financial year are omitted from the draft medium term financial plan for the financial years 2016 to 2019 –";
  2. for paragraph (2)(d) of the inserted Article 8A, there should be substituted the following sub-paragraph –

(d) a draft addition must be lodged no later than 30th June 2016.'.".

  1. after paragraph (5) of the inserted Article 8A, there should be added the following paragraph –

"(6) The minimum lodging period that applies to a draft medium term financial plan shall

also apply to a draft addition (whether lodged by the Council of Ministers or, in accordance with paragraph (5), by the Minister).".

Esplanade Quarter Development: Scrutiny Review and Referendum P.44/2015

THE STATES commenced consideration of a proposition of Deputy Montfort Tadier of St. Brelade concerning the Esplanade Quarter development and, adopting an amendment of Deputy Montfort Tadier of St. Brelade , agreed that –

"1. In paragraph (a) before the words "binding agreements" there should be inserted the word

"further"; the word "preparatory" should be deleted and after the words "should be started" there should be inserted the words "or continued".

2.  In paragraph (b) for the words "agree that, following" there should be substituted the words "request the Council of Ministers, within one month of"; after the words "paragraph (a)" there should be inserted the words "to lodge for debate a proposition asking the States Assembly to support the development, and to agree that"; before the words "agreements for development" there should be inserted the word "further"; the word "preparatory" should be deleted; after the word "started" there should be inserted the words "or continued" and for the words "in question have been approved by the majority of those voting in a referendum held under the Referendum (Jersey) Law 2002," there should be substituted the words "have been approved by the Assembly".".

THE STATES, having resumed consideration of a proposition of Deputy Montfort Tadier of St. Brelade , rejected paragraph (a), as amended, to request the Minister for Treasury and Resources to give directions to the States of Jersey Development Company Limited in accordance with Article 22(a) of the Articles of Association of the company that no further binding agreements should be entered into by the company for the development of new office accommodation on the site known as the Esplanade Quarter, St. Helier , and no building works should be started or continued, until the Corporate Services Scrutiny Panel had presented to the States the final report arising from its current scrutiny review of the project.

Jersey Financial Services Commission: re-appointment of Commissioner P.47/2015

THE STATES commenced consideration of a proposition of the Chief Minister regarding the re- appointment of a Commissioner of the Jersey Financial Services Commission.

THE STATES noted that, in accordance with Article 3(2) of the Financial Services Commission (Jersey) Law 1998, the discussion of this matter had to take place in camera. The Bailiff , in accordance with Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate in camera, proceeded to vote in public assembly and, in pursuance of Article 3 of the Financial Services Commission (Jersey) Law 1998 appointed Crown Advocate Cyril Edward Whelan as a Commissioner of the Jersey Financial Services Commission with effect from the date of the States' debate for a period of 5 years.
