THE STATES commenced consideration of the Draft Criminal Justice (Insane Persons) (Amendment) (Jersey) Law 201- and adopted the principles.
THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Article 1.
THE STATES commenced consideration of Article 2 and, adopting an amendment of the Chief Minister, agreed that for paragraphs (b) and (c) there should be substituted the following paragraphs –
"(b) in paragraph (2), for the words "by the Superior Number" there shall be substituted the
words "by the Inferior Number";
- in paragraph (3) –
- for the words "If the Superior Number" there shall be substituted the words "If the Inferior Number", and
- for the words "original court" there shall be substituted the words "that court".".

THE STATES, in pursuance of Article 48 of the States of Jersey Law 2005, made Amendment (No. 27) of the Standing Orders of the States of Jersey.
Draft Planning and Building (Amendment of Law) (Jersey) Regulations 201- P.2/2015
THE STATES commenced consideration of the Draft Planning and Building (Amendment of Law) (Jersey) Regulations 201- and adopted the principles.
THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 7.
THE STATES commenced consideration of Regulation 8 and, adopting an amendment of the Minister for Planning and Environment, agreed that for Regulation 8 there should be substituted –
"8 Article 12 amended
At the end of Article 12 there shall be added the following paragraphs –
"(6) A person aggrieved by a determination by the Minister under this Article may appeal
against the determination to the Royal Court only on a point of law (and for the avoidance of doubt, no appeal arises under Part 7).
- An appeal under paragraph (6) must be made within the period of 28 days beginning with the date of the determination.
- On hearing the appeal the Royal Court may –
- confirm the determination of the Minister wholly or in part;
- quash the determination of the Minister wholly or in part;
- remit the determination, wholly or in part, to the Minister to be retaken.
- In paragraph (6), a "person aggrieved" means –
- where the Minister determines that planning permission should be granted, the applicant for planning permission and any third party;
- where the Minister determines –
- that conditions should be attached to a grant of planning permission, or
- that planning permission should be refused,
the applicant for planning permission,
and for the purposes of sub-paragraph (a), "third party" has the same meaning as is given to that expression by Article 108(4).".

THE STATES, adopting an amendment of the Minister for Planning and Environment, agreed that after Regulation 37 there should be inserted the following Regulation –
"37A Article 50 amended
In Article 50, in the definition " "List of Sites of Special Interest" or "List" " the words "by the Minister" shall be deleted.".

THE STATES, adopting an amendment of the Minister for Planning and Environment, agreed that after Regulation 69 there should be inserted the following Regulation –
"70A Article 116 amended
For paragraph (5) of Article 116 there shall be substituted the following paragraphs –
"(5) No further appeal shall lie from the Minister's determination under this Article
except to the Royal Court on a point of law.
(5A) An appeal under paragraph (5) must be made within the period of 28 days
beginning with the date of the determination.
(5B) On hearing the appeal the Royal Court may –
- confirm the determination of the Minister wholly or in part;
- quash the determination of the Minister wholly or in part;
- remit the determination, wholly or in part, to the Minister to be retaken.
(6) The power to make rules of court under Article 13 of the Royal Court (Jersey) Law 1948 shall include the power to make rules regulating practice and procedure in relation to appeals under paragraph (5) of this Article.".

THE STATES, adopting a proposition of the Minister for Planning and Environment, agreed that fees could be charged for the submission of an appeal against a decision or action taken under Article 112 of the Planning and Building (Amendment No. 6) (Jersey) Law 2014 at a level as set out below –
- For an appeal against the refusal (or deemed refusal after non-determination of the application) for planning
permission, including for a development which had already
taken place, for a minor development (as defined by the
Department) £100.00
- For an appeal against the refusal (or deemed refusal after non-determination of the application) for planning
permission, including for a development which had already
taken place, for a major development (as defined by the
Department) £300.00
- For an appeal against the imposition of a condition or the
refusal to vary or remove a condition (both major and minor
applications) £100.00
- For an appeal against the granting of a planning permission (both major and minor) £300.00
- For an appeal against –
- the listing of a building or place,
- the listing of a tree,
- the service of a notice requiring action (including an
enforcement notice), or
- the refusal to grant building bye-laws permission,
- the refusal to grant a certificate of completion,
- the refusal to grant permission to undertake particular
activities on/in/under a Site of Special Interest;
- the imposition of a condition on any permission
previously granted,
- the refusal to grant permission for the importation or
use of a caravan in Jersey,
- the revocation or modification of any planning
