THE STATES noted that, in accordance with the provisions of Standing Order 106(2), Deputy Kirsten Francis Morel of St. Lawrence declared a financial interest in the subject matter of Oral Question 173/2019.

Proposition to mark Deputy Montfort Tadier of St. Brelade en défaut – Ruling by the Bailiff

The Bailiff , further to the withdrawal of Deputy Montfort Tadier of St. Brelade from the Chamber prior to asking an oral question he had submitted, advised the Assembly of the following ruling which he had made in respect of a proposition of the Deputy of St. Ouen that Deputy Montfort Tadier of St. Brelade consequently be marked en défaut –

"The obligation of elected Members, under the States of Jersey Law 2005, is to take an oath of office, which includes this language: "You will attend the meetings of the States whenever you are called upon to do so." We all know that Members come and go from the Chamber from time to time during the course of a meeting and that the purpose of the roll call is to ensure that there is a record of those who turn up to meetings of the Assembly in accordance with the oath of office, which has been taken. There is nothing in Standing Orders which suggests that, having answered to the roll, you can then be declared en défaut at a later stage. I think, for myself, I would have some difficulty in taking that step now. The option for the Deputy of St. Ouen to consider – it is entirely a matter for the Deputy and I am not suggesting it at all – would be a motion of censure under Standing Order 21(b), which the Deputy would have to take at a later stage, but it may be we all have reacted quickly sometimes in circumstances where we would, on reflection, not have reacted in quite that way and the Deputy may well feel that it is best done and dusted and left. At any rate, I do not think it is appropriate to mark Deputy Tadier en défaut."

THE STATES commenced consideration of a proposition of Senator John Alexander Nicholas Le Fondré entitled Establishment of an elected Speaker' (P.47/2019) and rejected a proposition of the Connétable of St. Helier that, in accordance with Standing Order 83(1)(a), the matter should be referred back to Senator John Alexander Nicholas Le Fondré in order that further information relating to the proposition could be provided to the Assembly.

THE STATES rejected the proposition of Senator John Alexander Nicholas Le Fondré that –

  1. whilst retaining the Bailiff in his role as President of the States, the States Assembly should select a Speaker from the elected members of the Assembly to be able to preside in the absence of the Bailiff and Deputy Bailiff ;
  2. the selection and appointment of the Speaker should be the first items of business for any new States Assembly and, should the office become vacant during the term of an Assembly, be the first item of business at the next scheduled meeting of the Assembly;
  3. the Speaker should be elected to serve for the duration of an Assembly term, or for the remainder of the Assembly's term if (for any reason) he or she is elected mid-term;
  4. the process for electing the Speaker should follow a similar format as those for the election of the Chief Minister, Ministers and Scrutiny Panel Chairmen;
  5. provision should be made for the Speaker to resign and/or be removed from office by the States Assembly;
  6. the Speaker should be required to act impartially, and be seen to act impartially, when presiding over the States. Upon being elected, the Speaker would be required to resign from any membership of a political party;
  7. the Speaker, while presiding at the meeting, shall have the same powers as the Bailiff when presiding at such a meeting;
  8. the role of the Speaker shall include the promotion of the States Assembly and of democracy in Jersey;
  9. the additional resources required to support a Speaker should be provided for within the current structure of the States Greffe;
  10. the Privileges and Procedures Committee should bring forward all necessary actions, including legislative amendments, to implement these changes in time for the Assembly to select and appoint a Speaker as soon as is reasonably practicable.

Housing developments for first-time buyers: allocation criteria P.53/2019

THE STATES commenced consideration of a proposition of Deputy Inna Gardiner of St. Helier entitled Housing development for first-time buyers: allocation criteria' (P.53/2019) and, adopting an amendment of Deputy Inna Gardiner of St. Helier (P.53/2019 Amd.), agreed that –

In paragraph (a), after the words "buy local property as" the word "a" should be deleted;

In paragraph (a), after the words "is located;" the words "and that all families qualified to buy local property as first-time buyers should be treated equally; and" should be deleted and there should be inserted a new paragraph (b) as follows –

"(b)  to agree that all families qualified to buy local property as first-time buyers should be treated

equally; notwithstanding that anyone presently registered for Parish Housing Schemes currently under development in partnership between Parishes and the Affordable Housing Gateway should not be affected adversely as a result of this proposition; and"; and

The original paragraph (b) should be deleted and substituted with a new paragraph (c) as follows –

"(c)  to request the Minister for Children and Housing to comprehensively detail and confirm the

Allocations and Affordability Criteria used to determine persons as being eligible to access the Affordable Housing Gateway register and purchase a family home, and to publish it by the end of 2019.".

THE STATES resumed  consideration of the proposition of Deputy Inna   Gardiner of   St. Helier , as amended, and, adopting a proposition of the Connétable of St. Clement , agreed, in accordance with the provisions of Standing Order 84, that the proposition be put to the vote.

THE STATES, resuming consideration of the proposition of Deputy Inna Gardiner of St. Helier , as amended, rejected paragraph (a) of the proposition that the Allocations and Affordability Criteria set by the Minister for Children and Housing, which determined when a family was eligible to access the Affordable Housing Gateway register and to purchase a house, should not give priority to anyone based on their ability to demonstrate close links with the Parish in which any affordable housing development was located.

Changes in Presidency

Dr. Mark Egan, Greffier of the States, retired from the Chamber during consideration of the proposition of Deputy Inna Gardiner of St. Helier entitled Housing development for first-time buyers: allocation criteria' (P.53/2019), and the meeting continued under the Presidency of the Bailiff .
